HomeMy WebLinkAbout09951 ORD - 10/07/1970ca • AN ORDINANCE ADOPTING A REVISED STREET ASSESSMENT POLICY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE POLICY ON STREET ASSESSMENTS SHALL BE AS FOLLOWS: A. IMPROVEMENTS — STREET SHALL CONTAIN A PAVED SURFACE, PLUS TWO FEET (21) OF CURB AND GUTTER SECTION ON EACH SIDE, A MINIMUM OF FOUR FEET (Y1) WIDE SIDEWALK ON EACH SIDE, OR WIDER WHERE NEEDED, PLUS DRIVE- WAYS AS NEEDED. THE PAVED SURFACE SHALL BE AS DETERMINED BY THE DEPARTMENT OF PUBLIC WORKS AND'MAY BE EITHER.ASPHALT WITH FLEXIBLE BASE OR CONCRETE AS REQUIRED AND APPROVED BY THE CITY COUNCIL. B. BASIC RATE OF ASSESSMENT — ITEMS HAVE BEEN BROKEN DOWN INTO FIVE (5) CATEGORIES: (1) CATEGORY I RELATES TO THE EXCAVATION, CALICHE BASE, PRIME COAT AND HOT —MIX SURFACE; (2) CATEGORY II REFLECTS CURB AND GUTTER, STORM SEWER INLETS, CALICHE BASE, AND EXCAVATION FOR CURB AND GUTTER AND INLETS; (3) CATEGORY III REFLECTS SIDEWALKS AND DRAINS; (4) CATEGORY IV INCLUDES DRIVEWAYS; AND (5) CATEGORY V INCLUDES HEADER CURB. ALL THESE CATEGORIES INCLUDE A 15% ENGINEERING AND CONTINGENCY FEE. THE RATE OF ASSESSMENT IS TO BE CALCULATED BY TAKING ONE —THIRD OF THE TOTAL IN EACH OF THE CATEGORIES AND DIVIDING BY THE TOTAL LINEAR OR _ SQUARE FEET WHERE APPLICABLE/ OF THE FRONTAGE ASSESSABLE ON THE PROJECT. MORE SPECIFICALLY, THE CATEGORIES ARE AS FOLLOWS: 1. PAVEMENT INCLUDES IMPROVEMENTS SUCH AS EXCAVATION, CALICHE BASE, PRIME COAT, ASPHALT SURFACE, AND A 15% (FIFTEEN PERCENT) ENGINEERING AND CONTINGENCY FEE. 2. CURB AND GUTTER INCLUDES A TWO —FOOT (21) CONCRETE CURB AND GUTTER SECTION, CALICHE BASE UNDER CURB AND GUTTER, NECESSARY 9951 EXCAVATION FOR CURB AND GUTTER, STORM SEWER INLET BETTERMENT, AND A 15% (FIFTEEN PERCENT) ENGINEERING AND CONTINGENCY FEE. 3. SIDEWALK INCLUDES A MINIMUM FOUR -FOOT (41) WIDE CONCRETE SIDEWALK, SIDEWALK DRAIN BETTERMENT, AND A 15% FIFTEEN PERCENT) 11ENGINEERING AND CONTINGENCY FEE. 4. DRIVEWAYS INCLUDE CONSTRUCTION OF A MINIMUM SIX -INCH (61 THICK REINFORCED CONCRETE DRIVEWAY TO THE WIDTH ESTABLISHED ON THE PLANS, PLUS A 15% FIFTEEN PERCENT) ENGINEERING AND ' CONTINGENCY FEE. - 5. HEADER CURBS WHERE IT BECOMES NECESSARY TO CONSTRUCT A CONCRETE HEADER CURB ALONG COMMERCIALLY USED PROPERTIES TO PREVENT VEHICLES FROM TURNING, BACKING, OR PARKING ON THE SIDEWALK, THIS HEADER-CURB WILL BE ASSESSED AGAINST THE ABUTTING PROPERTY PLUS 15% FIFTEEN PERCENT) FOR ENGINEERING AND CONTINGENCIES. EACH OF THE ABOVE FIVE CATEGORIES WILL BE CHARGED ONE -THIRD OF THE TOTAL COST DISTRIBUTED ON THE BASIS OF LINEAR OR SQUARE FOOTAGE AS APPLICABLE. CREDITS WILL BE GIVEN FOR EXISTING CURBS AND GUTTERS, SIDEWALKS AND DRIVE- WAYS IF THEY MEET THE STANDARDS OF THE CITY OF CORPUS CHRISTI AT THE TIME OF CONSTRUCTION UP TO THE AMOUNT SHOWN TO HAVE BEEN PREVIOUSLY SPENT FOR THESE PERMANENT TYPE IMPROVEMENTS. SECTION 2. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED, AND ORDINANCE NO. 9535, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 29, 1969; PROVIDED, HOWEVER, THAT ALL RIGHTS, BENEFITS, TITLES, INCOME, CHARGES AND ASSESSMENTS OWNED BY OR DUE TO THE CITY OF CORPUS CHRISTI UNDER ANY PREVIOUS PAVING ASSESSMENT ORDINANCES, OR OTHER ORDINANCES, ARE HEREBY EXPRESSLY RESERVED AND SAVED FOR THE BENEFIT OF THE CITY. SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 4. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, WHICH PUBLICATION SHALL CON- TAIN T+HE CAPTION STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. • SECTION-6 THE NECESSITY TO IMMEDIATELY ADOPT THE PROVISIONS HEREIN CONTAINED IN ORDER TO REVISE THE STREET ASSESSMENT POLICY IN THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL r.
