HomeMy WebLinkAbout10002 ORD - 11/18/19701XH:11 -18_70 a AN ORDINANCE ANNEXING TO THE CITY CERTAIN PUBLIC LANDS, INCLUDING THE NUECES RIVER AREA; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, ON THE 12TH DAY OF AUGUST, 1970, A PUBLIC HEARING WAS ORDERED TO BE HELD BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON THE 26TH DAY OF AUGUST, 1970 FOR THE CONSIDERATION OF THE ANNEXATION OF CERTAIN AREAS WITHIN THE EXTRATERRITORIAL DISTRICT OF THE CITY OF CORPUS CHRISTI TO PROVIDE AN OPPORTUNITY FOR ALL INTERESTED PERSONS TO BE HEARD; AND WHEREAS, NOTICE OF SUCH HEARING HAS BEEN PUBLISHED IN SUCH NEWSPAPER PURSUANT TO ARTICLE 970A, V.A.C.S.,.ANDAPPLICABLE LAW; AND WHEREAS, ALL NOTICES OF SAID HEARING APPLICABLE THERETO HAVE BEEN MADE AND THIS ANNEXATION PROCEEDING HAS BEEN CONDUCTED AND IS BEING CONCLUDED ACCORDING TO LAW; AND WHEREAS, SAID PUBLIC HEARING WAS DULY HELD ON THE 267TH DAY OF AUGUST, 1970, AT THE REGULAR MEETING OF THE CITY COUNCIL AT WHICH ALL PERSONS DESIRING TO BE HEARD OR INTERESTED IN SAID ANNEXATION WERE HEARD, AND BY MOTION MADE, SECONDED AND CARRIED BY THE CITY COUNCIL THE SAID HEARING WAS CLOSED; AND WHEREAS, IT HAS BEEN DETERMINED BY SAID CITY COUNCIL THAT THE TERRITORY PROPOSED TO BE ANNEXED ABUTS AND IS CONTIGUOUS AND ADJACENT TO THE CITY OF CORPUS CHRISTI AND CONSTITUTES PHYSICAL AREAS USED FOR PUBLIC PURPOSES, OWNED BY GOVERNMENTAL SUBDIV.ISIONS, OR HAS BEEN DEDI- CATED TO A PUBLIC USE; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT WOULD BE ADVANTAGEOUS TO THE CITY AND TO ITS CITIZENS AND IN THE PUBLIC INTEREST TO ANNEX THE AFORESAID AREA HEREAFTER DESCRIBED: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE FOLLOWING DESCRIBED AREA BE AND THE SAME IS HEREBY ANNEXED TO THE CITY OF CORPUS CHRISTI: 3L0002 AREA A . BEGINNING AT A POINT IN THE PRESENT CITY LIMITS LINE SAID POINT BEING ON THE LOW -WATER LINE ONTHE SOUTH SIDE OF THE NUECES RIVER, SAID POINT BEING IMMEDIATELY NORTHEAST OF THE CITY OF CORPUS CHRISTI 6.90 -ACRE TRACT ADJACENT TO RIVER FOREST SUBDIVISION FOR A CORNER OF THIS TRACT, HEREIN DESCRIBED; THENCE UPSTREAM IN A GENERAL WESTERLY DIRECTION WITH THE MEANDERS OF SAID LOW -WATER LINE OF THE SOUTH SIDE OF THE NUECES RIVER, A DISTANCE OF 5.0 MILES MORE OR LESS TO A POINT; THENCE IN A NORTHERLY DIRECTION ACROSS THE NUECES RIVER LOW -WATER LINES TO THE LOW -WATER LINE ON THE NORTH SIDE OF THE NUECES RIVER FOR A POINT; THENCE DOWNSTREAM IN A GENERAL EASTERLY DIRECTION WITH THE MEANDERS OF THE LOW -WATER LINE ON THE NORTH SIDE OF THE NUECES RIVER TO A POINT IN THE PRESENT CITY LIMITS LINE OPPOSITE AND NORTHWEST OF SAID 6.90 -ACRE CITY OF CORPUS CHRISTI TRACT; THENCE SOUTHEASTERLY WITH THE PRESENT CITY LIMITS LINE ACROSS THE NUECES RIVER LOW -WATER LINE TO THE POINT OF BEGINNING CONTAINING 30.5 ACRES OF LAND MORE OR LESS; -2- 3 IT IS FURTHER HEREBY EXPRESSLY PROVIDED THAT WHEREVER THE ABOVE DESCRIBED BOUNDARIES AND PERIMETERS OF THE SAID AREA ENCLOSE$ ANY LANDS OR SUBMERGED LANDS NOT USED FOR PUBLIC PURPOSES, NOT OWNED BY GOVERNMENTAL ,11k AC7r<rU ia ' OR NOT DEDICATED TO A PUBLIC USE, SUCH LANDS OR SUBMERGED // -if-747 LANDS, IF ANY, SHALL NOT BE INCLUDED WITHIN THIS ANNEXATION. THAT SAID AREA IS HEREBY RECEIVED INTO SAID CITY AND IS INCLUDED WITHIN THE TERRITORIAL LIMITS OF SAID CITY AS AN INTEGRAL PART THEREOF, AND THAT SAID TERRITORY SHALL HEREAFTER BE A PART OF THE CITY OF CORPUS CHRISTI, TEXAS, AND SHALL BE SUBJECT TO THE GENERAL LAWS OF THE STATE OF TEXAS, THE CITY CHARTER OF THE CITY AND THE ORDINANCES, RESOLUTIONS, LAWS, RULES AND REGULATIONS OF THE CITY OF CORPUS CHRISTI, TEXAS, TO ALL INTENTS AND PURPOSES AS THE PRESENT CITY OF CORPUS CHRISTI IS SO SUBJECT, AND SUBJECT TO ALL THE RIGHTS PRIVILEGES AND BURDENS THEREOF. SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE ACTS, NOTICES, RESOLUTIONS, RULES AND REGULATIONS RELATE: SECTION 3. THE NECESSITY TO IMMEDIATELY ANNEX TO THE CITY OF CORPUS CHRISTI THE AFORESAID LANDS AND TO DECLARE THAT THEY SHALL HERE- AFTER BE A PART OF THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SAID ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, HAVING REQUESTED THE SUSPENSION OF THE SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE ldrVk -DAY of NOVEMBER, 1970- ATTES C Y SECRE ARY MAYOR APPROVED: HE CITY OF CORPUS CHRISTI, TEXAS 'v- 7�Y OZ , 1970: CI Y ATTORNEY Corpus Christi, Texas day of . 19 A TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the city Council.
