HomeMy WebLinkAbout10006 ORD - 11/18/1970BJw:11 /18/70 TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH BLACK & VEATCH CONSULTING ENGINEERS FOR PRO- FESSIONAL SERVICES REQUIRED IN CONNECTION WITH IM- PROVEMENTS TO THE OSO SEWAGE TREATMENT PLANT SLUDGE HANDLING FACILITIES; APPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND FUND THE SUM OF $2%300 OF WHICH SUM $28,300 IS FOR PROFESSIONAL SERVICES AND $1,000 IS FOR LABORATORY INVESTIGATION AND CONTINGENCIES, APPLICABLE TO PROJECT NO. 250- 70 -81; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH BLACK & VEATCH CONSULTING ENGINEERS FOR PROFESSIONAL SERVICES REQUIRED IN CONNECTION WITH IMPROVEMENTS TO THE DSO SEWAGE TREATMENT PLANT SLUDGE HANDLING FACILITIES, APPLICABLE TO PROJECT N0. 250 - 70-811 IN ACCORDANCE WITH THE TERMS OF THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF NO. 250 SANITARY SEWER BOND FUND THE SUM OF $29,300 OF WHICH SUN $28,300 IS FOR PROFESSIONAL SERVICES AND $1,000 IS FOR LABORATORY INVESTIGATION AND CONTINGENCIES. SECTION 3. THE NECESSITY TO PROVIDE THE NECESSARY FUNDS AND TO AUTHORIZE THE HEREINABOVE DESCRIBED CONTRACT IN ORDER THAT THE WORK OUT- LINED ABOVE MAY PROCEED WITHOUT DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE t=L DAY OF NOVEMBER, 1970. ATTEST: CITY ECRETARY D THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: Y OF NO EMBER, 1970: :�M 1 0006 4J S CITY ATTORNE r � • CONTRACT FOR ENGINEERING SERVICES THIS CONTRACT, made and executed this day of , 1970, by and between the City of Corpus Christi, Texas, a municipal corporation, hereinafter called the City, party of the first part, and Black & Veatch, Con- sulting Engineers of Kansas City, Missouri, hereinafter called the Engineers, party of the second part; WITNESSETR That the City is desirous of employing Consulting.Engineers to perform certain engineering services as defined generally hereinafter and pertaining to the handling, processing, and ultimate disposal of solids from the OSO Waste Treat- ment Plant in order to determine the need for relocation, rehabilitation and /or improvements to the existing sludge facilities, and to establish an immediate program for such improvements that will be consistent with probable long -range objectives. THEREFORE In consideration of the mutual covenants herein contained, the City hereby agrees to employ the Engineers to perform the services hereinafter listed and agrees to pay them for such services according to the schedule of fees herein contained. The services which the Engineers agree to perform; upon authorization of the City include: Phase I - Engineering Studies and Report (A) Visits to the project site for discussions with supervisory and opera- ting personnel and for observation of problems of operation and maintenance of the existing sludge facilities. (B) Review of City records for the past five years to determine the annual operating and maintenance costs for the existing sludge disposal facilities, in- cluding labor, power, chemicals, fuel, supplies, and other miscellaneous operat- ing and maintenance costs. (C) Review of sales of fertilizer for the past five years to establish gross annual revenues and studies of sales by month to evaluate needs for storage facilities. (D) Projections of quantities of sludge to be handled at the OSO site for the next decade. (E) Consultation with regulatory agencies to establish criteria involved in the project. (F) Studies to determine the most feasible long -range plan for disposal of solids from the OSO site including, but not limited to,.the following dis- posal processes. (1) Liquid Sludge Disposal, (2) Dewatered Sludge Disposal' (3),Incinerated Sludge Disposal (G) The preparation of estimates of capital costs and operating costs for each of the alternatives studied under Item F. (H) Recommendations concerning the most feasible long -range plan, with due regard to capital cost, operating cost, and problems of public acceptance. In the event the most feasible plan has an estimated probable construction cost in excess of the amount budgeted for this purpose by the City, the Engineers will present an alternate plan with a probable construction cost within the budget limitation. (I) The incorporation of all data, findings, recommendations, cost esti- mates, sketch layouts, etc, in a report to be filed with the City in thirty (30) copies. Phase II - Detailed Plans and Specifications After the City has determined the scope of work to be performed under the program and subsequent to written authorization by the City, the Engineers will: (A) Make the necessary field surveys required for drawing.plans and specifications. (S) Provide assistance and guidance in exploratory work conducted by the City. (C) Consult with the necessary state and federal agencies concerning the plans to be drawn as to requirements covering items in which they might be interested. (D) Prepare detailed plans and /or specifications for the proposed con- struction work and for all equipment required. - 2 - (E) Prepare an estimate of probable construction costs for the pro- posed work as covered by the plans and specifications. (F) Submit plans and specifications for review and approval to the State Board of Health and any other state or federal agency which has a regulator interest in the project. (0) Assist and advise the City concerning award of contracts. (H) Review drawings and data submitted by the contractor as required for general conformity to the plans and specifications. (I) Make periodic visits to the site of the work during construction and consult with the City concerning progress. (J) Observe field tests of equipment. (&) Provide a set of revised prints conforming to construction records. Phase III - Resident. Engineering Services At the option of the City, to furnish a full -time resident engineer on the work who will assist and offer general guidance on establishing horizontal and ver- tical control points, the interpretation of the contract documents, and the mak- ing of field checks of materials and equipment. During the course of the contractor's performance of the job, the resident engi- neer will conduct on -site observations of the general progress of the work and will consult with the City and the contractor, giving his opinions and suggestions, based on his observations, as to any defects or deficiencies in the contractor's work. This service will in no way relieve the contractor of complete supervision of the work or the contractor's obligation for complete compliance with the plans and specifications. The resident engineer will also prepare all routine monthly and final payment estimates for guiding the City in payments to the contractor, and will report regularly to the City and to the Engineers upon the progress and quality of the work. The actual time the services of the resident engineer or engineers will be re- quired will be determined by the City. For the services outlined above, the City agrees to pay the Engineers as follows: (A) Upon the delivery and acceptance of the thirty (30) copies of the com- pleted report to the City, the lump sum of Five Thousand. Dollars ($5,000.00) as payment in full for the services rendered under Phase I of this contract. Two Thousand Five Hundred Dollars ($2,500.00), of this report fee will be applied subsequently as a credit to the payment for services under Phase II, if author- ized by the City. - 3 - (B) Upon the delivery of the plans and specifications and the award of construction contract, a sum equal to eighty -five percent (85 %) of the percentage engineer's fee, as defined hereinafter under mutual agreements, times the cost of the work, covered by the plans and specifications, exclusive of the cost of the land appraisers fees, -and rights -of way, less a credit of Two Thousand Five Hundred Dollars ($2,500.00). In the event construction awards are not made within one hundred fifty (150) days after the delivery of plans and speci- fications, the payment shall be based on the Engineers` estimate of construction cost. This fee will constitute full payment for serv- ices under Phase II. (C) Upon the completion of construction an amount sufficient to bring the total payments under Phase II equal to the percentage fee, as defined hereinafter under mutual agreements, times the final and actual construction cost, less a credit of Two Thousand Five Hun- dred Dollars ($2,500.00). (D) For the services of the resident engineer, outlined in Phase III above, the City agrees to pay the Engineers a fee equal to the salary cost, as defined under Section VII of TSPE Manual of Pro- fessional Practice - 1967, times a multiplier of 2.00 payable monthly. It is mutually agreed-and understood that: The percentage fee for payment of services under Phase II will be based on Classification A, page 9, TSPE Manual of Professional Practice - .1967. That the City will provide, at its own expense, which shall not, however, be included in the estimated construction cost or construction cost calculation of the percentage fee, all exploratory work, such as the digging of test pits, . making soil bearing tests, laboratory analyses, etc., necessary for the prepa- ration of plans and specifications. The work will be done with the assistance and guidance of the Engineers, who will furnish the engineering services for such work. That the City will provide, at its own expense, any property description'and land surveys that may be required. That the Engineers will complete the services under Phase I within 90 days after authorization and will deliver the completed plans and specifications within six months following authorization to proceed under Phase II. - 4 - f IN WITNESS WHEREOF, the parties of the first and second parts have hereunto set their hands and seals in duplicate originals on the date first above written.
