HomeMy WebLinkAbout09887 ORD - 08/12/19708/12/70 • - s AN ORDINANCE PROVIDING FOR THE PERMITTING, FOR THE ENSUING SIX MONTHS FROM THE EFFECTIVE DATE OF THIS ORDINANCE, OF MOBILE HOMES TO BE PLACED ON OWNER- OCCUPIED RESIDENTIAL LOTS OCCUPIED BY THE OWNER OR HIS IMMEDIATE FAMILY WHO WERE RESIDENTS OF CORPUS CHRISTI, TEXAS, AT THE TIME HURRICANE CELIA ARRIVED IN THIS CITY; PROVIDING FOR SETBACK REQUIREMENTS; PROVIDING FOR THE LOCATION OF MOBILE HOMES ON RESIDENTIAL LOTS; PROVIDING, AS A CONDITION OF PLACING MOBILE HOMES, THAT ALL UTILITIES ARE TO BE CONNECTED TO MOBILE HOMES; REQUIRING THAT THE MOBILE HOME UNDER NO CIRCUMSTANCES BECOME PERMANENTLY ANNEXED TO THE REALTY SO AS TO BECOME A PERMANENT FIXTURE; PROVIDING FOR TERMINATION CLAUSE; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, A PUBLIC EMERGENCY HAS BEEN DECLARED BY THE CITY COUNCIL l� AS A RESULT OF HURRICANE CELIA; AND WHEREAS, AS A RESULT OF THE SAID HURRICANE CELIA, THERE IS A SHORTAGE OF HABITABLE HOUSING IN THE CITY OF CORPUS CHRISTI, AND THE CITY COUNCIL IS DESIROUS OF ALLEVIATING SUCH SHORTAGE OF HOUSING: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT FOR THE ENSUING SIX MONTHS FROM THE EFFECTIVE DATE OF THIS ORDINANCE, MOBILE HOMES MAY BE PLACED ON OWNER- OCCUPIED RESIDENTIAL LOTS FOR OCCUPANCY BY THE OWNER AND THE MEMBERS OF HIS IMMEDIATE FAMILY WHO WERE RESIDENTS OF CORPUS CHRISTI, TEXAS, AT THE TIME HURRICANE CELIA STRUCK THE CITY. SAID PERMIT SHALL TERMINATE AT THE EXPIRATION OF SIX MONTHS. SECTION 2. MOBILE HOMES WILL BE LOCATED ON THE RESIDENTIAL LOT, PREFERABLY ADJACENT TO THE DRIVEWAY AREA IF SAID LOT DOES IN FACT HAVE A PAVED DRIVEWAY AREA. IF THIS 15 NOT FEASIBLE, THE MOBILE HOME SHALL BE LOCATED IN THE FRONT PORTION OF THE RESIDENTIAL LOT. THE MOBILE HOME MAY BE LOCATED AT THE REAR OF THE LOT PROVIDED THAT THERE IS AN ACCESS ROAD IN THE REAR TO PERMIT THE REMOVAL OF THE MOBILE HOME UPON COMPLETION OF CONSTRUCTION OF THE OWNERS HOME. ALL UTILITIES AND SANITARY SERVICES SHALL BE CONNECTED TO THE MOBILE HOME. ILE HO�WILajC OT BEE PERMITTED TO BE PERMANENTLY ANNEXED TO THE REALTY SO AS TO BECOME A PERMANENT FIXTURE AND NO PERMIT SHALL BE rYYI� ISSUED BY THE CITY BUILDING DIVISION FOR SUCH TEMPORARY LOCATION OF A MOBILEy� HOME UNLESS THE OWNER OF THE LOT RENDERS A SWORN, ACKNOWLEDGED STATEMENT, }E� FILED WITH THE BUILDING DIVISION, AND RECORDED BY THE BUILDING DIVISION IN THE NUECES COUNTY DEED RECORDS, THAT NEITHER HE,NOR ANY SUCCESSOR, ASSIGN, OR HEIR OF SUCH OWNER SHALL MORTGAGE, PLEDGE, OR ENCUMBER SAID MOBILE HOME /N AS A PART OF OR FIXTURE TO THE LAND ON WHICH SUCH MOBILE HOME IS SITUATED. SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, PHRASE OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 4. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CONTAIN THE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 5. THE NECESSITY TO ENACT THE HEREINABOVE PROVIDED CONDITIONS AND PROVISIONS AS SOON AS POSSIBLE IN ORDER TO ALLEVIATE THE SHORTAGE OF HOUSING IN THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM JJ AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 1O V DAY OF AUGUST, 1970.
