HomeMy WebLinkAbout10054 ORD - 12/30/1970JRR:JKH:12 -30:70 AN ORDINANCE AUTHORIZING AND ESTABLISHING A COMPLIMENTARY PASS SYSTEM IN THE CITY TRANSIT DIVISION; PROVIDING A REPEALING CLAUSE; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL THAT THE CITY TRANSIT SYSTEM NEEDS ADDITIONAL ADVERTISING AND PROMOTIONAL ACTIVITY TO ASSURE THE INHABITANTS OF THE CITY ROUTES, SCHEDULES, FARES, AND SERVICES WHICH ARE WELL -KNOWN AND MORE WIDELY USED; AND WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL THAT INDIVIDUALS AND FAMILIES MOVING INTO CORPUS CHRISTI TO ESTABLISH INHABITANCY AND TO ESTABLISH RESIDENCE HERE ARE ALMOST ENTIRELY UNFAMILIAR WITH SAID TRANSIT SYSTEM, ITS ROUTES, SCHEDULES, FARES, AND SERVICES; AND WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL THAT SUCH UNFAMILIARITY 15 A PUBLIC PROBLEM, THE AMELIORATION OF WHICH BY THE HEREINAFTER ESTABLISHED COMPLIMENTARY PASS.SYSTEM, SHALL SERVE THE PUBLIC INTEREST, ADVANCE THE PUBLIC ADVANTAGE, AND PROMOTE THE PUBLIC WELFARE: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO ESTABLISH OR CAUSE TO BE ESTABLISHED IN THE CITY TRANSIT DIVISION A SYSTEM AND PROCEDURE WHEREBY ALL NEWLY - ARRIVED INHABITANTS AND/OR NEWLY - ESTABLISHED RESIDENTS OF THE CITY, SO FAR AS PRACTICABLE TO REACH SUCH PERSONS, REGARDLESS OF RACE, SEX, AGE, CREED, GEOGRAPHIC LOCATION IN THE CITY, OR STATUS OR MODE OF TENANCY OR DWELLING, SHALL BE APPRISED BY ,PRINTED MATTER OF-THE TRANSIT SYSTEM, ITS ROUTES, SCHEDULES, FARES, AND SERVICES AND TO INCLUDE, IN SUCH PRINTED MATTER, A DETACHABLE COUPON, WHICH SHALL ENTITLE THE MOLDER THEREOF TO ONE (1) COMPLIMENTARY, NO- CHARGE RIDE ON ANY ONE (1) ROUTE AND SCHEDULE THEREON OF THE TRANSIT SYSTEM, IF PRESENTED TO THE TRANSIT SYSTEM BUS DRIVER ON SUCH ROUTE AND SCHEDULE WITHIN NOT MORE THAN THIRTY (30) DAYS AFTER YHE DATE OF ISSUE, TO BE SHOWN ON THE FACE OF SAID COUPON. WHOLE DAYS ONLY SHALL BE CONSIDERED IN THE COMPUTATION OF THE COMPLIMENTARY PASS - PERIOD. SECTION 2. THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO PROMULGATE RULES AND PROCEDURES TO FACILITATE THE ISSUANCE OF SUCH _005 $ COUPONS, AND THE ADJUSTMENT OF ISSUE DATES AND EXPIRY DATES, INCLUDING GUIDELINES FOR TIME EXTENSION, TO EFFECTUATE THE PURPOSE OF THIS ORDINANCE. SECTION 3. THE CITY MANAGER SHALL-DETERMINE THE MANNER OF LOCATING THE PERSONS TO BE SERVED HEREUNDER IN THE MOST UNIFORM, NON- DISCRIMINATORY MANNER, AND MAY FURTHER LIMIT THE NUMBER OF PERSONS WHO MAY RIDE, AS AFORESAID, ON ANY ONE (1) COUPON ISSUED HEREUNDER. SECTION 4. ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH SHALL BE AND ARE HEREBY REPEALED TO THE EXTENT OF CONFLICT HEREWITH. SECTION 5. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 6. THE NECESSITY TO ESTABLISH A COMPLIMENTARY PASS SYSTEM IN THE CITY TRANSIT DIVISION, AS MORE FULLY SET FORTH HEREINABOVE, IN ORDER TO FAMILIARIZE NEWCOMERS TO THE CITY WITH THE TRANSIT SYSTEM, ITS ROUTES, SCHEDULES, FARES, AND SERVICES, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS SSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE® DAY of ® .
