AMENDING SECTION 27 -3 MODIFICATION OF AREA REGULATIONS, BY ADDING A NEW SUBSECTION, NLMBERED 27 -3.07, CONCERNING TRASH AREAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING CERTAIN AMENDMENTS TO' THE TEXT OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON AUGUST 19, 1970, AT REGULAR COUNCIL MEETING OF THE CITY COUNCIL IN THE CITY COUNCIL CHAMBER OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENTS WOULD BEST SERVE THE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING.OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, -AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 29TH DAY OF MARCH, 1961, BE, AND THE SAME IS HEREBY, AMENDED BY MAKING THE CHANGES HEREINAFTER SET OUT. - SECTION 2. THAT ARTICLE 3, DEFINITIONS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SUBSECTION 3 -1.03 APARTMENT TO HEREAFTER READ AS FOLLOWS: "3 -1.03 APARTMENT. AN APARTMENT IS A LIVING UNIT OR DWELLING UNIT WITHIN A MULTIPLE- FAMILY DWELLING STRUCTURE, A PART OF A BUILDING CONTAINING COOKING AND HOUSEKEEPING FACILITIES, CONSISTING OF A ROOM, OR SUITE OF ROOMS, INTENDED, DESIGNED, AND USED AS A RESIDENCE BY AN INDIVI- DUAL OR A SINGLE FAMILY." SECTION 3. THAT SUBSECTION 3 -1.16 COURT BE AMENDED TO HEREAFTER READ AS FOLLOWS: "3- 1.16'000RT. AN OPEN SPACE WHICH MAY INCLUDE UNCOVERED PARKING AROUND WHICH IS ARRANGED A SINGLE BUILDING OR A GROUP OF RELATED BUILDINGS." SECTION u. THAT SUBSECTION 3 -1.22 DWELLING, MULTIPLE - FAMILY, BE AMENDED TO HEREAFTER READ AS FOLLOWS: "3 -1.22 DWELLING MULTIPLE- FAMILY. A DWELLING DESIGNED, ARRANGED, OR USED EXCLUSIVELY FOR THE USE AND OCCUPANCY OF THREE OR MORE FAMILIES LIVING INDEPENDENTLY OF EACH OTHER. THE DWELLING STRUCTURE MAY INCLUDE A TRIPLEX, APARTMENT, TOWNHOUSE, CONDOMINIUM, COOPERATIVE, HIGH -RISE, ETC." SECTION 5., THAT SUBSECTION 3 -1.26 FLOOR - LOT RATIO BE AMENDED TO HEREAFTER READ AS FOLLOWS: "3 -1.26 FLOOR AREA FACTOR. THE FLOOR AREA FACTOR IS MULTIPLIED BY LAND AREA TO DETERMINE THE TOTAL PERMITTED FLOOR AREA." SECTION 6. THAT SKETCHES AND ILLUSTRATIONS OF FLOOR -LOT RATIO, FOLLOWING SUBSECTION 3 -1.26, AS THEY PRESENTLY APPEAR AT THE TOP OF PAGE 5 OF THE ZONING ORDINANCE, BE DELETED IN THEIR ENTIRETY. SECTION 7. THAT ILLUSTRATION OF YARD, FOLLOWING SUBSECTION 3 -1.71 YARD, SIDE, BE DELETED IN ITS ENTIRETY AND THAT A NEW SUBSECTION, TO BE NUMBERED 3 -1.72, BE ADDED, TO READ AS FOLLOWS: "3 -1.72 YARD, OPEN SPACE. ANY YARD OR COURT AREA, BUT NOT . INCLUDING ANY AREAS DEVOTED TO AUTOMOBILE CIRCULATION OR PARKING AREA." SECTION 8. THAT ARTICLE 7, "R -2" TAG- FAMILY DWELLING DISTRICT REGULATIONS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SUBSECTION 7 -2, USE REGULATIONS, ITEM (3) BY DELETING THE PRESENT ITEM (3) AND ADDING A NEW ITEM (3) READING AS FOLLOWS: • -3- "7 -2, USE REGULATIONS. MULTIPLE FAMILY OR TOWNHOUSE DWELLINGS HOUSING NO MORE THAN TEN (10) DWELLING UNITS PER DETACHED BUILDING.