HomeMy WebLinkAbout10083 ORD - 01/20/1971AN ORDINANCE AMENDING CHAPTER 38 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING ARTICLE IV, UTILITY TAPS OR CONNECTIONS, BY AMENDING SUBSECTION 5A AND 5B OF SECTION 38 -26, ITEM (1), SO AS TO PROVIDE FOR STREET AND EASEMENT FEES, FOR INSTALLATION OF GAS LINES, BOTH INSIDE AND OUTSIDE THE CITY LIMITS, AS MORE FULLY SET FORTH HEREINAFTER; ADDING TO CHAPTER 38 OF THE SAID CITY CODE A NEW ARTICLE, TO BE DESIGNATED ARTICLE XII, GAS EXTENSIONS, AUTHORIZING THE DIRECTOR OF PUBLIC UTILITIES TO APPROVE GAS EXTENSIONS ON PRIVATE PROPERTY FOR THE PURPOSE OF BRINGING GAS INTO PREVIOUSLY ALL - ELECTRIC HOMES; PROVIDING A SEVERANCE CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT CHAPTER 38 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY AMENDING ARTICLE IV, UTILITY TAPS OR CONNECTIONS, SUBSECTION 5A AND 5B OF SECTION 36 -26, AS FOLLOWS: "SECTION 38 -26. 5. THERE IS HEREBY ADDED TO CHAPTER 38 OF THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, A NEW ARTICLE, TO BE DESIGNATED ARTICLE XII, GAS EXTENSIONS, AND BY ADDING A NEW SECTION THERETO, DESIGNATED AS SECTION 38 -89, READING AS FOLLOWS: "ARTICLE XII. GAS EXTENSIONS. SECTION 38 -89. THE DIRECTOR OF PUBLIC UTILITIES SHALL HAVE THE AUTHORITY TO APPROVE GAS EXTENSIONS ON PRIVATE PROPERTY FOR THE PURPOSE OF BRINGING GAS INTO PREVIOUSLY ALL - ELECTRIC HOMES." 10083 SECTION 3. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVI- SION, CLAUSE, PHRASE, OP, PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION, IT SHALL NOT AFFECT ANY VALID PROVISIONS OF THIS OR ANY OTHER ORDINANCE OF THE CITY OF CORPUS CHRISTI TO WHICH THESE RULES AND REGULATIONS RELATE. SECTION 4. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLICATION OF THE CITY OF CORPUS CHRISTI, BY PUBLISHING THE CAPTION OF THIS ORDINANCE, STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 5. THE NECESSITY TO REVISE THE SCHEDULE OF GAS RATES AS HEREINABOVE OUTLINED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE, AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRO- DUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT -FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE O•_ DAY OF JANUARY, 1971.
