APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND
THE SUM OF $2,100, OF WHICH $2,000 IS FOR ACQUISI-
TION OF THE HEREINAFTER DESCRIBED TRACT OR PARCEL
OF LAND AND $100 IS FOR INCIDENTAL EXPENSES RELATED
TO CLOSING COSTS, APPLICABLE TO PROJECT NO. 295- 70 -72,
NEIGHBORHOOD IMPROVEPENT AREAS AND MINOR STORM SEWER
IMPROVEMENTS; AUTHORIZING AND DIRECTING THE CITY
MANAGER TO EXECUTE REAL ESTATE SALES CONTRACT WITH
THE OWNERS, JOHN DE LA GARZA AND WIFE LYDIA -R. DE LA
GARZA; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF NO. 295 STORM
SEWER BOND FUND THE SUM OF $21100, OF WHICH AMOUNT $2,000 IS FOR ACQUISITION
OF LAND AND $100 IS FOR INCIDENTAL EXPENSE AND RELATED COSTS, ALL IN CONNEC-
TION WITH PROJECT N0. 295- 70 -72, NEIGHBORHOOD IMPROVEMENT AREAS AND MINOR
STORM SEWER IMPROVEMENTS, SAID PARCEL BEING MORE FULLY DESCRIBED AS FOLLOWS:
A TRACT OF LAND 751 X 300' OUT OF THAT CERTAIN 8.88
ACRE TRACT OF LAND OUT OF THE GREGORIA FARIAS GRANT,
ABSTRACT 592, NUECES COUNTY, TEXAS; SAID 8.88 ACRE
TRACT BEING DESCRIBED IN WARRANTY DEED, RECORDED IN
VOL. 764, PAGE 571 OF THE DEED RECORDS OF NUECES
COUNTY, TEXAS, THE HEREIN CONVEYED TRACT BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT AND SUCH OTHER INSTRUMENTS
AS MAY BE NECESSARY TO ACQUIRE, FOR AND ON BEHALF OF THE CITY OF CORPUS
CHRISTI, THE AFORESAID PARCEL FROM THE RESPECTIVE OWNERS, JOHN DE LA GARZA
AND WIFE LYDIA R. DE LA GARZA.
SECTION 3. THE NECESSITY TO APPROPRIATE THE SUM HEREINABOVE
DESCRIBED AND THE ACQUISITION OF THE PARCEL AFORESAID NEEDED FOR A DRAINAGE
DITCH CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING
THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND
HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE
IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
