AN ORDINANCE
APPROPRIATING OUT OF NO. 295 STORM SEWER BOND FUND
THE SUM OF $1465, OF WHICH $375 IS FOR ACQUISITION
OF THE HEREINAFTER DESCRIBED TRACT OR PARCEL OF LAND,
PARCEL NO. 15, AND $90 IS FOR INCIDENTAL EXPENSES
RELATED TO TITLE CLOSING COST, APPLICABLE TO PROJECT
NO. 295- 67 -46, CLARKWOOD DITCH; AUTHORIZING AND
DIRECTING THE CITY MANAGER TO EXECUTE REAL ESTATE
SALES CONTRACT WITH THE OWNERS, BOBBIE HAZEL McLEROY
AND HUSBAND, G. H. McLEROY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF NO. 295 STORM

SEWER BOND FUND THE SUM OF $465, OF WHICH AMOUNT $375 IS FOR ACQUISITION
OF LAND AND $90 IS FOR INCIDENTAL EXPENSES RELATED TO TITLE CLOSING COSTS,
ALL IN CONNECTION WITH PROJECT NO. 295- 67 -46, CLARKWOOD DITCH, SAID PARCEL
BEING MORE FULLY DESCRIBED AS FOLLOWS:
Beginning at the southeast corner of Clarkwood "Townsite as shown by map of record
in Volume 4, Page 21, Nueces County, Texas, Map Records; Thence South, with the
west center line of an existing 40 foot wide drainage ditch right -of -way and also
being the East line of the G. H. McLeroy tract as recorded in Vol. 189, Page 226
Deed records of Nueces County, a distance of 565.85 feet to a point in the south
of-way line of the proposed State Highway No. 44 Cut -off for the northeast and
beginning corner of the tract herein described;
Thence continuing South, with the center line of said existing drainage ditch, a
distance of 751.97 to a point in the Southeast corner of the McLeroy tract and for
the Southeast corner of this tract;
Thence East, with the south boundary line of said McLeroy tract, a distance of
35.0 feet to a point for the southwest corner of this tract;
Thence North, a distance of 752.16 feet to a point in the south right -of -way line
of said proposed Highway No. 44 Cut -off for the northwest corner of this tract
Thence N. 890 41, 000 W, with the south right -of -way line of said proposed Highway
No. 44 Cut -off, a distance of 35.0 feet to the point of beginning.
Containing 0.604 acres of land more or less.
The above described tract includes that portion of the West half of the 40 foot
wide drainage easement, within this tract, conveyed to the State of Texas by deed
recorded in Vol. 212 Page 354 of the Deed Records of Nueces County, Texas and
containing 0.345 acres.
SECTION 2. THAT THE CITY MANAGER EE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE REAL ESTATE SALES CONTRACT AND SUCH OTHER INSTRU-
MENTS AS MAY BE NECESSARY TO ACQUIRE, FOR AND ON BEHALF OF THE CITY OF
CORPUS CHRISTI, THE AFORESAID PARCEL F13011 THE OWNERS,, BOBBIE HAZEL
McLEROY AND HUSBAND, G. H. McLEROY.

SECTION 3. THE NECESSITY TO APPROPRIATE THE SUM HERE INA BOVE
DESCRIBED AND TO ACQUIRE THE PARCEL AFORESAID FOR THE CLARKWOOD DITCH,
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING
THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND
HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDI-
NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT
AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS
ACCORDINGLY SO ORDAINED, THIS THE 30 OF DECEMBER, 1970•

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
