SHEPPARD FARM LOTS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO DEDICATION OF A CUL -DE -SAC AT THE END OF TULOSO CIRCLE; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING 1C�ONCERNING THE CLOSING OF A PORTION OF TULOSO CIRCLE, ppBEING THE SOUTH 419.70 FEET OF TULOSO CIRCLE LOCATED IN LOTS 27 AND 2V OF THE H. B. SHEPPARD FARM LOTS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID STREET AND WITHIN 1150 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, JULY 22, 1970, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING THAT THE PORTION OF THE STREET ABOVE DESCRIBED IS NOT NOW NEEDED FOR STREET PURPOSES, NOR WILL IT WITHIN THE FORESEEABLE FUTURE BE NEEDED FOR STREET PURPOSES; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE ABOVE DESCRIBED PORTION OF TULOSO CIRCLE SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE PORTION OF TULOSO CIRCLE, HEREINAFTER MORE FULLY DESCRIBED, BE, AND THE SAME IS HEREBY, CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY, SUBJECT, HOWEVER, TO DEDICATION OF A CUL -DE -SAC AT THE END OF TULOSO CIRCLE: 9871.- FIELDNOTES for the southerly 419 feet, more or less, of the right -of -way line of that certain public street known as Tuloso Circle, dedicated by deed recorded in Volume 928, Page 389, of the deed records of Nueces County, Texas, and more particularly described as follows: BEGINNING at a point in the east right -of -way line of said Tuloso Circle, for the northeast corner and POINT OF BEGINNING of this tract whence the southwest corner of Lot A as shown by map of- Lots A, B, and C, Tuloso Circle, as recorded in Volume 25, Page 36 of the map records of said county, bears with said right -of- way line North 868.30 feet; THENCE with said east right -of -way line south 419.70 feet to the southeast corner of Tuloso Circle and the southeast corner of this tract; THENCE west 50 feet to the southwest corner of Tuloso Circle and the southwest corner of this tract; THENCE with the west right -of -way line of Tuloso Circle north 419.70 feet to the northwest corner of this tract; THENCE crossing the right -of -way of Tuloso Circle in a'south- easterly direction with a circular curve to the left whose radius center bears N 30° E 50 feet, said curve having a central angle m 60 °, tangent = 28.87 feet, for an arc distance of 52.36 feet to the POINT OF BEGINNING, and containing 0.476 acres, more or less. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WILL BE BETTER SERVED BY THE CLOSING OF THE AFORESAID PORTION OF TULOSO CIRCLE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THATNO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29 DAY OF JULY, 1970.
