HomeMy WebLinkAbout10039 ORD - 12/16/1970TEXAS: AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT WITH MANSON INDUSTRIES FOR TRANSIT SYSTEM BUILDING REHABILITATION;'APPROPRIATING $7,900 FOR THE CONSTRUCTION CONTRACT OUT OF NO. 218 TRANSIT SYSTEM BOND FUND; APPROPRIATING THE SUM OF $13,454 OUT OF THE NO. 220 STREET BOND FUND, OF WHICH $1500 IS APPLICABLE TO PROJECT NO. 220- 70 -108r NORTH ALAMEDA, WEST BROADWAY TO I.H. 37, AND $11,954 IS APPLICABLE TO PROJECT NO. 220 -70 -122, WINNEBAGO STREET IMPROVEMENTS, NORTH ALAMEDA TO SAM RANKIN; AUTHORIZING THE REIMBURSE- MENT OF TRANSIT SYSTEM BOND FUND FOR EXPENSES INCURRED IN IMPROVING PORTIONS OF ALAMEDA AND WINNEBAGO STREETS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH MANSON INDUSTRIES TO PROVIDE FOR THE REHABILITATION OF THE TRANSIT SYSTEM BUILDING, ALL AS MORE FULLY DESCRIBED IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF MANSON INDUSTRIES, OPENED ON THE 18TH DAY OF NOVEMBER, 1970, THE SAID BID OF MANSON INDUSTRIES BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $7,900 FOR THE CONSTRUCTION CONTRACT WITH MANSON INDUSTRIES OUT OF THE N0. 218 TRANSIT SYSTEM BOND FUND. SECTION 3. THERE IS HEREBY APPROPRIATED THE SUM OF $13,454 OUT OF THE N0. 220 STREET BOND FUND OF WHICH $1500 IS APPLICABLE TO PROJECT N0. 220 -70 -108, NORTH ALAMEDA, WEST BROADWAY TO I.H. 37, AND $11,954 IS APPLICABLE TO PROJECT N0. 220-70 -122, WINNEBAGO STREET IMPROVE- MENTS, NORTH ALAMEDA TO SAM RANKIN. SECTION 4. AUTHORIZATION IS HEREBY GRANTED FOR REIMBURSEMENT OF TRANSIT SYSTEM BOND FUND FOR EXPENSES INCURRED IN IMPROVING PORTIONS OF ALAMEDA AND WINNEBAGO STREETS. SECTION 5. THE NECESSITY TO PROVIDE THE NECESSARY FUNDS FOR THE TRANSIT SYSTEM REHABILITATION AS SOON AS POSSIBLE SO THAT WORK MAY BE 1®939 COMMENCED AT THE EARLIEST POSSIBLE DATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /Zp'/iLe DAY OF DECEMBER, 1970. Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a_public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
