BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 0 SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AN ACCEPTANCE- LETTER CONTRACT WITH TETCO FOR LABORATORY TESTING SERVICES IN CONNECTION WITH THE CONSTRUCTION OF STREET IMPROVEMENTS, MOLINA AREA NEIGHBORHOOD IMPROVEMENT PROGRAM, PROJECT NO. 220 -67 -92.3 FOR $16,722.25, PREVIOUSLY APPROPRIATED BY ORDINANCE No. 9709, A COPY OF SAID ACCEPTANCE - LETTER CONTRACT BEING ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO EXECUTE THE AFORESAID ACCEPTANCE- LETTER CONTRACT FOR LABORATORY TESTING SERVICES IN ORDER THAT THE MOLINA AREA STREET IMPROVEMENTS MAY BE COMMENCED AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE �DAY OF DECEMBER, 1970. It is agreeable with our firm for payment to be at 10% of the total per month, beginning after January 30, 1971. We concur that the need for these tests should be during a ten -month period beginning February 1, 1971. Should the scope of work be substantially increased, we will negotiate with the City at prices equal to those reflected in this proposal. 4. We will maintain a file at our office for HUD. This file will:be accessible to the City personnel assigned to this project. At the completion of our work, this file will be delivered to the City Engineer's office.
