AN ORDINANCE
ANNEXING TO THE CITY CERTAIN PUBLIC LANDS AND SUB-
MERGED LANDS BETWEEN THE PRESENT CITY LIMITS AND
THE WESTERLY SHORE OF MUSTANG ISLAND AND PADRE ISLAND,
INCLUDING PORTIONS OF CORPUS CHRISTI BAY, NUECES RIVER
AREA, AND LAGUNA MADRE; AND PROVIDING FOR SEVERABILIIY.
WHEREAS, ON THE 12TH DAY OF AUGUST, 1970, A PUBLIC HEARING WAS
ORDERED TO BE HELD BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON
THE 26TH DAY OF AUGUST, 1970 FOR THE CONSIDERATION OF THE ANNEXATION OF
CERTAIN AREAS WITHIN THE EXTRATERRITORIAL DISTRICT OF THE CITY OF CORPUS
CHRISTI TO PROVIDE AN OPPORTUNITY FOR ALL INTERESTED PERSONS TO BE HEARD;
AND
WHEREAS,. NOT I CE OF SUCH HEARING HA BEEN PUBLISHED IN SUCH NEWS-
PAPER PURSUANT TO APPLICABLE LAW; AND
WHEREAS, ALL NOTICES OF SA HEA 1 APPLICABLE THERETO HAVE
BEEN MADE ACCORDING TO LAW; AND
WHEREAS, SAID PUBL C HEARING WAS DULY HELD ON THE 26TH DAY OF
AUGUST, 1970, AT THE REG R MEE 1 OF THE CITY COUNCIL AT WHICH ALL
PERSONS DESIRING TO BE HEAR OR I RESTED IN SAID ANNEXATION WERE HEARD

CLOSED;.AND
EREAS, IT HAS ZEN DETERMINED BY SAID CITY COUNCIL THAT THE
OPOSED TO BE ANNEXED ABUTS AND IS CONTIGUOUS AND ADJACENT TO THE

My fellow Members of the City Council:
Last Wednesday, October 28, the Council voted the passage of Ordinance No. 9968,
the Annexation Ordinance, on a third reading. Prior to that vote in Regular Meeting, I
stated in this open umber that I opposed the reservation of areas in Corpus Christi Bay -
Laguna Madre for the creation of Industrial Districts for the benefit of oil and gas companies
operating in the Territory under annexation through the second reading of the ordinance. I
urged members of Council to avoid preferential treatment of those companies, to carry the
annexation as already twice voted, to not amend for the grant of unwarranted privilege. I
did not vote for the amendment or for passage on third reading. Today I am, in accordance
with Article 11, Sec. 6, of the Charter of the City of Corpus Christi, now returning Ordinance
No. 9968, on its third reading form of last Wednesday, without my approval or signature and
I here veto that ordinance. In all the time I have been Mayor of the City I have never before
vetoed an ordinance. The high regard and close comradeship I hold with the members of:this
Council leads me to give great weight to the action of the majority, but the majority has con-
fronted me with an ordinance that I simply cannot, in good conscience and sound logic, approve.
My reasons for the veto are manifold. As the City Attorney has earlier indicated to
us, there are legal questions yet unresolved in this annexation proceeding. Are we certain
that the original published Notice is free from fault, with a solid, closed description? I am
not. Do we feel justifiably confident that a court of law will close the descriptions where
they have been defective? 1 do not feel that confidence.
Beyond legal scruples, look at the impact of the annexation policy this Council is
adopting. In the last Bay annexation we made no exceptions for the oil and gas operations
then existing therein. Those companies pay full ad valorem tax, and how imperative it is
now, after the wholly unpredictable cash drain on our City Treasury 'opened" by Hurricane
Celia, to annex completely, without special favor to these outer Bay and Laguna operators,
and without discrimination to those already in the city limits, and help recoup our depleted
resources, to the benefit of all our people in restoring and enlarging essential City services.
During the course of this annexation proceeding we have often stated that another
purpose was to gain control of the outer Bay- Laguna to regulate production there, for
safety and to stop pollution. Why is an industrial district, with all its cumbersome, intri-
cate contract regulation, necessary? It isn't. General ordinance regulation, by full
annexation, would solve the problem effectively, uniformly, promptly.
Yesterday the voters of this State may have subtracted (depending on the final and
official returns), by passing a constitutional amendment, reset untold thousands of dollars
From this City's future revenues by, in effect, removing all farm and agricultural potential -
use lands within our City limits from the tax rolls. The full annexation of the Bay- Laguna
Area is more vital to our City's recovery and rise in the seventies than ever before.
Gentlemen, I am of the opinion the ordinance the majority of you have voted for
does not and cannot legally accomplish your purpose. If you persist in your present views,
then let's do the thing right. I respectfully ask that you not overturn this veto, and that
we give the City Attorney and the City Engineer two weeks to put an ordinance in being
that will not be subject to successful challenge, at which time I will submit it to you as an
emergency ordinance.
