I ©i OIDETERMINED THAT IT WAS NECES- SARY TO IMPROVE THE FOLLOWING BY PAVING: MCBRIDE LANE, FROM LEOPARD STREET TO AGNES STREET; AND WHEREAS,' BY THE TERMS OF SAID ORDINANCE, SPECIFICATIONS WERE ORDERED TO BE MADE BY THE DIRECTOR OF PUBLIC WORKS, FOR THE IMPROVEMENT I OF THE AFORESAID STREET, WITHIN THE LIMITS DEFINED, AS PROVIDED BY SAID c. ORDINANCE; AND WHEREAS; THE SAID SPECIFICATIONS HAVE BEEN PREPARED AND ARE NOW SUBMITTED TO THE CITY COUNCIL FOR APPROVAL AND ADOPTION; AND _ WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI IS OF THE OPINION THAT IT IS NECESSARY TO LEVY AN ASSESSMENT AGAINST THE PROPERTY y AND THE OWNERS THEREOF ABUTTING UPON THE AFORESAID STREET, WITHIN THE LIMITS DEFINED, AND AGAINST STREET AND RAILWAY COMPANIES WHOSE TRACKS OCCUPY SAID STREET, IF ANY, FOR A PART OF-THE COST OF IMPROVING SAID STREET, FIXING A TIME FOR THE HEARING OF THE OWNERS OF SAID PROPERTY, AND THE SAID RAILWAY COMPANIES, CONCERNING THE SAME, AND DIRECTING THE CITY • SECRETARY TO GIVE NOTICE OF SAID HEARING, AS REQUIRED BY LAW; AND WHEREAS, THE CITY COUNCIL HAS HERETOFORE, BY ORDINANCE, ORDERED THE IMPROVEMENTS OF THE STREET AND PORTIONS ENUMERATED ABOVE. This project is to be constructed by excavating the existing street to a width and depth to permit the construction of standard 6" curb and gutter section and the installation of pavement measuring 41' from the back of the curbs. The pavement section on this project will consist of 5" lime stabilized subgrade, the installation of 10" caliche base, the installation of 32" of Type "B" asphaltic concrete. In addition to the paving section the project will include the construc- tion of reinforced concrete driveways where needed and requested by property owners and also the storm sewer extensions from Highway 9 to Highway 44 including all I appurtenances required for the proper drainage of the street. Both the storm sewer portion and the paving portion are bond projects. In addition to the improvements of McBride, a small storm sewer extension of Westchester Drive is included in this contract. The assessment rate has been determined by using the unit prices received from the low bid submitted by.Asphalt Paving Company and applying those unit prices to the policy on assessments of the City of Corpus.Christi. SECTION 7. THAT THE NEED FOR THE ADOPTION OF THE PLANS AND PROCEEDING WITH THE IMPROVEMENTS AS HEREIN PROVIDED, AND THE IMPORTANCE OF PROMPTLY EXAMINING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS AND MAKING A DECISION THEREON, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY A14D NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORD11IGLY SO ORDAINED, THIS THE % / Vb DAY OF FEBRUARY, 1971.
