CITY OF CORPUS CHRISTI
On. this the 11th day of November, 1970, the City
Council of the City of Corpus Christi, Texas, convened in
Regular Meeting, with the following members of said Council
present, to -wit:
Jack R. Blackmon, Mayor
V. A. Bradley, Jr.
Eduardo E. deAses
Gabe Lozano, Sr. Commissioners
Ken McDaniel
W. J. Roberts
Ronnie Sizemore
T. Ray Kring, City Secretary
with the following absent: ,
constituting a quorum, at which time the fol owing among other
business was transacted:
Mr. Blackmon, Mayor, presented for the consideration
of the Council an ordinance. The ordinance was read by the City
Secretary. The Mayor presented to the Council a communication
in writing pertaining to said proposed ordinance, as follows:

Gentlemen:
The public importance and pressing need for the perman-
ent improvements to be constructed by use of the proceeds of
bonds contemplated to be voted pursuant to an ordinance create
an emergency and an imperative public necessity requiring the
suspension of rules and Charter provisions requiring ordinances
to be considered and voted upon at three regular meetings. I,
therefore, request that the City Council pass the proposed ordinance
ordinance calling an election for the issuance of said bonds as
an emergency measure. You will please consider this request in
connection with the ordinance which is to be introduced for pas -.
sage by the City Council on this subject.

provision prohibiting ordinances from being passed finally on
the date introduced be suspended for the reasons stated in the
written request of the Mayor and stated in the emergency clause
of he ordinance. The motion was seconded by Commissioner

ORDINANCE NO.�
BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, CALLING AN
ELECTION ON THE QUESTION OF THE
ISSUANCE OF IMPROVEMENT BONDS.
WHEREAS, the City Council of said City deems it
advisable to issue the bonds of said City for the purposes
hereinafter stated; and
WHEREAS, it is hereby officially found and determined:
that a case of emergency or urgent public necessity exists which
requires the holding of the meeting at which this Ordinance is
passed, such emergency or urgent public necessity being that the
proceeds from the proposed bonds are required as soon as possible
and without delay for necessary and urgently needed public
improvements; that said meeting was open to the public as
required by law; and that public notice of the time, place, and
purpose of said meeting was given as required by law; and that
public notice of the time, place, and purpose of said meeting
was given as required by Chapter 227, Acts of the 61st Legisla-
ture, Regular Session, 1969.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
1. That an election shall be held in said City on the
5th day of December, 1970. The regular county election precincts
of Nueces County within the said City are hereby established as
the Election Precincts for such election. In all cases where a
County Election Precinct is not located entirely within the City
limits of the City of Corpus Christi so much of such County Elec-
tion Precinct that is located within the said City limits shall
be considered an election precinct for said City. The polling
places in each of the said County Election Precints that are
located entirely within or partially within the City limits shall
be as follows:

The Mayor of said City shall appoint the election
officers to hold said election, in accordance with law.
2. That at said election the following PROPOSITION
shall be submitted in accordance with law:
PROPOSITION
Shall the City Council of said City be
authorized to issue the bonds of said City,
in one or more series or issues, in the aggre-
gate principal amount of $3,000,000, with the
bonds of each such series or issue, respectively,
to mature serially within not to exceed forty
years from their date, and to be sold in accord-
ance with law at such prices and bear interest
at such rates as shall be determined within the
discretion of the City Council for the purpose
of providing funds for making permanent public
improvements, to -wit: a governmental center and
site therefor; and shall said City Council be
authorized to levy and cause to be assessed and
collected, annual ad valorem taxes in an amount
sufficient to pay the annual interest on said
bonds and provide a sinking fund to pay said
bonds at maturity?
.3. That said election shall be held in accordance
with law, and that said election shall be held and
conducted in effect as two separate but simultaneous elections,
to -wit: one election at which only the resident, qualified
electors who own taxable property in the City and who have duly
rendered the same for taxation shall be entitled to vote on
said PROPOSITIONS, and another election at which all other
resident, qualified electors of the City shall be entitled to
vote on said PROPOSITIONS. The votes cast at each of said
separate but simultaneous elections shall be recorded, returned,
and canvassed separately. It is hereby declared that the purpose
of holding the election in such manner is to ascertain arithmeti-
cally: (a) the aggregate votes-cast at the election for and
against said PROPOSITIONS by resident, qualified electors of the

City, and also (b) the aggregate votes cast at the election for
and against said PROPOSITIONS by.resident, qualified electors
who own taxable property in the City and who have duly rendered
the same for taxation. Each elector shall be entitled to vote
once, in accordance with the foregoing provisions of this
Ordinance.
4. That the official ballots for said election shall
be prepared in accordance with the Texas Election Code so as to
permit the electors to vote '"FOR" or "AGAINST" the aforesaid
PROPOSITIONS, which shall be set forth in substantially the
following form:

5. That voting machines shall be employed at the
election herein ordered in accordance with the provisions of
V.A.T.S. Election Code, Article 7'.14.
6. That the City Secretary of the City of Corpus
Christi shall be the clerk for absentee voting at said election;
and the office of said City Secretary in the City Hall is hereby
designated as the place at which absentee voting shall be con-
ducted for said election, during the regular office hours of

said City Secretary. Voting machines shall be used both for
absentee voting by personal appearance and for voting at the
regular polling places at said election; but paper ballots shall
be used for absentee voting by mail. A Special Canvassing Board
shall be appointed by the Mayor, as provided by law, to count
and canvass all absentee votes and ballots cast at.said
election.
7. A substantial copy of this Ordinance shall serve
as proper notice of said election. Notice shall be given in_
accordance with Article 704, Revised Civil Statutes of 1925,
as amended. The Mayor is authorized and directed to have a
copy of said notice posted at the City Hall in said City and
at each of the voting places in said City, not less than fifteen
days prior to the date fixed for holding said election. He
shall also cause said notice to be published on the same day
in each of two successive weeks in a newspaper of general
circulation published within said City, the date of the first
publication to be not less than fourteen days prior to the date
set for said election. Except as otherwise provided in said
Article 704, as amended, the manner of holding said election
shall be governed by the laws governing general elections.
8. That the public importance and the pressing need
for the permanent improvements to be constructed by use of the
proceeds of the sale of said bonds create an emergency and an
imperative public necessity requiring the suspension of rules
and Charter provisions requiring same to be considered and
voted upon at three regular meetings, and such facts require
that this ordinance be passed and take effect immediately as
an emergency measure, and such rules and provisions are hereby
suspended and this ordinance is passed and shall take effect as
an emergency measure, and shall be in full force and effect
immediately upon its passage.

9. It is hereby officially found and determined that
the meeting at which said election was called was open to the public
as required by law and public notice of the time, place, and pu=pos
of said meeting was given as required by Chapter 227, Acts of the
61st Legislature, Regular Session, 1969.
10. If for any reason any section, paragraph, subdivisi n,
clause, phrase, or provision of this Ordinance shall be held invali ,
it shall not affect any valid provisions of this or any other ordi-
nance of the City of Corpus Christi to which these rules and regu-
lations relate.
11. All ordinances or parts of ordinances in conflict
herewith shall be and are hereby repealed. y

For the reasons set forth in the emergency clause of the foregoing
ordinance, a.public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; 1, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
