AN ORDINANCE
AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED,
BY AMENDING SECTION 38 -46 THEREOF; MAKING FINDINGS;
DEFINING TERMS; ESTABLISHING CHANGES IN GAS RATES THERE-
UNDER AND TERMS OF APPLICABILITY; PROVIDING CYCLICAL
BILLING; PROVIDING AN EFFECTIVE DATE; PROVIDING SEVER -
ABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN
EMERGENCY.
WHEREAS, THE CITY COUNCIL FINDS THAT PRESENT GAS RATES ARE
INADEQUATE TO DEFRAY THE OPERATING EXPENSES AND PROVIDE A PROPER RETURN
ON INVESTMENT OF THE CITY OF CORPUS CHRISTI IN ITS GAS DISTRIBUTION
SYSTEM; AND
WHEREAS, IT IS THE FINDING OF THIS CITY COUNCIL, AFTER STUDY
AND DELIBERATION, THAT THE HEREINAFTER ORDAINED GAS RATES AND TERMS OF
APPLICABILITY WILL PROBABLY PRODUCE SUFFICIENT REVENUES TO THE CITY TO
DEFRAY SUCH OPERATING EXPENSES AND GAIN A PROPER RETURN OF SAID INVEST-
MENT:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. DEFINITION OF TERMS. THAT THE FOLLOWING TERMS AS
USED IN THIS ORDINANCE ARE HEREBY SPECIALLY DEFINED AS FOLLOWS:
A. "CYCLE" MEANS A GROUP OF GAS CUSTOMERS REGULARLY BILLED
TOGETHER FOR THEIR SEPARATE ACCOUNTS BY THE CITY UTILITIES DIVISION.
CYCLES ARE NUMBERED FROM "1" UP.
B. "INSTALLED TOTAL ENERGY" MEANS THE TOTAL ENERGY OUTPUT AT
A METERED LOCATION OF ALL CUSTOMER -OWNED OR CONTROLLED ELECTRIC - POWERED
GENERATION AND GAS -FIRED EQUIPMENT.
SECTION Z. THAT NEW RATES APPLICABLE TO CUSTOMERS AND CONSUMERS
OF THE CITY -OWNED GAS DISTRIBUTION SYSTEM AND ALL OTHER GAS DISTRIBUTION
SYSTEMS IN THE CITY ARE HEREBY ESTABLISHED AND SECTION 38-46 OF THE CORPUS
CHRISTI CITY CODE, 1958, AS AMENDED, IS HEREBY AMENDED TO READ AS FOLLOWS:
"SECTION 38-46. CLASSIFICATION OF CUSTOMERS AND SCHEDULE OF
RATES.
ALL CUSTOMERS OTHER THAN ONE -OR TWO - FAMILY RESIDENTIAL CUSTOMERS,
SEASONAL CUSTOMERS, CHURCH CUSTOMERS, SCHOOL CUSTOMERS, HOSPITAL CUSTOMERS,
AND GOVERNMENTAL AGENCY CUSTOMERS, SHALL BE CLASSIFIED AS GENERAL RATE
CUSTOMERS.
ONE- AND TWO- FAMILY CUSTOMERS. ALL ONE - FAMILY
RESIDENCE AND
ALL TWO- FAMILY RESIDENCE CUSTOMERS
SHALL BE BILLED FOR AND
THERE SHALL
BE COLLECTED THE FOLLOWING CHARGES
FOR GAS FURNISHED AND
DELIVERED TO
THEIR METERS BY THE DEPARTMENT OF
PUBLIC UTILITIES OF THE

ALL GENERAL RATE CUSTOMERS THAT HAVE INSTALLED TOTAL ENERGY OR
HAVE GAS OPERATED AIR COOLING AND AIR CONDITIONING EQUIPMENT OR BOTH AND
HAVE AN AVERAGE VOLUME USED IN MCF PER MONTH IN THE SEVEN SUMMER MONTHS
THAT EXCEEDS THE FIVE WINTER MONTHS AVERAGE USE, WHEN INSPECTED AND
APPROVED BY THE GAS DIVISION, WHO REQUEST IN WRITING TO BE BILLED IN
THE SUMMER MONTHS ON THE SUMMER INCENTIVE GAS RATE SCHEDULE STARTING WITH

