HomeMy WebLinkAbout09937 ORD - 09/23/1970• BIW :9/23/70 0 AN ORDINANCE REPEALING ORDINANCE NO. 9688, AND IN LIEU THEREOF AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT FOR EASEMENT ON AND ACROSS STATE SUBMERGED LAND FOR THE CROSSING OF THE CAYO DEL OSO WITH A 30" WATER LINE, AND A CONTRACT FOR EASEMENT ON AND ACROSS STATE SUBMERGED LAND FOR THE CROSSING OF THE LAGUNA MADRE, STATE TRACT NUMBERS 16, 28, 29, 144, AND 51, WITH A 214" WATER LINE, AND TO PERFORM SUCH OTHER ACTS AS ARE NECESSARY TO COMPLETE ACQUISI- TION OF SAID EASEMENTS ALL IN CONNECTION WITH THE CON- STRUCTION OF THE 214" WATER LINE TO PADRE ISLAND; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AUTHORIZED AND DIRECTED TO EXECUTE A CONTRACT FOR EASEMENT ON AND ACROSS STATE SUBMERGED LAND FOR THE CROSSING OF THE CAYO DEL OSO WITH A 30" WATER LINE, AND A CONTRACT FOR EASEMENT ON AND ACROSS STATE SUBMERGED 1L�AND FOR THE CROSSING OF THE LAGUNA MADRE, STATE TRACT NUMBERS 16, 28, 29, 1141 AND 51, WITH A 211" WATER LINE, AND TO PERFORM SUCH OTHER ACTS AS ARE NECESSARY TO COMPLETE ACQUISITION OF SAID EASEMENTS ALL IN CONNECTION WITH THE CONSTRUCTION OF THE 214" WATER LINE TO PADRE ISLAND. ANY PRIOR ORDINANCES CONFLICTING HEREWITH ARE REVOKED ONLY TO THE EXTENT OF SUCH CONFLICT. SECTION 2. THE NECESSITY TO EXECUTE THE AFORESAID CONTRACTS FOR EASEMENTS AT THE EARLIEST PRACTICABLE DATE IN ORDER THAT THE PROPOSED 30" AND 24" WATER LINES MAY BE CONSTRUCTED WITHOUT DELAY CREATES A PUBLIC EMER- GENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY 50 ORDAINED, THIS THE AY OF SEPTEMBER, 1970. ATTE 1 CITY SEC ETARY APPROVED: J3 AY OF 970 THE CITY OF CORPUS CHRISTI, TEXAS 9937 ��Y ^ATT ORNEY Ili • Corpus Christi, as o _day of 19 �® TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request- that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
