AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE
SALES CONTRACT FOR THE ACQUISITION OF PARCEL NO. 27,
BAYFRONT OPEN SPACE PROJECT, NO. 291 -70 -8, FROM OWNERS,
JOHN B. PETERSON AND WIFE, THELMA LAVERNE PETERSON;
APPROPRIATING THE SUM OF.$20,736.50 OUT OF NO. 291
PARR BOND FUND, OF WHICH $20,500 IS FOR ACQUISITION AND
$236.50 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING
COSTS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is hereby,
authorized to execute, for and on behalf of the City of Corpus Christi,
real estate sales contract with the owners of Parcel No. 27, Bayfront
Open Space Project,•No. 291 -70 -8, said owners being John B. Peterson
and wife, Thelma Laverne Peterson, said parcel being described as follows:
Lot One (1)•, Block Two (2), ALTA VISTA CLIFFS, an addition to the City
of Corpus Christi, Texas according to map or plat recorded in Vol.4,
Page 14, Map Records of Nueces County, Texas, and a tract of 'land 30 ft.
wide, more or less, and being adjacent to and adjoining the N. side of
Lot 1, Block 2, Alta Vista Cliffs, said 30 foot strip being des cribea by
metes and bounds as follows, to -wit:
BE in the E. right of way line of a public street- in the City of
Corpus Christi, Texas known as Ocean Drive at the NW corner of Lot 1,
Block 2, Alta Vista Cliffs, being also the SW corner of the tract herein
'described and being the place of beginning; THENCE, in a northerly direc-
tion along the E. right of way line of Ocean Drive, a distance of 30 ft.,
more or less, to the point of intersection with waters of Corpus Christi
Bay for the NW corner of this tract; said Port Aransas Cliffs being an
:addition in the City of Corpus Christi, County of Nueces, State of Texas,
according to map or plat thereof on file in the office of the County Clerk
of Nueces County, Texas in Vol. A, Page 27, Map Records of•Nueces County,
Texas; THENCE, in an easterly direction to the waters of Corpus Christi Bay
.along the S. boundary line of Lot 1, Block 15, Port Aransas Cliffs Addition
extended in an eastward direction to the waters of Corpus Christi Bay, for
the NE corner of this tract; THENCE, in a southerly direction following the
meanders of Corpus Christi Bay, a distance of 30 feet, more or less, to a
point being the SE corner of the tract herein conveyed, and also being the
NE corner of Lot 1, Block 2, Alta Vista Cliffs Addition; THENCE., in a west -
wardly direction along the N. boundary line of Lot 1, Block 2, Alta Vista
Cliffs Addition to a.point in the S.•right of way line of Ocean Drive, and
being the PLACE OF BEGINNING; and being the identical property described in
a deed dated December 2, 1963, from W. R. Reid, Trustee, to the Young Men's
Christian Association of Corpus Christi, recorded in Vol. 1024, Page 212,
Deed Records of Nueces County, Texas.
SECTION 2. There is hereby appropriated out of No. 291 Park
Bond Fund the sum of $20,736.50, of which amount of $20,500 is for acquisition
and $236.50 is for incidental expenses related to closing costs.
SECTION 3. The necessity to authorize the execution of the
necessary documents and to authorize the payment of funds for the acquisi-
tion of the aforesaid parcel of land in order to proceed with the develop -
went of the Bayfrout Open Space Project, creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared such
emergency and necessity to exist, and having requested the suspension of
the Charter rule and that this ordinance be passed finally on the date of
its introduction and take effect and be in full 'force and effect-from and
after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of

I certify to the City Council that $ 20,736.5o , the amount required
for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi

from which it is proposed to be drawn, and such money is not appropriated for
any other purpose.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I. therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
