AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO GRANT
A STREET EASEMENT TO NUECES COUNTY,30 FEET WIDE BY
APPROXIMATELY 2600 FEET, OUT OF THE SOUTH SIDE OF A
90.748 ACRE TRACT CONVEYED TO THE CITY OF CORPUS
CHRISTI BY GUARANTY NATIONAL BANK, AND RECORDED IN
VOLUME 1287, PAGE 232, NUECES COUNTY DEED RECORDS,
AND MORE FULLY DESCRIBED HEREINAFTER; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY,
AUTHORIZED AND DIRECTED TO GRANT A STREET EASEMENT, FOR AND ON BEHALF
OF THE CITY OF CORPUS CHRISTI, TO NUECES COUNTY,.SAID EASEMENT BEING
30 FEET WIDE BY APPROXIMATELY 2600 FEET OUT OF THE SOUTH SIDE OF A
90.748 ACRE TRACT CONVEYED TO THE CITY OF CORPUS CHRISTI BY GUARANTY
NATIONAL BANK, AND RECORDED IN VOLUME 1287, PAGE 232, NUECES COUNTY
DEED RECORDS, MORE FULLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHWEST CORNER OF THE CITY OF
CORPUS CHRISTI 90.748 ACRE TRACT, SAME BEING LOCATED
IN THE CENTER OF CARBON PLANT ROAD;
THENCE WITH THE SOUTH LINE OF SAID TRACT S. 780 24* 30"
E. A DISTANCE OF 20.01 FEET TO THE EAST RIGHT OF WAY
LINE OF ROAD FOR THE SOUTHWEST CORNER AND POINT OF
BEGINNING OF THIS DESCRIPTION;
THENCE CONTINUING S. 78° 241 30" E. WITH SAID SOUTH
LINE OF CITY OF CORPUS CHRISTI TRACT A DISTANCE OF
2602.30 FEET TO THE SOUTHEAST CORNER OF THE CITY OF
CORPUS CHRISTI 90.748 ACRE TRACT AND A POINT IN THE
WEST LINE OF THE HUNTER TRACT FOR THE SOUTHEAST CORNER
OF THIS DESCRIPTION; -
THENCE N. 0° 131 W. WITH THE COMMON LINE BETWEEN THE
CITY OF CORPUS CHRISTI AND HUNTER TRACTS A DISTANCE OF
30.65 FEET TO A POINT IN THE PROPOSED NORTH RIGHT OF
WAY LINE OF A 60 FOOT ROAD FOR THE NORTHEAST CORNER
OF THIS DESCRIPTION;
THENCE N. 78^ 241 30" W. WITH THE NORTH RIGHT OF WAY
LINE OF PROPOSED ROAD A DISTANCE OF 2597.13 FEET TO
A POINT IN THE EAST RIGHT OF WAY LINE OF CARBON PLANT
ROAD FOR THE NORTHWEST CORNER OF THIS DESCRIPTION;
THENCE S. 09° 291 W. A DISTANCE OF 30.02 FEET TO THE
POINT OF BEGINNING.
CONTAINING 1.790 ACRES OF LAND, MORE OR LESS.

SECTION 2. IT IS HEREBY EXPRESSLY PROVIDED THAT WHENEVER THE
EASEMENT TRACT HEREINABOVE DESCRIBED IS ABANDONED, OR ITS USE FOR STREET
OR ROAD PURPOSES IS DISCONTINUED, OR SAID TRACT IS LEASED OR SOLD TO A
PRIVATE PARTY, INDIVIDUAL, OR AGENCY, ALL TITLE, INTEREST, AND EASEMENT
CONVEYED HEREIN SHALL THEREUPON, IN ANY OF SAID EVENTS,REVERT TO THE
CITY OF CORPUS CHRISTI.
SECTION 3. THE NECESSITY TO GRANT THE AFORESAID EASEMENT
AT THE EARLIEST PRACTICABLE DATE IN ORDER THAT THE SAME MAY BE USED
BY THE COUNTY OF NUECES FOR ROAD, DRAINAGE AND UTILITY PURPOSES CREATES
A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,
AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
.EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT
IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF NOVEMBER, 1970.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