° SECTION 9. THAT ARTICLE 9, "A -2" APARTMENT HOUSE DISTRICT REGULATIONS, OF THE ZONING ORDINANCE-OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SECTION -1 TO HEREAFTER READ AS FOLLOWS: "SECTION 9 -1 THE REGULATIONS SET FORTH IN THIS ARTICLE, OR SET FORTH ELSEWHERE IN THIS ORDINANCE WHEN REFERRED TO IN THIS ARTICLE, ARE THE REGULATIONS IN THE IA -21 APARTMENT HOUSE DISTRICT. THIS, THE HIGHEST DENSITY RESIDENTIAL DISTRICT,IS GENERALLY LOCATED NEAR OR WITHIN THE CENTRAL PART OF THE CITY AND PROVIDES FOR CERTAIN TRANSIENT RESIDENCE AS WELL AS PERMANENT RESIDENCE AND FOR CERTAIN INSTITUTIONAL USES." SECTION 10. THAT SECTION 9 -5, SUBSECTION 9 -5.01, BE AND THE SAME 15 HEREBY AMENDED BY DELETING THE PRESENT SUBSECTION 9 -5.01 AND IN LIEU THEREOF ADDING A NEW SUBSECTION TO READ AS FOLLOWS: "9 -5.01 BUILDINGS MAY EXCEED SIXTY (60) FEET OR FOUR (4) STORIES IN HEIGHT PROVIDED THAT FORTY PERCENT (40%) OF THE SITE IS DEVOTED TO NONVEHICULAR OPEN SPACE." SECTION 11. THAT SECTION 9 -5, SUBSECTION 9 -5.02, BE AMENDED TO HEREAFTER READ AS FOLLOWS: "9 -5.02 REQUIREMENTS FOR FLOOR AREA PER ACRE SHALL NOT APPLY TO DORMITORIES, FRATERNITIES, OR SORORITIES WHERE NO COOKING FACILITIES ARE PROVIDED IN INDIVIDUAL ROOMS OR APARTMENTS." SECTION 12. THAT ARTICLE 10, "AT" APARTMENT- TOURIST DISTRICT REGULATIONS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SECTION 10 -1 TO HEREAFTER READ AS FOLLOWS: "SECTION 10 -1 THE REGULATIONS SET FORTH IN THIS ARTICLE, OR SET FORTH ELSEWHERE IN THIS ORDINANCE WHEN REFERRED TO IN THIS ARTICLE, ARE THE REGULATIONS IN THE 'AT' APARTMENT - TOURIST DISTRICT. THIS DISTRICT IS DESIGNED TO PERMIT HIGH -RISE MULTIPLE- FAMILY DWELLINGS AND TOURIST ACCOMMODATIONS WITH LIMITED OUTDOOR ADVERTISING SO AS TO BE GENERALLY -4- COMPATIBLE WITH EXISTING DEVELOPMENT IN THE DISTRICT AND IN SURROUNDING RESIDENTIAL NWIGHBORH00DS." SECTION 13. THAT SECTION 10-2, ITEM (3), BE AMENDED TO HEREAFTER READ AS FOLLOWS: „(3) MULTIPLE- FAMILY DWEL4.INGS (INCLUDING HIGH - RISE). SECTION 111. THAT SECTION 10.5 HEIGHT, AREA, AND BULK REGULATIONS, BE AMENDED BY DELETING THE FOLLOWING WORDS AT THE END OF THE SENTENCE: AND IN ADDITION THE FOLLOWING REGULATIONS SHALL APPLY : ". SECTION 15. THAT SUBSECTION 10-5.01 BE DELETED IN ITS ENTIRETY. SECTION 16. THAT ARTICLE 11, "AB" PROFESSIONAL OFFICE DISTRICT REGULATIONS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SECTION 11-5 By DELETING SUBSECTION 11 -5.01 IN ITS ENTIRETY. SECTION 17. THAT SUBSECTION 