THE MINIMUM VOLUME USED IN ANY MONTH OF THE YEAR SHALL NOT BE LESS THAN
50% OF THE AVERAGE WINTER MONTH.
CHURCH, SCHOOL, HOSPITAL, AND GOVERNMENTAL AGENCY CUSTOMERS. ALL
CUSTOMERS AND CONSUMERS WHO DESIRE TO BE CLASSIFIED AS CHURCH CUSTOMERS,
SCHOOL CUSTOMERS, HOSPITAL CUSTOMERS, OR GOVERNMENTAL AGENCY CUSTOMERS
SHALL PRESENT EVIDENCE SATISFACTORY TO THE DIRECTOR OF PUBLIC UTILITIES
OF THE FACT THAT THE GAS SERVICE IS FOR USE ON PREMISES USED EXCLUSIVELY
FOR CHURCH PURPOSES BY A DULY RECOGNIZED CHURCH IF THE CUSTOMER DESIRES
TO BE CLASSIFIED AS A CHURCH CUSTOMER, OR USED EXCLUSIVELY FOR SCHOOL
PURPOSES, BEING PUBLIC OR PRIVATE NONPROFIT SCHOOL IF IT IS TO BE CLASSI-
FIED AS A SCHOOL CUSTOMER, OR USED EXCLUSIVELY FOR HOSPITAL PURPOSES BY
A PUBLIC, PAROCHIAL OR NONPROFIT HOSPITAL IF DESIRED TO BE CLASSIFIED
AS A HOSPITAL CUSTOMER, OR USED EXCLUSIVELY FOR GOVERNMENTAL AGENCY
PURPOSES OF THIS CITY, OR OF COUNTY, STATE, OR FEDERAL GOVERNMENTS, IF
CLASSIFICATION AS A GOVERNMENTAL AGENCY CUSTOMER IS SOUGHT. ALL CUSTOMERS
CLASSIFIED AS CHURCH, SCHOOL, HOSPITAL, AND GOVERNMENTAL AGENCY CUSTOMERS
SHALL BE CHARGED AND THERE SHALL BE COLLECTED THE FOLLOWING CHARGES FOR
GAS FURNISHED AND DELIVERED TO THE METERS OF SUCH CUSTOMERS BY THE DEPART-
MENT OF PUBLIC UTILITIES OF THE CITY:

THESE GAS RATE SCHEDULES ARE LIMITED TO
CUSTOMER USING 365 M.M.C.F. PER YEAR OR LESS.
STREET AND OUTDOOR LIGHTING RATE. THE STREET AND OUTDOOR LIGHTING
RATE IS APPLICABLE TO THE ENTIRE TERRITORY SERVED NATURAL GAS BY THE CITY
GAS DIVISION.
THE RATE IS AVAILABLE ON WRITTEN REQUEST, SUBJECT TO THE CONDITIONS
AND APPROVAL HEREIN STATED, TO UNMETERED FIRM GAS SERVICE FOR CONTINUOUS
USE BY GROUPS OF CUSTOMER -OWNED GAS LIGHTS INSTALLED IN A CONSECUTIVE AND
CONTIGUOUS ARRANGEMENT ALONG OR ADJACENT TO PUBLIC THOROUGHFARES AND CON-
STITUTING A LIGHTING SYSTEM. SERVICE UNDER THIS SCHEDULE IS CONDITIONAL
UPON ARRANGEMENTS MUTUALLY SATISFACTORY TO THE CUSTOMER AND THE CITY GAS
DIVISION FOR CONNECTION OF THE CUSTOMERS' GAS LIGHTS TO THE CITY GAS
DIVISIONS FACILITIES AND IS AVAILABLE ONLY FOR GROUPS OF GAS LIGHTS
APPROVED BY THE GAS DIVISION OF THE CITY.

ALL GAS LIGHTS FOR PUBLIC OUTDOOR LIGHTING WILL BE OWNED AND
INSTALLED BY THE CUSTOMER. THEY ARE TO BE APPROVED BY THE CITY GAS
DIVISION AT THE TIME THAT THE CONTRACT IS SIGNED.

THE SERVICE TAP ASSEMBLY AND SERVICE PIPE FOR EACH GAS LIGHT
WILL BE OWNED, INSTALLED AND MAINTAINED BY THE CITY GAS DIVISION. THE
ESTIMATED INSTALLED COST THEREOF SHALL BE PAID BY THE CUSTOMER TO THE
CITY GAS DIVISION IN ADVANCE OF CONSTRUCTION.
THE BASE TERM OF ALL STREET AND OUTDOOR LIGHTING RATE CONTRACTS
SHALL BE THREE YEARS AND SHALL CONTINUE THEREAFTER UNTIL CANCELLED BY
EITHER PARTY AFTER 30 DAYS' WRITTEN NOTICE. THE THIRTY -DAY CANCELLATION
HEREIN PROVIDED SHALL BE CUMULATIVE OF AND IN ADDITION TO ALL OTHER CAN-
CELLATIONS AND APPLICABLE REGULATIONS OF GAS SERVICE PROVIDED BY THE
ORDINANCES OF THIS CITY OR THE LAWS OF THE STATE OF TEXAS."
SECTION 3. THE EFFECTIVE DATE OF THESE RATES SHALL BE
70.
SECTION 4. IF FOR ANY REASON ANY SECTION, PARAGRAPH, PHRASE
OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT
ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS
CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE.
SECTION 5. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL
PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CON-
TAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE.
SECTION 6. THE NECESSITY FOR IMMEDIATELY REVISING THE
SCHEDULE OF GAS RATES FOR THE CITY OF CORPUS CHRISTI AS HEREINASOVE
SET FORTH CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY
AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUS-
PENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS
INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
