HomeMy WebLinkAbout09931 ORD - 09/16/1970• AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN 10 LUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF E. I. ou PONT DE NEMOURS & COMPANY, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON THE HEREINAFTER DESCRIBED TRACT OF LAND, BEING A 60.68 -ACRE TRACT OF• SU13MERGED LAND LOCATED ALONG THE LAQUINTA SHIP CHANNEL WHICH IS APPROXIMATELY ELEVEN MILES NORTH, 65 DEGREES' EAST FROM THE COUNTY SEAT AT CORPUS CHRISTI, NUECES COUNTY, TEXAS, AND A PART OF SUBMERGED TRACTS 2 AND 3 IN CORPUS CHRISTI BAY, LYING SOUTHEAST OF THE REYNOLDS METAL COMPANY, FROM "R -1A" ONE FAMILY DWELLING DISTRICT TO "1 -3" HEAVY INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDIN0C E AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWAR DEO TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF E. 1. OU PONT DE NEMOURS & COMPANY FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON SEPTEMBER 16, 1970_ , AT REGULAR COUNCIL MEETING OF THE CITY COUNCIL, IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE.HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. e.. � •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•FgR•THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND w AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING , DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /�wc, DAY OF SEPTEMBER, 1970 ATTE CITY SECRETA \ OF APPROVED: THE CITY OF CORPUS CHRISTI, TEXAS T AY OF PTEM , 1970 G CITY ATT' EXHIBIT A -1 27.28 acres'of land, more or less, being the same land conveyed to Mrs. H. S. Stillwell, Trustee, and William Merritt Hutchins,. Trustee, by Nueces County Navigation District No. 1 by mutual conveyance dated the 9th day of April, 1952, and recorded in Volume 178, page 295, Deed Records of San Patricio County, Texas, to which reference is here made for all purposes. EXHIBIT A -2 Being 12.07 acres of submerged land situated in Nueces County, Texas, in the waters of Corpus Christi Bay about eleven miles North 65° East from the County Seat at Corpus Christi, Nueces County, and embracing a portion of the State of Texas Submerged Tracts Nos. 2 and 3 in Corpus Christi Bay lying South of the North shoreline of Corpus Christi Bay and southerly of that tract of 652.8 acres, more or less, conveyed by Esther Carter Wheeler and husband, Melville M. Wheeler to Birdie Carter Goodloe by Deed dated July 1, 1942, and recorded in Volume 131, page 337, Deed Records of San Patricio County, Texas, and between a south- westerly extension of the boundary line between the Birdie Carter Goodloe tract and the Stillwell- Hutchins Tract and a southwesterly extension of the boundary line between the Birdie Carter Goodloe Tract and the Esther Carter Wheeler Tract and lying Northeast of a line crossing the waters of Corpus Christi Bay in a general northwesterly southeasterly direction and referred to as the Nueces C -)unty Navigation District North Bulkhead line. Said survey is .a part of the Corpus Christi Bay submerged in Nueces County.patented to Nueces County Navigation District No. 1 by the State of Texas on 31st of July, 1951, and recorded in the Deed Records of Nueces County, Texas, in Volume 522, page Nos. 202 -203, and described by metes and bounds as follows: BEGINNING at"a 1" iron pipe set on the North shore -, line of Corpus Christi Bay for a common corner between the Stillwell- Hutchins Tract and the Birdie Carter Goodloe Tract and the most northerly corner of this survey; THENCE with the meanders of said Corpus Christi Bay and Southwest boundary of said Birdie Carter Goodloe Tract and northeast boundary of the submerged land patented to Nueces County Navigation District No'. 1 by the State of Texas South 440 57' East 32.99 feet, South 430 56' East 1032.9 feet; South 38° 44' East 440.3 feet, South 29° 33' East 1.84 feet to. a 1" iron pipe set for a common corner between the Birdie Carter Goodloe Tract and Esther Carter Wheeler Tract and the most easterly corner of this survey; THENCE South 61° 37' 48" West a distance of 455.45 feet to a point in a curve running in a northwesterly south- easterly direction and referred to as the Nueces County Navigation District North Bulkhead line, located parallel with, on straight and concentric courses and 200 feet north- easterly measured at right angles and radially respectively from the near bottom edge of the proposed 150 ft. bottom width channel, for the most southerly corner of this survey; THENCE in a northwesterly direction with the North Bulkhead