H. 358 BETWEEN S. H. 286 AND I. H. 37; APPROPRIATING OUT OF THE NO. 250 SANITARY SEWER BOND FUND THE AMOUNT OF $22,000, OF WHICH AMOUNT $19,190.84 IS FOR THE CONSTRUCTION CON- TRACT AND $2,809.16 IS FOR ENGINEERING AND CONTINGENCIES, APPLICABLE TO PROJECT NO. 250- 70 -87; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A CONTRACT WITH THE ARNOLD UTILITY COMPANY FOR THE CONSTRUCTION OF SANITARY SEWER ADJUSTMENTS, PROJECT N0. 250- 70 -87, SAID CONSTRUCTION WORK TO CON- SIST OF INSTALLING AN 8" SANITARY SEWER LINE ACROSS S. H. 358 SOUTH OF LEOPARD STREET THEN PARALLEL WITH THE WEST PROPERTY LINE OF S. H. 358 TO HALL STREET. ALSO, THE INSTALLATION OF AN 84 SANITARY SEWER LINE ALONG THE NORTH SIDE OF LEOPARD FROM S. H. 358 TO A POINT 500' WEST AND THE RE- PLACEMENT OF 300' OF 8" VCP WITH CAST IRON PIPE ACROSS S. H. 358 AT HAMPSHIRE STREET, ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CON- TRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF ARNOLD UTILITY COMPANY, OPENED ON FEBRUARY 3, 1971, THE SAID BID OF ARNOLD UTILITY COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $22,000 OUT OF N0. 250 SANITARY SEWER BOND FUND, OF WHICH AMOUNT $19,190.84 13 FOR THE CONSTRUCTION CONTRACT AND $2,809.16 IS FOR ENGINEERING AND CONTINGENCIES, ALL APPLICABLE TO PROJECT NO. 250- 70 -87. SECTION 3. THE NECESSITY TO PROVIDE FOR THE RELOCATION OF SANITARY SEWER LINES PRIOR TO THE CONSTRUCTION OF AN OVERPASS OF S. H. 358 AT LEOPARD STREET AND PURSUANT TO AGREEMENT PREVIOUSLY MADE WITH THE STATE HIGHWAY DEPARTMENT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH 10113 ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE / /` -- DAY 1971. Director of Finance FIN 2 -55 Revised 7/31/69 19 Corpus Christi, Texas %l V day of 19?/ TO THE I-IFIMBERS OF TILE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the-Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
