W. R. HURLER; APPROPRIATING THE SUM OF $ 6,811 OUT OF NO. 291 PARK BOND FUND, OF WHICH SUM 136,475 IS FOR ACQUISITION AND $336 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING COST; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE,CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED TO EXECUTE A REAL ESTATE SALES CONTRACT WITH THE OWNER OF PARCEL N0. 10, BAYFRONT OPEN SPACE PROJECT NO. 291 -7o -8, SAID OWNER BEING DR. W. R. HURLER, SAID PARCEL BEING DESCRIBED AS FOLLOWS: Tract 1: All of that tract of land lying northeast of Ocean Drive directly opposite the below described tract, and between Ocean Drive and Corpus Christi Bay, the north and south boundaries of such tract to be determined just as though the most northerly boundary line of the below described tract of land and the most southerly bound- ary .line of the below described tract of land had been extended from the east bour_dsf line of Ocean Drive to Corpus Christi Pay, SAVE and EXCEPT that portion conveyed by QCD 8 -17 -67 from W. R. Hubler et ux to City of Corpus Christi recorded in Volume 1247/15 Deed Records, Nueces County, Texas and containing 295.69 sq. feet. REFERENCED DFSCRTPTIO0.T: 1. Being a portion of what is corsnonly no-,,T, as the Harney 1000 acre tract, about two and and =half miles south of the Nueces County Courthouse, and more particularly described as follows, to-wit: Beginning at a Pine stake 205.58 feet S. 411 0 34' E. from the Eastern corner of a tract of land conveyed by Matthew Dunn and Laura Dunn to T. T. Elliott, as of record in Vol. 23, page 491/493, deed records of TTueces County, for the northern corner of this survey. Thence S. 440 34' E. 22.98 feet to a pine stak& for a corner of this sur- vey. Thence curve to the right with 46 03' curve 67.46 feet to a pine stake for a corner of this survey. Thence curve left with 250 32' curve 111.5 feet to0a pine stake for the Eastern corner of this survey. Tinence S. 58 50'. W. 308.06 feet to a Dine stake for the Southern_ corner of this survey. Thence N. 440 3T1, 1•7. 102.79 feet to a pine state for the western corner of this survey. Thence N. 580 50' E. 332.23 feet to the place of beginning. Tract II Being a portion of Block 12, Bessar Park, an addition to the City of Corpus Christi, Texas, according to plat recorded in Vol. 6, Page 38, 14ap Records, Nucces County, Texas and being more particularly described as follows, to -wit: Being that portion.of Block 12, being seventy (70) feet wide, and lying between the North boundary line of said Block 12, and the South or Southeast boundary line of the below described tract, extended to Corpus Christi Bay, SAVE and EXCEPT that portion conveyed by QCD 8- 17 -6'1 from W. R. Hubler et ux to City of Corpus Christi recorded in Volume 1247/15 Deed Records, Nueces County, Texas and containing 295.69 Sq. feet. REFEP.ENCF,D DESCRIPTION: 1. Being a portion of Block 11, Bessar Paxk Addition to the City of Corpus Christi Nueces County, Texas, and being more particularly des- cribed as follows: Beginning at the North or Northeast corner of Block Eleven, —Mence in a Southwesternly direction along the North line of said Block. 11, approx- imately 309.08 feet to the Best corner of said Block 11, same being on the Fast boundary line of Denver Avenue for the West or Northwest corner of this tract, Thence in a Southeasterly direction along the Eastern boundary line of Denver Avenue, and the Western boundary line of said Block 11, 75 ' to a point for the South or Southwest corner of this tract; Thence in a Northeasternly direction along a line parallel to the North line of said Block 11, and 75' distant therefrom approximately 176.08' to a point, Thence in a Northeesternly direction on a line parallel with the Western boundary line of Block 11, 5' to a point, Thence in a Northeasternly direction along a line parallel to the North line of said Block 11 and 70' distance therefrom to a point on the 'nest line of Ocean Drive for the East or Southeast corner of this tract, Thence in a northerly direction along the West line of Ocean Drive and the East line of said Block 11, to the place of beginning. Said tract is Sometimes known as, and is shown by Bracy's Block, Maps of the City of Corpus Christi, as Lot C, Block 12, Bessar Park Addition. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 291 PARK BOND FUND $36,811, OF WHICH SUM $36,475 IS FOR ACQUISITION OF THE AFORESAID PARCEL No. lO AND $336 IS FOR INCIDENTAL EXPENSE RELATING TO CLOSING COSTS. SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE NECESSARY DOCUMENTS AND TO AUTHORIZE THE PAYMENT OF FUNDS FOR THE ACQUISITION OF THE AFORESAID PARCEL OF LAND IN ORDER TO PROCEED WITH THE DEVELOPMENT OF THE BAYFRONT OPEN SPACE PROJECT, CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT -2- AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY RO ORDAINED, THIS THE 29TH DAY of JULY, 1970.
