HomeMy WebLinkAbout09871 ORD - 07/29/1970JKH:7 -29 -70 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT WITH BLUE WATER INDUSTRIES, INCORPORATED, FOR CONSTRUCTION OF THE LAGUNA MADRE WATER LINE, PROJECT NO. 202 -68 -29.3 (PART B), EDA PROJECT NO. 08-1- 00747, SUBJECT TO FINAL APPROVAL FROM THE ECONOMIC DEVELOPMENT ADMINISTRATION; APPROPRIATING FROM THE NO. 202 WATER SYSTEM BOND FUND THE SUM OF $475,861.55, of WHICH $453,943.64 Is FOR THE CONSTRUCTION CONTRACT AND $21,917.91 IS FOR CON- TINGENCIES, INCLUDING ENGINEERING FEES, INSPECTION, STAKING, RADIOGRAPHIC TEST, LABORATORY TESTING, AND OTHER INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH BLUE WATER INDUSTRIES, INCORPORATED, FOR CONSTRUCTION OF THE LAGUNA MADRE WATER LINE, PROJECT N0. 202 -68 -29.3 (PART B), EDA PROJECT NO. 08-1 - 00747, SAID WORK TO CONSIST OF THE CON- STRUCTION OF A 16" WATER SUPPLY LINE APPROXIMATELY 14,759 LINEAR FEET, COMPLETE IN PLACE AS IS MORE FULLY DESCRISEDIN THE PLANS AND SPECIFICATIONS, FROM LAGUNA SHORES ROAD IN FLOUR BLUFF ACROSS THE LAGUNA MADRE TO THE WESTERN SIDE OF PADRE ISLAND, SUBJECT TO FINAL APPROVAL FROM THE ECONOMIC DEVELOPMENT ADMINISTRATION, ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORD- ING TO THE BID OF BLUE WATER INDUSTRIES, INCORPORATED, OPENED ON THE 15TH DAY OF JULY, 1970, THE SAID BID OF BLUE WATER INDUSTRIES, INCORPORATED, BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE N0.202 WATER SYSTEM BOND FUND THE SUM OF $475,861.55, OF WHICH $453,943.64 IS FOR THE CONSTRUCTION CONTRACT AND $21,917.91 IS FOR CONTINGENCIES, INCLUD- ING ENGINEERING FEES, INSPECTION, STAKING, RADIOGRAPHIC TEST, LABORATORY TESTING, AND OTHER INCIDENTAL EXPENSES. THE NECESSITY TO PROVIDE A WATER TRANSMISSION FACILITY TO PADRE ISLAND BECAUSE DEVELOPMENT OF THE ISLAND AS A RESORT, RECREATION, '9871 s _ � AND RESIDENTIAL AREA HAS CREATED A NEED FOR ADDED WATER SUPPLY, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THAT THE CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29TH DAY OF JULY, 1970- ATTEST: C TY SECRYI R kPPROdED: DAY OF JULY, Y70.
