E -7 (G), BETWEEN THE CITY OF CORPUS CHRISTI AND THE UNITED STATES OF AMERICA, PERTAINING TO THE PREPARATION OF CODE ENFORCEMENT PROGRAM NO. TEX.E -7, A COPY OF SAID AMENDATORY CONTRACT BEING ATTACHED HERE- TO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, UNDER TITLE I OF THE HOUSING ACT OF 1949, AS AMENDED, THE UNITED STATES OF AMERICA (HEREIN CALLED THE "GOVERNMENT") HAS TENDERED TO THE CITY OF CORPUS CHRISTI (HEREIN CALLED THE "PUBLIC BODY") A PROPOSED GRANT CONTRACT FOR CODE ENFORCEMENT PROGRAM, HEREINAFTER MENTIONED, PUR- SUANT TO WHICH THE GOVERNMENT WOULD EXTEND A GRANT OF FEDERAL FUNDS TO THE PUBLIC BODY TO AID IN FINANCING THE COST OF THE PREPARATION OF A CODE ENFORCEMENT PROGRAM, DESIGNATED CODE ENFORCEMENT PROGRAM N0. TEX. E -7(G) (HEREIN CALLED THE "PROGRAM "); AND • WHEREAS, THIS PUBLIC BODY HAS GIVEN DUE CONSIDERATION TO SAID PRO- POSED CONTRACT AND HAS FOUND IT TO BE IN THE INTEREST OF THIS LOCALITY TO EXECUTE SUCH CONTRACT; AND WHEREAS, THIS PUBLIC BODY IS DULY AUTHORIZED, UNDER AND PURSUANT TO THE CONSTITUTION AND LAWS OF THE STATE OF TEXAS, TO UNDERTAKE AND CARRY OUT THE PREPARATION OF THE PROGRAM; AND BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE PENDING PROPOSED AMENDATORY CONTRACT, DESIGNATED FIRST AMENDATORY GRANT CONTRACT AMENDING GRANT CONTRACT FOR CODE ENFORCEMENT PROGRAM, CONTRACT NO. TEX.E -7(G), IS HEREBY APPROVED IN ALL RESPECTS. SECTION 2. THE CITY MANAGER OF THIS PUBLIC BODY IN ITS BEHALF IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE SAID PROPOSED CONTRACT IN TWO COUNTERPARTS, AND THE CITY SECRETARY OF THIS PUBLIC BODY IS HEREBY AUTHORIZED AND DIRECTED TO IMPRESS AND ATTEST THE OFFICIAL SEAL OF THIS PUBLIC BODY ON EACH SUCH COUNTERPART AND TO FORWARD SUCH COUNTERPARTS TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, TOGETHER WITH TWO CERTIFIED COPIES OF THE PROCEEDINGS IN CONNECTION WITH THE PASSAGE OF THIS ORDINANCE, TWO CERTIFIED COPIES OF THIS ORDINANCE, AND SUCH OTHER AND FURTHER DOCUMENTS RELATIVE TO THE APPROVAL AND EXECUTION OF THE CONTRACT AS MAY BE REQUIRED BY THE GOVERNMENT. 9945 SECTION 3. THE CITY MANAGER OF THIS PUBLIC BODY IS HEREBY AUTHORIZED TO FILE REQUISITIONS, TOGETHER WITH NECESSARY SUPPORTING DOCU- MENTS, WITH THE GOVERNMENT, FROM TIME TO TIME AS GRANT FUNDS ARE REQUIRED, REQUESTING PAYMENTS TO BE MADE TO IT ON ACCOUNT OF THE GRANT PROVIDED FOR IN THE CONTRACT, AND TO DO AND PERFORM ALL OTHER THINGS AND ACTS REQUIRED TO BE DONE OR PERFORMED IN ORDER TO OBTAIN SUCH PAYMENTS. SECTION Z. THE NECESSITY TO EXECUTE THE AFORESAID PROPOSED GRANT CONTRACT FOR CODE ENFORCEMENT PROGRAM IN ORDER TO PROVIDE ADEQUATE LOW - PRICE HOUSING IN THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFiFR ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE , DAY OF . e�J , 1970. E -7(G) Program No, Tex, E -7 TRIS FIRST AMENDATORY CONTRACT made and entered into on the date here - inbelow specified, by and between the City of Corpus Christi, Texas (herein called the "Grantee ") and the United States of America jherein called the "Government "), WITNESSETH: WHEREAS, the Parties hereto entered into that certain Grant Contract for Code Enforcement Program No, Tex, E-7 dated December 9, 1968, (herein called the "Existing Contract "), and it now appears that the Existing Contract should be amended: NOW, THEREFORE, in consideration of the mutual covenants, promises and representations contained herein and in the Existing Contract, the Parties hereto do agree as follows: The Existing Contract is hereby amended as follows: (1) By exscinding in SEC, 5•6f Part I thereof the figures "$1,340,878" and inserting in lieu thereof the figures "$2,236,367," (2) By exscinding in SEC, 7(a) of Part I thereof the figures "$496,500" and inserting in lieu thereof the figures "$1,387,852," (3) By exscinding in SEC, 8 of Part I thereof the figures "$12,99$" and inserting in lieu thereof the figures 1.1$21,900," The Grantee certifies that all things necessary on its part to constitute this Amendatory Contract a valid, binding and legal agreement have been done or have occurred, that all conditions precedent to its valid execution of this Amendatory Contract have been complied with, and that such execution is in all respects authorized in accordance with law. I, • Corpus Christi, Tex d� day of 197.0 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
