HomeMy WebLinkAbout09928 ORD - 09/16/1970AN ORDINANCE CLOSING A PORTION OF COKE STREET, LOCATED ADJACENT TO THE EAST PROPERTY LINE OF LOTS 5 AND 6, BLOCK 3, CRAVEN HEIGHTS, IN THE CITY OF CORPUS CHRISTI, TEXAS; RESERVING THE NECESSARY EASEMENTS FOR EXISTING UTILITIES; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR *HOLDING A HEARING CONCERNING THE CLOSING OF A PORTION OF COKE STREET, LOCATED ADJACENT TO THE EAST PROPERTY LINE OF LOTS 5 AND 6, BLOCK 3, CRAVEN HEIGHTS, AND GENERALLY DESCRIBED AS THE DEAD END PORTION OF THE OLD COKE STREET RIGHT OF WAY, IN THE CITY OF CORPUS CHRISTI, TEXAS, WAS GIVEN BY PUBLICA- TION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID PORTION OF COKE STREET AND WITHIN 450 FEET OF THE AREA TO BE CLOSED AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, SEPTEMBER 9, 1970, IN ACCORDANCE WITH THE PROVI- SIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE,.CITY COUNCIL AFTER SUCH HEARING THAT IT WOULD BEST SERVE THE PUBLIC CONVENIENCE AND NECESSITY TO CLOSE THAT PORTION OF COKE STREET, HEREINAFTER MORE FULLY DESCRIBED, FOR USE AS A PUBLIC STREET; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE HEREINAFTER DESCRIBED PORTION OF COKE STREET SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES; HOWEVER, THE CITY COUNCIL HAS DETERMINED IT IS NECESSARY TO RETAIN EASEMENTS FOR ALL EXISTING UTILITIES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT PORTION OF COKE STREET, HEREINAFTER MORE FULLY DESCRIBED, SITUATED IN THE CITY OF CORPUS CHRISTI, IS HEREBY CLOSED FOR PUBLIC USE AS A PUBLIC STREET AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY, SUBJECT TO THE HEREINAFTER PROVIDED CONDITION: ml BEING A PORTION OF COKE STREET AS ORIGINALLY DEDICATED BY MAP OF RECORD IN VOLUME A, PAGE 7, MAP RECORDS NUECES COUNTY2 TEXAS SAID PORTION OF STREET BEING MORE PARTICU- LARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING AT A POINT IN THE WEST RIGHT OF WAY LINE OF SAID COKE STREETS SAID POINT BEING N. v 14' E., 7.68 FEET FROM THE SOUTHEAST CORNER OF LOT 5, BLOCK 3, CRAVEN HEIGHTS AS SHOWN BY MAP OF RECORD IN VOLUME A, PAGE 7, MAP RECORDS NUECES COUNTY TEXAS4 FOR THE MOST SOUTHERLY AND BEGINNING CORNER OF THE TRACT HEREIN DESCRIBED; THENCE N. O° 14' E., WITH THE ORIGINAL WEST RIGHT OF WAY LINE OF SAID COKE STREETS AT 42.32 FEET PASS THE NORTHEAST CORNER OF SAID LOT 5, IN ALL A DISTANCE OF 10.07 FEET TO A POINT, THE NORTHEAST CORNER OF LOT 6, BLOCK 3, SAID CRAVEN HEIGHTS FOR THE NORTHWEST CORNER OF THE TRACT HEREIN DESCRIBED; THENCE S. 89° 58. E., WITH THE NORTH RIGHT OF WAY LINE OF SAID COKE STREET, A DISTANCE OF 17.58 FEET TO A POINT THE P.C. OF A CURVE TO THE RIGHT FOR A CORNER OF THIS TRACT; v THENCE IN A SOUTHEASTERLY AND SOUTHERLY DIRECTION WI'TH� THE ARC OF SAID CURVE TO THE RIGHTS WHOSE CENTRAL ANGLE IS 131° 42' 30 ", AND WHOSE RADIUS IS 15.0 FEET A DISTANCE OF 34.48 FEET TO A POINT FOR A CORNER] THENCE IN A SOUTHERLY DIRECTION WITH THE ARC OF A CURVE TO THE LEFT, WHOSE CENTRAL ANGLE IS 410 301 20 ", AND WHOSE RADIUS IS 115.0 FEET A DISTANCE OF 83.31 FEET TO THE POINT OF BEGINNING. CONTAINING 1445.5 SQUARE FEET OF LAND MORE OR LESS. SECTION 2. THERE IS HEREBY RESERVED TO THE CITY OF CORPUS CHRISTI AN EASEMENT FOR ALL UTILITIES IN THE FULL WIDTH OF THE RIGHT OF WAY OF THE HEREINABOVE DESCRIBED PORTION OF COKE STREETv AND THIS CLOSURE IS CONDITIONED ON SUCH RESERVATION -BEING EFFECTED AND PRESERVED. SECTION 3. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID PORTION OF COKE STREET CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS -2- • INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND-EFFECT FROM AND AFTER ITS PASSAGE,.IT IS ACCORDINGLY SO ORDAINED, THIS THE /' / 7DAY OF SEPTEMBER, 1970.
