HomeMy WebLinkAbout10089 ORD - 01/27/19711/27/71:E " r j AN ORDINANCE ' DETERMINING FINDINGS BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS, THE GOVERNING BODY OF THE LOCALITY, TO -WIT, CORPUS CHRISTI, TEXAS, A MUNICIPAL CORPORATION AND BODY POLITIC OF THE STATE OF TEXAS, RELATIVE TO A COMMUNITY RENEWAL PROGRAM FOR THE CITY, BY APPLICATION, A TRUE COPY OF WHICH, MARKED EXHIBIT "A ", IS ANNEXED HERETO AND BY THIS REFERENCE INCORPORATED HEREIN FOR ALL PURPOSES, FOR CONTRACT AND GRANT THEREFOR WITH THE UNITED STATES OF AMERICA, THROUGH THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, RENEWAL ASSISTANCE ADMINISTRATION, UNDER THE PROVISIONS OF SECTION 103(D) OF THE HOUSING ACT OF 1949, AS AMENDED, AND RULES AND REGULATIONS THEREUNDER; AUTHORIZING AND DIRECTING THE CITY MANAGER TO SIGN, EXECUTE, AND TRANS- MIT SAID APPLICATION FOR AND IN BEHALF OF THE CITY; AND + DECLARING AN EMERGENCY. WHEREAS, IT IS THE FINDING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT THERE IS A SUBSTANTIAL SHORTAGE OF HABITABLE HOUSING, AT ALL SOCIAL AND ECONOMIC LEVELS, WITHIN THE CITY; AND WHEREAS, IT IS THE FINDING OF THE SAID CITY COUNCIL THAT THERE ARE NUMEROUS BLIGHTED AND DETERIORATED BUILDINGS, NEIGHBORHOODS AND AREAS WITHIN THE CITY; AND WHEREAS, IT IS THE FINDING OF THE SAID CITY COUNCIL, THROUGH ITS CODE ENFORCEMENT PROGRAM, AND PURELY LOCAL DILIGENT EFFORTS, THAT ALTHOUGH SOME PROGRESS HAS BEEN MADE IN AMELIORATING THE SAID HOUSING SHORTAGE AND DILAPIDATION, CRITICAL HOUSING AND PUBLIC SERVICE PROBLEMS SUBSIST WITHIN THE CITY, GREATLY AGGRAVATED BY THE DAMAGE WROUGHT IN HURRICANE CELIA, AND ITS CONSEQUENCES, IN 1970; AND WHEREAS, IT 15 THE FINDING OF THE SAID CITY COUNCIL THAT THERE IS NO URBAN RENEWAL PROGRAM OPERATIVE OR AUTHORIZED IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, IT IS THE FINDING OF THE SAID CITY COUNCIL THAT THE COMMUNITY RENEWAL PROGRAM OFFERED TO CITIES UNDER SECTION 103(D) OF THE HOUSING ACT OF 1949, AS AMENDED, THE RULES AND REGULATIONS THEREUNDER, AND BY CONTRACT AND GRANT MADE PURSUANT THERETO, SHALL AFFORD VERY SIGNIFICANT IMPROVEMENT IN THE CITY'S HOUSING AND RELATED PROBLEMS, AND WOULD SUBSTANTIALLY SERVE THE PUBLIC INTEREST AND ADVANCE THE PUBLIC SAFETY, HEALTH, AND WELFARE; AND 10089 ( ` WHEREAS, IT IS THE FINDING OF THE SAID CITY COUNCIL THAT THE GENERALIZED APPLICATION, INCLUDING THE HUD -6400 (5 -69) APPLICATION FOR COMMUNITY RENEWAL PROGRAM GRANT, AND ALL PAGES, PAPERS, AND CHARTS ATTACHED THERETO, TRANSMITTED TO THE CITY MANAGER BY EARL GOETSCH, CITY PLANNING DEPARTMENT, BY MEMO OF JANUARY 20, 1971, HERETOFORE CAPTIONED AS EXHIBIT "A", A TRUE COPY OF WHICH IS ANNEXED HERETO, BY THIS REFERENCE INCORPORATED HEREIN FOR ALL PURPOSES, AND MADE A PART HEREOF, AS THOUGH FULLY SET FORTH IN THIS ORDINANCE, AND AMENDMENTS AND ADDITIONS THERETO, CONSTITUTE A VALID, PROPER, APPROPRIATE APPLICATION FOR THE PURPOSES HEREOF, AND IS IN GOOD ORDER; AND WHEREAS, IT 15 THE FINDING OF THE SAID CITY COUNCIL THAT SAID APPLICATION, UPON APPROVAL AND IMPLEMENTATION, WOULD AFFORD VERY SIGNIFI- CANT IMPROVEMENT IN THE CITY'S HOUSING AND RELATED PROBLEMS, AND WOULD SUBSTANTIALLY SERVE THE PUBLIC INTEREST AND ADVANCE THE PUBLIC SAFETY, HEALTH, AND WELFARE; AND WHEREAS, IT IS THE FINDING OF THE SAID CITY COUNCIL THAT THE CITY MANAGER SHOULD BE IMMEDIATELY AUTHORIZED AND DIRECTED TO SIGN, EXECUTE AND TRANSMIT SAID APPLICATION TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR ITS ACTION AND APPROVAL: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI, TEXAS, IS HEREBY AUTHORIZED AND DIRECTED TO SIGN, EXECUTE AND TRANSMIT TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR AND IN BEHALF OF THE CITY, THE GENERALIZED APPLICATION, INCLUDING THE HUD -6400 (5 -69) APPLICATION FOR COMMUNITY RENEWAL PROGRAM GRANT, AND ALL PAGES, PAPERS, AND CHARTS 1 ATTACHED THERETO, TRANSMITTED TO THE CITY MANAGER BY EARL GOETSCH, CITY PLANNING DEPARTMENT, BY MEMORANDUM OF JANUARY 20, 1971, HERETOFORE CAP- TIONED AS EXHIBIT "A", A TRUE COPY OF WHICH IS ANNEXED HERETO, BY THIS REFERENCE INCORPORATED HEREIN FOR ALL PURPOSES AND MADE A PART HEREOF, AS THOUGH FULLY SET FORTH IN THIS ORDINANCE, AND AMENDMENTS AND ADDITIONS PURSUANT THERETO, IF ANY, AND ANY AND ALL OTHER DOCUMENTS REQUIRED IN SUPPORT OF SAID APPLICATION, UNDER THE PROVISIONS OF SECTION 103(D) OF THE HOUSING ACT OF 1949, AS AMENDED, AND RULES AND REGULATIONS THEREUNDER. -2- � J SECTION Z. THE NECESSITY TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE AFORESAID APPLICATION IN ORDER TO COMMENCE THIS PROGRAM AT THE EARLIEST POSSIBLE DATE, CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE � %!L DAY OF JANUARY, 1971• ATTES CITY SECR T M OR THE CITY OF CORPUS CHRISTI, TEXAS APPROV D: 7� X71 C Y ATTORNEY• Corpus Christi, Texas 7tet�aay of 19,7/ TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
