HomeMy WebLinkAbout09875 ORD - 07/29/1970J AN ORDINANCE CLOSING A PORTION OF BILTMORE DRIVE, FROM THE SOUTHWEST RIGHT OF WAY LINE OF BILTMORE DRIVE, EXTENDING IN A SOUTHWESTERLY DIRECTION FOR A TOTAL OF APPROXIMATELY 160 FEET, LOCATED IN COUNTRY CLUB ESTATES NO. 12, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CON- CERNING THE CLOSING OF A PORTION OF BILTMORE DRIVE, FROM THE SOUTHWEST RIGHT OF WAY LINE OF BILTMORE DRIVE, EXTENDING IN A SOUTHWESTERLY DIREC- TION FOR A TOTAL OF APPROXIMATELY 160 FEET, LOCATED IN COUNTRY CLUB ESTATES NO. 12, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID STREET AND WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR COUNCIL MEETING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, JULY 22, 1970, IN ACCORDANCE WITH THE PROVI- SIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL THAT THE PORTION OF THE STREET ABOVE DESCRIBED IS NOT NOW NEEDED FOR STREET PURPOSES, NOR WILL IT WITHIN THE FORESEEABLE FUTURE BE NEEDED FOR STREET PURPOSES; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE ABOVE DESCRIBED PORTION OF BILTMORE DRIVE SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT PORTION OF BILTMORE DRIVE, MORE FULLY DESCRIBED HEREINAFTER, IN THE CITY OF CORPUS CHRISTI, TEXAS, IS HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY: 9875 FIELDNOTE DESCRIPTION of that portion of a City street prpposed to be closed and known as Biltmore Circle as shown by map of Country Club Estates Unit 12 as recorded in Volume 34, Page 131 of the Map Records of Nueces County, Texas. INNING at the intersection of the centerlines of Biltmore Drive and Biltmore Circle thence with the centerline of Biltmore Circle S 73* 43' 93" W 33.13 feet to a point in the east boundary line of this tract and the POINT OF BEGINNING. THENCE N 16* 16' 57" W 2S feet to the northerly right -of -way line of Biltmore Circle for the northeast corner of this tract. THENCE continuing with said right -of -way line S 73* 43' 03" W 31.87 fett to the point of curve of a circular curve to the right. THENCE with said curve having a central angle a 45* 14' 23", radius a 34.SO feet, tangent - 14.37 feet, for an arc distance of 27.24 feet to the point of reverse curve of a circular curve to the left. THENCE with said curve having a central angle a 270* 28' 4611, radius - 50 feet, for an arc distance of 236.04 feet to the point of curve of a reverse curve to the right. THENCE with said curve having a central angle a 45* 14' 23 ", radius - 34.50 feet, tangent a 14.37 feet, for an arc distance of 27.24 feet to the point of tangency. THENCE N 73* 43' 03" E 31.87 feet to the southeast corner of this tract. THENCE N 16* 16' 57" W 25 feet to the centerline of said Biltmore Circle and the POINT OF BEGINNING. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID PORTION OF BILTMORE DRIVE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29TH DAY OF JULY, 1970.