11 -5.02 BE RENUMBERED 11 -5.01 AND BE AMENDED TO HEREAFTER READ AS FOLLOWS: "11 -5.01 REQUIREMENTS FOR FLOOR AREA PER ACRE SHALL NOT APPLY TO DORMITORIES, FRATERNITIES, OR SORORITIES WHERE NO COOKING FACILITIES ARE PROVIDED IN INDIVIDUAL ROOMS OR APARTMENTS." SECTION 18. THAT ARTICLE 16, "B-4" GENERAL BUSINESS DISTRICT REGULATIONS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY DELETING SUBSECTION 16 -5.03 IN ITS ENTIRETY. SECTION 19. THAT ARTICLE 20, "1 -2" LIGHT INDUSTRIAL DISTRICT REGULATIONS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY DELETING SUBSECTION 20 -5.03 IN ITS ENTIRETY. SECTION 20. THAT ARTICLE 22, PARKING REGULATIONS, of THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY AMENDING SECTION 22 -1 BY AMENDING THE TABLE, COLUMN 3, PERTAINING TO "OFFICE OR OFFICE BUILDING, STUDIO OR CLINIC" TO HEREAFTER READ "ALL DISTRICTS") COLUMN 4, TO HEREAFTER READ "1 PER 200 SQUARE FEET OF FLOOR AREA "; AND COLUMN 5, TO HEREAFTER READ "5 SPACES MINIMUM." -5- SECTION 21. THAT SECTION 22 -1 BE.AMENDED BY AMENDING THE TABLE COLUMN 44, PERTAINING TO "FUNERAL HOME" TO HEREAFTER READ "1 PER 5 SEATS PER PARLOR OR CHAPEL." SECTION 22. THAT SECTION 22 -1 BE AMENDED BY AMENDING THE TABLE COLUMN 3, PERTAINING TO "RETAIL STORE OR PERSONAL SERVICE ESTABLISHMENT AND BANKS" TO HER READ "ALL DISTRICTS" AND COLUMN 44, TO HEREAFTER READ "1 PER 200 SQUARE FEET OF FLOOR AREA." SECTION 23. THAT SECTION "22 -3 JOINT USE AND OFF -SITE FACILITIES BE AMENDED BY AMENDING SUBSECTION 22 -3.01 TO HEREAFTER READ AS FOLLOWS: "22 -3.01 UP TO FIFTY PERCENT (50%) OF THE PARKING SPACES REQUIRED FOR (A) PUBLIC AUDITORIUMS, AND UP TO 100 PERCENT (100 %) OF THE PARKING SPACES REQUIRED FOR A CHURCH AUDITORIUM MAY BE PROVIDED AND USED JOINTLY BY (B) BANKS OFFICES RETAIL STORES, REPAIR SHOPS, SERVICE ESTABLISHMENTS AND SIMILAR USES NOT NORMALLY OPENS USED OR OPERATED DURING THE SAME HOURS AS THOSE LISTED IN (A); PROVIDED, HOWEVER THAT WRITTEN AGREEMENT THERETO IS PROPERLY EXECUTED AND FILED AS SPECIFIED BELOW." SECTION 244. THAT SECTION 22 -4 DESIGN STANDARDS, BE AMENDED BY AMENDING SUBSECTION 22 -44.01 TO HEREAFTER READ AS FOLLOWS: "22 -44.01 AS DEFINED IN SECTION 3 -1, AN OFF- STREET PARKING SPACE IS AN ALL- WEATHER SURFACED AREA NOT IN A STREET OR ALLEY AND HAVING AN AREA OF NOT LEAS THAN 180 SQUARE FEET AND A MINIMUM DIMENSION OF 9' X 201, EXCLUSIVE OF DRIVEWAYS PERMANENTLY RESERVED FOR THE TEMPORARY STORAGE OF ONE AUTOMOBILE AND CONNECTED WITH A STREET OR ALLEY BY AN ALL - WEATHER SURFACED DRIVEWAY WHICH AFFORDS UNOBSTRUCTED INGRESS AND EGRESS TO EACH SPACE. IF SUCH PARKING LOT CONTAINS FOUR (44) OR MORE VEHICLE SPACES ALL SURFACES SHALL BE PAVED WITH ASPHALT