HomeMy WebLinkAbout09901 ORD - 08/26/1970• vMP:8/26 /7o • AN ORDINANCE AMENDING SECTION 18 -22 OF THE CORPUS CHRISTI CITY CODE, AS AMENDED BY ORDINANCE NO. 9866, BY PROVIDING A MINIMUM RATE OF NINETY CENTS PER MONTH FOR DISPOSAL ONLY OF GARBAGE AND TRASH FOR ALL OCCUPIED BUSINESS AND COMMERCIAL INSTITUTIONS AND CERTAIN OTHER PLACES IN THE CITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT SECTION 18 -22 OF THE CORPUS CHRISTI CITY CODE, AS AMENDED BY ORDINANCE NO. 9866, BE AND THE SAME IS HEREBY AMENDED BY AMENDING THE SECOND PARAGRAPH OF SAID ORDINANCE TO HEREAFTER READ AS FOLLOWS: "FOR THE SERVICE OF AND DISPOSAL ONLY OF GARBAGE AND TRASH, ALL OCCUPIED BUSINESS AND COMMERCIAL INSTITUTIONS AND ALL OTHER PLACES IN THE CITY, EXCEPT AS NOTED IN SECTION 18 -21 OF THIS CODE, SHALL BE CHARGED AT A MINIMUM RATE OF NINETY CENTS (900) PER MONTH OR EIGHTEEN PERCENT (i8 %) OF THE AMOUNT OF THE CHARGE WHICH THE SUPERINTENDENT OF THE SANITATION DIVISION OF THE DEPARTMENT OF PUBLIC WORKS SHALL DETERMINE WOULD BE THE PROPER AND EQUITABLE CHARGE FOR BOTH COLLECTION AND DISPOSAL, IF CITY SERVICES WERE USED, BASED ON THE TYPE AND AMOUNT OF REFUSE." SECTION 2. THE NECESSITY TO IMMEDIATELY AMEND THE CODE OF ORDINANCES OF THE CITY OF CORPUS CHRISTI TO REFLECT THE ABOVE RATES ON THE BILLING OF CYCLE ONE ON OR ABOUT SEPTEMBER 1, 1970 CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AS HEREINABOVE PROVIDED AND BE IN FULL FORCE AND EF//FE����C //��T FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE ,26VICDAY OF AUGUST, 1970. 0 THE CITY OF CORPUS CHRISTI, TEXAS (:I TY SECRETARY APPROVED: DAY OF q USTr70: CTJ�IGG CITY ATTORNE)V'- 9901 Corpus Christi, Texas day of zc a 197,- TO THE NENBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
