HomeMy WebLinkAbout09899 ORD - 08/19/1970JK H:7 -29 -70 AN ORDINANCE CLOSING ALL BUFFER ZONES, PLANTING STRIPS, WALKWAYS, ALLEYS, AND EASEMENTS THAT APPEAR ON THE PLAT FILED FOR RECORD IN VOLUME 14, PAGE 50, NUECES COUNTY MAP RECORDS, AND REFERRED TO AS LOTS 1 THROUGH 4, BLOCK 3, AND LOTS 1 THROUGH 10, BLOCK "A ", PLUS THE REPLAT OF THE AREA THAT IS FILED IN VOLUME 15, PAGE 25, NUECES COUNTY MAP RECORDS, AND REFERRED TO AS LOTS 1 THROUGH 10,.BLOCK "A ", BOTH BEING IN COOPERDALE ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE CONDITIONS HEREINAFTER PROVIDED; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CON- CERNING THE CLOSING OF CERTAIN BUFFER ZONES, PLANTING STRIPS, WALKWAYS, ALLEYS, AND EASEMENTS THAT APPEAR ON THE PLAT FILED FOR RECORD IN VOLUME 1111, PAGE 50, NUECES.000NTY MAP RECORDS, AND REFERRED TO AS LOTS 1 THROUGH 4, BLOCK 3, AND LOTS I THROUGH 10, BLOCK "A PLUS THE REPLAT OF THE AREA THAT IS FILED IN VOLUME 15, PAGE 25, NUECES COUNTY MAP RECORDS, AND REFERRED TO AS LOTS 1 THROUGH 10, BLOCK "A ", BEING IN COOPERDALE ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF THE PROPERTY ABUTTING THE AFORESAID PROPERTIES AND WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, JUNE 9, 1969, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING THAT THE PORTION OF THE BUFFER ZONES, PLANTING STRIPS, WALKWAYS, ALLEYS AND EASEMENTS IN COOPERDALE ADDITION, ABOVE DESCRIBED, ARE NOT NOW NEEDED FOR USE BY THE PUBLIC, NOR WILL THEY WITHIN THE FORESEEABLE FUTURE BE NEEDED FOR USE BY THE PUBLIC; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE BUFFER ZONES, PLANTING STRIPS, WALKWAYS, ALLEYS AND EASEMENTS IN COOPERDALE ADDITION SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERSFOR OTHER PURPOSES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: = SECTION 1. THAT ALL BUFFER ZONES, PLANTING STRIPS, WALKWAYS, ALLEYS AND EASEMENTS THAT APPEAR ON THE PLAT FILED IN VOLUME 14, PAGE 50, NUECES COUNTY MAP RECORDS, AND REFERRED TO AS LOTS 1 THROUGH 4, BLOCK 3, AND LOTS 1 THROUGH 10, BLOCK "A ", PLUS THE REPLAT OF THE AREA THAT IS FILED IN VOLUME 15, PAGE 25, NUECES COUNTY MAP RECORDS, AND REFERRED TO AS LOTS 1 THROUGH 10, BLOCK "A", BEING IN COOP£RDALE ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, ARE HEREBY CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY; SUBJECT, HOWEVER, TO DEDICATION OF NEW EASEMENTS, PLANTING STRIPS, BY REPLAT, APPROVED BY THE PLANNING COMMISSION, AND FILED OF RECORD IN THE DEED RECORDS OF NUECES COUNTY, TEXAS. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID BUFFER ZONES, PLANTING STRIPS, WALKWAYS, ALLEYS AND EASEMENTS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /.0 DAY OF 4u94 1zt 970.