OR CONCRETE MATERIALS." SECTION 25. THAT SECTION 22 -44 BE AMENDED BY ADDING A NEW SUBSECTION 22 -44.02 TO READ AS FOLLOWS: "22 -44.02 A BUILDING PERMIT SHALL BE REQUIRED FOR THE CONSTRUC- TION OF ANY COMMERCIAL PARKING LOTS OR PARKING LOT REQUIRED BY THE TERMS OF THIS ORDINANCES WHICH CONTAINS FOUR (44) OR MORE VEHICLE SPACES. WHEN HEADER CURB IS REQUIRED ALONG PUBLIC RIGHT -OF -WAYS PERMIT APPROVAL OF THIS CURB AS WELL AS DRIVEWAYS WITHIN THE PUBLIC RIGHT -OF -NAY SHALL BE OBTAINED FROM THE DIRECTORS OF PUBLIC WORKS AND TRAFFIC ENGINEERING." -6- THAT THE PRESENT SUBSECTIONS 22 -4.02 AND 22 -4.o3 BE RENUMBERED AS SUBSECTIONS 22 -4.2j AND 22 -4.04, RESPECTIVELY. SECTION 26. WHEN IN THE OPINION OF THE DIRECTOR OF PUBLIC WORKS IT BECOMES NECESSARY TO CONSTRUCT SUCH HEADER CURB OR BARRIER TO PREVENT VEHICLES FROM PARKING ON, TURNING ON, OR OTHERWISE MOVING ACROSS EXISTING OR FUTURE SIDEWALK, SAID CURB SHALL BE CONSTRUCTED." THAT ARTICLE 27, SUPPLEMENTARY HEIGHT, AREA AND BULK REQUIREMENTS, OF THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED BY DELETING SUBSECTION 27- 3.01.E IN ITS ENTIRETY AND ADDING A NEW SUBSECTION 27- 3.01.23 TO HEREAFTER READ AS FOLLOWS: °27- 3.01.2, IN THE EVENT THAT ONE OR MORE CONTIGUOUS LOTS UNDER ONE OWNERSHIP OF MORE THAN 20,000 SQUARE FEET WITH AN AVERAGE WIDTH OF MORE THAN 125 FEET IS TO BE OCCUPIED BY A GROUP OF TWO OR MORE RELATED -7- BUILDINGS TO BE USED FOR MULTIPLE - FAMILY INSTITUTIONAL HOTEL OR MOTEL PURPOSES SUW BUILDINGS SHALL BE ARRANGED AROUND A COURT OR COURTS; PROVIDED HOWEVER, THAT ANY SUCH COURT BETWEEN BUILDINGS SHALL HAVE AN AVERAGE WIDTH OF AT LEAST THIRTY (30') FEET FOR ONE -STORY BUILDINGS; AT LEAST FORTY (YO1) FEET FOR TWO AND THREE -STORY BUILDINGS; BUT IN NO CASE MAY ANY WALL OF ANY SUCH BUILDING BE CLOSER THAN SIXTEEN (16') FEET TO ANOTHER BUILDINGS EXCEPT AS SET FORTH IN ARTICLE 24 OF THIS ORDINANCE; AND ANY BUILDING PARALLEL OR WITHIN 300 OF BEING PARALLEL TO ANOTHER BUILDING FOR A DISTANCE OF MORE THAN SIXTY (601) FEET SHALL HAVE A MINIMUM SEPARA- TION OF TWENTY -FIVE (25') FEET; PROVIDED FURTHER THAT EACH BUILDING SHALL BE DIRECTLY ACCESSIBLE FROM A PUBLIC STREET OR FROM AN UNOBSTRUCTED FIRE LANE." THAT SECTION 27 -3 MODIFICATION OF AREA REGULATIONS BE AMENDED BY ADDING A NEW SUBSECTION, TO BE NUMBERED 27 -3.07 TO READ AS FOLLOWS: "27 -3.07 TRASH AREAS: "27- 3.07.01 ON ANY LOT USED FOR BUSINESS OR MULTIPLE FAMILY PURPOSES ALL TRASH AREAS SHALL BE PROVIDED IN A PLACE ACCESSIBLE TO VEHICLES USED FOR PICKING UP AND CARRYING TRASH AWAY. THESE AREAS SHALL BE EFFECTIVELY SCREENED FROM STREET, PUBLIC AND NEIGHBORING VIEWS." SECTION 30. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED.
