AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREE-
MENT WITH THE TEXAS HIGHWAY DEPARTMENT FOR REIMBURSE-
MENT FOR DAMAGES TO TRAFFIC CONTROLS AND SIGNS ON THE
PRIMARY AND SECONDARY HIGHWAY SYSTEMS IN THE CITYy AS
MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH
IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLAR-
ING AN EMERGENCY.
WHEREAS, ON AUGUST 3, 1970, HURRICANE CELIA CAUSED SEVERE
DAMAGE TO TRAFFIC SIGNAL INSTALLATIONS AND SIGNS IN THE CITY OF CORPUS
CHRISTI, ON FEDERAL -AID PRIMARY TYPE 1, PRIMARY TYPE II AND SECONDARY
HIGHWAY SYSTEMS; AND
WHEREAS, THE CITY OF CORPUS CHRISTI UNDER THE CONDITIONS OF
THE MUNICIPAL MAINTENANCE AGREEMENT BETWEEN THE STATE AND THE CITY OF
CORPUS CHRISTI, DATED DECEMBER 302 19682 MAINTAINS THE SIGNING AND
UNDER CONDITIONS OF THE VARIOUS AGREEMENTS BETWEEN THE STATE AND THE CITY
OF CORPUS CHRISTI FOR INSTALLATION, CONSTRUCTION AND MAINTENANCE OF
TRAFFIC SIGNALS, MAINTAIN THE TRAFFIC SIGNALS; AND
WHEREAS, THESE SIGNS AND TRAFFIC SIGNALS ON THE FEDERAL -AID
SYSTEMS IN THE CITY LIMITS ARE NOT ELIGIBLE FOR PUBLIC LAW 875 FUNDS,
BUT ARE ELIGIBLE FOR EMERGENCY FUNDS UNDER THE FEDERAL HIGHWAY ACT:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY,
AUTHORIZED AND DIRECTED TO ENTER INTO AN AGREEMENT WITH THE TEXAS
HIGHWAY DEPARTMENT FOR REIMBURSEMENT FOR DAMAGES TO TRAFFIC CONTROLS AND
SIGNS ON THE PRIMARY AND SECONDARY HIGHWAY SYSTEMS IN THE CITY, AS MORE
FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF.
SECTION 2. THE NECESSITY TO ENTER INTO THE AFORESAID AGREEMENT
AT THE EARLIEST PRACTICABLE DATE IN ORDER TO RECEIVE REIMBURSEMENT FOR
DAMAGES TO TRAFFIC CONTROLS AND SIGNS AS HEREINABOVE SET FORTH CREATES
A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,

AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST,
AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT
IS ACCORDINGLY SO ORDAINED, THIS THE 30 DAY of DECEMBER, 1970-

WHEREAS, on August 3, 1970, Hurricane Celia caused severe damage to
traffic signal installations and signs in the City of Corpus Christi,
on Federal -Aid primary Type 1, Primary Type II and Secondary Highway
Systems; and
WHEREAS, the City of Corpus Christi under the conditions of the
Municipal Maintenance Agreement between the State and the City of
Corpus Christi dated December 30, 1968, maintains the signing and
under conditions of the various agreements between the State and the
City of Corpus Christi for installation, construction and maintenance
of traffic signals, maintain the traffic signals; and
WHEREAS, these signs and traffic signals on the Federal -Aid Systems
in the City limits are not eligible for Public Law 875 funds, but are
eligible for emergency funds under the Federal Highway Act.
NOW, THEREFORE, the State agrees to apply for Federal emergency funds
through the Federal Highway Administration for the cost of temporary
repair and emergency work to the signing and traffic signals on the
Federal Highway Systems in the City of Corpus Christi; and
FURTHER, that the State agrees to reimburse the City of Corpus Christi
for these repairs when properly billed in two payments, a partial
payment for work completed when Federal funds are first made available
and a final payment when all work is completed, in amounts not to
exceed that paid by the Federal Highway Administration; and
FURTHER, that the City of Corpus Christi agrees to perform this repair
work and to assume the balance of the repair coat not participated in
by the Federal Highway Administration; and
FURTHER, that this agreement does not alter previous or future agreement
pertaining to the construction, maintenance and operation of traffic
signals or signing in the City of Corpus Christi.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