line, and left curve with radius of 3131.10 feet ' and central angle of 53° 46' 08" a distance of 1449.43 feet measured along the curve to the intersection of the North Bulkhead line with a line extended southwesterly from the common corner of the Birdie Carter Goodloe Tract and the Stillwell- Hutchins Tract on the shoreline, of Corpus Christi Bay for the most westerly corner of this survey; THENCE North 53° 21' 40" East a distance of 348.17 feet to the shoreline and the common corner of the Birdie Carter Goodloe Tract and the Stillwell- Hutchins Tract and place of beginning and containing 12.07 acres, more or less. All bearings are based on Grid North for Texas, South Zone as established by U.S. Coast & Geodetic Survey. EXHIBIT A -3 Being 21.33 acres of submerged land .situated in. Nueces County, Texas, in the waters of Corpus Christi Bay about 11 miles North 65° East from the County Seat of Corpus Christi, Nueces County, and embracing a portion of the State of Texas Submerged Tract No. 3 in Corpus Christi Bay lying Southwest of the Northeast shoreline of Corpus Christi Bay, and southerly of that tract of 652.8 acres of land, more or less, conveyed"by Birdie Carter Goodloe and husband, Sperry H. Goodloe, to Esther Carter Wheeler as her separate property by deed dated July 1, 1942, recorded in Volume 131, page 385, Deed Records of San Patricio County, Texas, and hereinafter designated as the Esther Carter Wheeler Tract, and between a southwesterly extension of the boundary line between the Birdie Carter Goodloe Tract and Esther Carter Wheeler Tract and a southwesterly extension of the boundary line between the Esther Carter Wheeler Tract and Humble Oil & Refining Company tract and lying Northeast of a line crossing Corpus Christi Bay in a general northwesterly southeasterly direction and referred to as the Nueces County Navigation District North Bulkhead line. Said survey is a part of the Corpus Christi Bay Submerged lands in Nueces County patented to Nueces County Navigation District No. 1 by the State of Texas on 31st of July, 1951, and recorded in the Deed Records of Nueces County, Texas, in Volume 522, pages 202 -203, and described by metes and bounds as follows: BEGINNING at a 1" iron pipe set on the North shore- line of Corpus Christi Bay for a common corner between the Birdie Carter Goodloe Tract and Esther Carter Wheeler Tract and the most northerly corner of this survey; THENCE with the meanders of said Corpus Christi Bay and Southwest boundary of said Esther Carter Wheeler Tract and northeast boundary of the submerged lands patented to Nueces County Navigation District No. 1 by the State of Texas South 29° 33' East 484.16 feet, South 240 37' East 487.8 feet, South 29° 34' East 576 feet, South 15° 17' East 321.53 feet to a 1" iron pipe set for a common corner between the Esther Carter Wheeler Tract and Humble Oil & Refining Company Tract and the most easterly corner of this survey; THENCE South 74° 43' West a distance of 526.08 feet to a point in a line running in a northwesterly southeasterly direction and referred to as the Nueces County Navigation District North Bulkhead line, located parallel with, on straight and concentric coursds and 200 feet northeasterly, measured at right angles from the near bottom edge of the proposed 150 foot bottom width channel for the most southerly corner of this survey; THENCE North 23° 45' 14" West with the North Bulk= head line, a distance of 1,661.42 feet to the point of beginning of a left curve with radius of 3,131.10 feet and central angle of 530 46'. 08 "; THENCE in a northwesterly direction with the North Bulkhead line and left curve with radius of 3131.10 ft. and central angle of 53° 46' 08" a distance of 83.57 feet measured along the curve to the intersection of the North Bullhead line with a line extended Southwesterly from the common corner of the Esther Carter Wheeler Tract and the Birdie Carter Goodloe Tract on the shoreline of Corpus Christi Bay for the most westerly corner of this survey; THENCE North 610 37' 48" East, a distance of 455.45 feet to the shoreline and the common corner of the Esther Carter Wheeler Tract and the Birdie Carter Goodloe Tract and the place of beginning, and containing 21.33 acres, more or less. All bearings are based on Grid North for Texas, South Zone as established by U.S. Coast & Geodetic Survey. • • Corpus Christi, Tex_ ,L6 Ak, day of , 197o TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I. therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
