HomeMy WebLinkAbout10048 ORD - 12/23/1970BJH :IL/2j/7O TEXAS: AN ORDINANCE PROVIDING FOR THE INTERIM ENFORCEMENT OF CERTAIN CITY ORDINANCE RULES AND REGULATIONS GOVERNING THE EXPLORA- TION FOR, THE DRILLING, OPERATION, AND SHUTTING -IN (PLUGGING) OF OIL AND GAS WELLS, AND PIPELINE TRANSPORT OF THE PRODUCTS THEREOF, IN THE AREAS OF LAGUNA MADRE AND CORPUS CHRISTI BAY ANNEXED BY THE CITY IN ORDINANCE NO. 10,007, NOVEMBER 18, 1970; PRESCRIBING FOR SUCH INTERIM ENFORCEMENT APPLICATION OF CERTAIN PROVISIONS OF THE "BAY DRILLING ORDINANCE ", BEING ORDINANCE NO. 8294, AS AMENDED, SUCH PROVISIONS CONSISTING OF THE AMENDING OF PERMITS, ORDINANCE 81482; PERMITS, ORDINANCE 0421; BAY DRILLING COMMITTEE MEMBERSH-1 _P7_UR_M NANCE 8B79; HARDWARE, ORDINANCE 9007; SURFACE PIPE, ORDINANCE 93143; SEISMIC PERMITS, ORDINANCE 9965; AND, IN ORDINANCE NO. 6294, AS AMENDED, ONLY SUBSECTIONS 3.1 -3.13, 3.16, 3.22, 3.23, DEFINITIONS, SECTION 4 -BAY DRILLING COMMITTEE, SECTION 5, DIVISION OF PETROLEUM INSPECTION OF THE DEPARTMENT OF PUBLIC WORKS, SUBSECTIONS 7.14 AND 7.5, LOCATION OF WELLS AND SURFACE STRUCTURES IN LAGUNA.MADRE AND CORPUS CHRISTI BAY PARK AND RECREATION AREA, SECTION 11, REGULATION OF PIPELINES, SECTION 13, PROHIBITION OF POLLUTION, SECTION 15, PROHIBITION OF SIGNS AND ADVER- TISING, SECTION 16, RIGHT OF ACCESS, SECTION 17, INSURANCE, SECTION 18, BONDS, SECTION 19, TECHNICAL REGULATIONS, SUBSECTIONS 20.1 - 20.3 (3), PERMITS, SECTION 21, ACTION UPON APPLICATION FOR PERMIT, EXCEPT SUBSECTION 21.9, SECTION 22, EFFECT OF ACCEPTANCE OF PERMIT, SECTION 23, INSPECTION, SECTION 24, RELINQUISHMENT OF PERMIT, SECTION 25, REQUIRED SIGN, SECTION 26, ANNUAL REPORT OF PERMIT (FIRST PERMIT TO BE SUBMITTED WITHIN THIRTY (30) DAYS AFTER EFFECTIVE DATE HEREOF) SECTION 27, EMERGENCY OPERA- TIONS BY LESSEE WITHOUT FIRST OBTAINING A PERMIT, SECTION 28, VIOLATION AND PENALTIES AND OTHER REMEDIES; PROVIDING ONE PUBLICATION OF THE CAPTION HEREOF; REPEALING ORDINANCES IN CONFLICT; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. FOR THE PURPOSE OF PROVIDING FOR THE INTERIM ENFORCE- MENT OF CERTAIN CITY ORDINANCE RULES AND REGULATIONS GOVERNING THE EXPLORA- TION FOR, THE DRILLING, OPERATION, AND SHUTTING -IN (PLUGGING) OF OIL AND GAS WELLS, AND PIPELINE TRANSPORT OF THE PRODUCTS THEREOF, IN THE AREAS OF LAGUNA MADRE AND CORPUS CHRISTI BAY ANNEXED TO THE CITY BY THE CITYIS ORDINANCE NO. 10,007, NOVEMBER 18, 1970, PENDING MORE DETAILED STUDY AND RECOMMENDATIONS BY THE BAY DRILLING COMMITTEE, IT IS HEREBY PRESCRIBED THAT THE FOLLOWING ENUMERATED CERTAIN PROVISIONS OF THE "BAY DRILLING ORDINANCE", BEING ORDINANCE N0. 82914, AS AMENDED., AND PRIOR ORDINANCES AS HEREIN DESIG- NATED, SHALL BE IMPLEMENTED AND ENFORCED IN THE SAID AREAS ANNEXED BY ORDINANCE N0. 10,007, NOVEMBER 18, 1970, DURING THE INTERIM PERIOD OF THE 00418 COMMITTEES STUDY AND RECOMMENDATIONS AND UNTIL FINAL PASSAGE OF AN AMEND- ING OR SUPERSEDING ORDINANCES IF ANY AS TO SUCH AREAS: AMENDING OF PERMITS ORDINANCE 8482; PERMITS, ORDINANCE 8421; BAY DRILLING COMMITTEE MEMBERSHIP, ORDINANCE 8879; HARDWARES ORDINANCE 9007; SURFACE PIPES ORDINANCE 9343; SEISMIC PERMITS1 ORDINANCE 9965; AND IN ORDINANCE No. 8294, AS AMENDED, ONLY SUBSECTIONS 3.1 -3.13, 3.16, 3.22, 3.23, DEFINITIONS, SECTION 4 -BAY DRILLING COMMITTEE] SECTION 5, DIVISION OF PETROLEUM INSPECTION OF THE DEPARTMENT OF PUBLIC WORKS, SUBSECTIONS 7.4 AND 7.5, LOCATION OF WELLS AND SURFACE STRUCTURES IN LAGUNA MADRE AND CORPUS CHRISTI BAY PARK AND RECREATION AREA SECTION 11, REGULATION OF PIPELINES SECTION 13, PROHIBITION OF POLLUTION, SECTION 15, PROHIBITION OF SIGNS AND ADVERTISING SECTION 16, RIGHT OF ACCESS SECTION 17, INSURANCES SECTION 18, BONDS SECTION 19, TECHNICAL REGULATIONS SUBSECTIONS 20.1 - 20.3 (3), PERMITS, SECTION 21, ACTION UPON APPLICATION FOR PERMITS EXCEPT SUBSECTION 21.9, SECTION 22, EFFECT OF ACCEPTANCE OF PERMITS SECTION 23, INSPECTIONS SECTION 24, RELINQUISHMENT OF PERMIT, SECTION 25, REQUIRED SIGNS SECTION 26, ANNUAL REPORT OF PERMIT (FIRST PERMIT TO BE SUBMITTED WITHIN THIRTY (30) DAYS AFTER EFFECTIVE DATE HEREOF) SECTION 27, EMERGENCY OPERATIONS BY LESSEE WITHOUT FIRST OBTAINING A PERMITS SECTION 28, VIOLATION AND PENALTIES AND OTHER REMEDIES. SECTION 2. THE CAPTION OF THIS ORDINANCE SHALL BE PUBLISHED ONCE FOR PURPOSES OF NOTICES IN THE CITY'S OFFICIAL NEWSPAPER. SECTION 3. ALL ORDINANCES OR PORTIONS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT OF SUCH CONFLICT ONLY; ALL RIGHTS, PRIVILEGES, RECEIVABLES, TITLES ROYALTIES,. INCOME, OPTIONS, CHOSES IN ACTION AND ALL OTHER BENEFITS OR THINGS OF VALUE WHATEVER ACCRUED TO OR SUBSISTING TO THE CREDIT OF THE CITY OF CORPUS CHRISTI BY VIRTUE OF ANY AND ALL OTHER ORDINANCES AND CONTRACTS EVIDENCES OF DEBTS AND OTHER UNDERTAKINGS DERIVED THEREFROM ARE HEREBY EXPRESSLY PRESERVED AND SAVED FOR THE CITY. SECTION 4. IF FOR ANY REASON ANY SECTIONS PARAGRAPHS SUBDIVISION CLAUSES PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. -2- SECTION 5. THE URGENCY IN THE PUBLIC INTEREST, AS WELL AS FOR THE INDUSTRY, TO PROVIDE FOR INTERIM REGULATION OF OIL AND GAS ACTIVITIES IN THE NEWLY ANNEXED AREAS OF THE LAGUNA MADRE AND CORPUS CHRISTI BAY CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLTUION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND"PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF DECEMBER, 1970.
