AN ORDINANCE CLOSING THE STUB END OF HUDSON STREET, BETWEEN BLOCK 1 AND BLOCK 9, MIDWAY ADDITION; THE STUB END OF ROSALIE BOULEVARD, LYING BETWEEN BLOCK 9, MIDWAY ADDITION, AND BLOCK 6, PRESCOTT PARK, UNIT #1; AND THE STUB END OF GARDEN DRIVE, LYING BETWEEN BLOCK 7, INWOOD VILLAGE, UNIT #1, AND BLOCK 8, INWOOD VILLAGE, UNIT #2; RESERVING, HOWEVER, THE UTILITY EASEMENT IN OW-_ ROSALIE 84W, _AND AN EASEMENT ACROSS EACH STREET CON- TINUING THE REAR LOT EASEMENT; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CONCERNING THE CLOSING OF THE STUB ENDS OF ROSALIE BOULEVARD, HUDSON STREET AND GARDEN DRIVE, MORE FULLY DESCRIBED HEREINAFTER, LOCATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID STREETS AND WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WASHELD AT REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, JANUARY 14, 1970, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING THAT THE PORTIONS OF THE STREETS ABOVE DESCRIBED ARE NOT NOW NEEDED FOR STREET PURPOSES, BUT WILL BE NEEDED FOR UTILITY PURPOSES AS DESCRIBED HEREINAFTER, NOR WILL IT WITHIN THE FORESEEABLE FUTURE BE NEEDED FOR STREET PURPOSES; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE STREETS HEREINAFTER MORE FULLY DESCRIBED SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES; HOWEVER, THE CITY COUNCIL HAS DETERMINED THAT IT IS NECESSARY TO RETAIN CERTAIN EASEMENTS FOR UTILITIES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE STUB END OF HUDSON STREET, BETWEEN BLOCK I AND BLOCK 9, MIDWAY ADDITION; THE STUB END OF ROSALIE BOULEVARD, LYING BETWEEN BLOCK 9, MIDWAY ADDITION, AND BLOCK 6, PRESCOTT PARK, UNIT il; AND THE STUB END OF GARDEN DRIVE, LYING BETWEEN BLOCK 7, INWOOD VILLAGE, 19876 UNIT #1, AND BLOCK S, INWOOD VILLAGE, UNIT $2, BE CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY HOWEVER, THERE IS EXCEPTED FROM SAID ABANDONMENT, THE RIGHT OF THE CITY OF CORPUS CHRISTI TO RETAIN AN EASEMENT FOR ALL EXISTING UTILITIES IN ROSALIE DROVE UNLESS THE 7_zi -7c OWNER OF THE ABUTTING PROPERTY RELOCATES THE EXISTING WATER MAIN AT THE EXPENSE OF SAID ABUTTING PROPERTY OWNERS AND FURTHER, THAT A UTILITY EASEMENT ACROSS EACH STREET CONTINUING THE REAR LOT EASEMENT BE RETAINED. T.-.- `,,CT TuAAT rur_cl;jjL lC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID PORTION OF THE NAMED STREETS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29TH DAY,OF JULY, 1970. IAY R APPROVED: THE CITY OF CORPUS CHRISTI, TEXAS &DAY OF JULY, 1970: AC ING CITY ATTO Y Corpus Christi as day of , 19Zb TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; 1, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
