AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
A CONTRACT WITH HAYDEN SALES FOR CONSTRUCTION OF A
MUNICIPAL SWIMMING POOL AT BROWNLEE AND WINNEBAGO,
DESIGNATED AS PROJECT NO. 291 -70-7; APPROPRIATING
OUT OF NO. 291 PARK BOND FUND THE SUM OF $1148,179,
OF WHICH $142,9914 IS FOR CONSTRUCTION CONTRACT AND
$5,185 IS FOR CONTINGENCIES; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY,
AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI, A CONTRACT WITH HAYDEN SALES FOR THE CONSTRUCTION OF
A MUNICIPAL SWIMMING POOL AT BROWNLEE AND WINNEBAGO, DESIGNATED AS
PROJECT No. 291 -70-7, ALL AS MORE FULLY DESCRIBED IN THE PLANS AND

SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE
CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND
ACCORDING TO THE BID OF HAYDEN SALES, OPENED ON THE 23RD DAY OF
SEPTEMBER, 1970, THE SAID BID OF HAYDEN SALES BEING THE LOWEST AND MOST
ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS.
SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE No. 291
PARK BOND FUND THE SUM OF $148,179, OF WHICH $142,994 IS FOR THE CONSTRUC-
TION CONTRACT AND $5,185 15 FOR CONTINGENCIES.
SECTION 3. THE NECESSITY TO PROVIDE SWIMMING POOL FACILITIES
IN AN AREA HEREINABOVE DESCRIBED IN ORDER TO PROVIDE ADDITIONAL RECREATIONAL
FACILITIES FOR CITIZENS OF THE CITY OF CORPUS CHRISTI CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF
THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE
MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING
REQUESTED THAT THE CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE

IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY
SO ORDAINED, THIS THE 30TH DAY OF SEPTEMBER, 1970.

for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi
to the credit of:

Project No. 291-70-W-7
Project Name Municipal Swimming Pool, Brownlee and Winnebago
from which it is proposed to be drawn, and such money is not appropriated for
any other purpose.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
