AUTHORIZING THE'CITY MANAGER TO EXECUTE, FOR,AND ON
BEHALF OF THE CITY, A CONTRACT WITH EACH AMBULANCE
SERVICE OPERATOR DESIRING TO ENTER INTO EMERGENCY
SERVICE AMBULANCE OPERATION WITH THE CITY, SAID CON-
TRACT TO BE,SUBSTANTIALLY IN THE FORM ATTACHED HERETO
AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS :
SECTION 1. That the City Manager be, and he is hereby, authorized
and directed to execute, for and on behalf of the City, an contract with each
ambulance service operator desiring to enter into emergency service ambulance
operation with the City, said contract to be substantially in the form
attached hereto and made a part hereof.
SECTION 2. The necessity for the City to provide adequate
emergency ambulance service for the citizens of the City of Corpus Christi
without delay creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolu-
tion shall be passed finally on the date of its introduction and that such
ordinance or resolution shall be read at three several meetings of the City
Council, and the Mayor having declared such emergency and necessity to exist,
having requested the suspension of said Charter rule and that this ordinance
be passed finally on the date of its introduction and that such ordinance take
effect and be in full force and effect from and after it passage, IT IS
ACCORDINGLY SO ORDAINED, this the,l Z day 1971.

CONTRACT
11is is a contract betuecu the City of Corpus Cht isti, hereinafter
called City, and Professional Ambulance Service , hereinafter
called Operator.
k'licreas Operator is now performing a vital service in providing
ambulance service; and•
F;hereas it is now the policy of the City to offer financial assistance
to operators who stand ready to provide the public with ambulance service 24
hours a day, seven days a week; therefore
Be it knoon that the City and Operator have agreed to a contract with
the following provisions:
(1) City agrees to pay'Operator $5.00 for each call for ambulance
service which is assigned through the Police Dispatcher.
(2) Mien the Police Dispatcher receives information which, in his
judgment, indicates that ambulance service is needed, said
Dispatcher shall call the Operator on the rotafion list, as
provided for by the Ambulance Ordinance of this City, and
shall dispatch said ambulance to the location where said ser-
vice is needed. When the Dispatcher gives the Operator an
assignment he will, at the same time, give the Operator a
call number, The Dispatcher shall assign a different ambulance'
call number for each ambulance he dispatches on an ambulance
run.
,(3) Operator shall be entitled to be paid when he begins a run at
the request of the Police Dispatcher regardless of any service
which may or may not be rendered after the run has begun.
(4) The Operator shall stand ready to provide ambulance service
24 hours a day, seven days a week. When the Police Dispatcher
notifies an operator that ambulance service is needed, said
operator is required to respond to that call; provided, however,
when the Operator is temporarily unable to provide ambulance
service because of some physical or mechanical inability to do
so he shall immediately notify the police dispatcher that he
is unable to answer emergency calls and shall also notify the
police DispaLclirr when he'is again ablci to respond to culls; pro-
vided, further, that: if an operaLor is unable to respond to t
ambulance calls due to the attendance to any business or
profession of the ambulance operator, said operator shall
notify the Police Dispatcher as soon as he is aware of his
.inability to respond to calls and said Dispatcher shall re-
move said Operator from the rotation list- for that day. If
any Operator is unable to provide emergency ambulance service
as outlined above, it shall be the duty of the Police Dis-
patches to notify the next Operator "on call ". Persistent and
repeated failure to notify the Police Dispatcher of unavail-
ability or persistent and repeated unavailability when on
"first -call" shall be -deemed just cause for cancellation of
this contract.by the City.
(5) Operator shall maintain a separate record of calls assigned by
the Police Dispatcher; said record shall contain at least (a)
date the call is made, (b) location dispatched to, and (c) the
ambulance call number. Said record shall be open to inspection
by the City PLsnager or his designated representative, at all
times during regular business hours of the Operator.
(6) At the end of each month, Operator shall submit a statement to
the City Health Officer showing the number of runs made in the
previous month, the ambulance call number and date of each call.
Within 30 days the City shall make payment to the Operator in
accordance with Paragraph(1);provided, however, the 30 -day pay -
meb t does not apply to any call which is challenged by the City
as being outside the terms of this contract.
(7) An Operator who is "on call" in accordance with the police
rotation list shall not refer a call he receives for ambulance
service to the Police Dispatcher and then accept said call when
requested to do so by the Police Dispatcher.
(8) Operator and his employees shall comply with all state laws and
City ordinances relating to the operation of an ambulance.
(9) If Operator does have a two -way radio in any ambulance which is
on the frequency assigned to the Corpus Christi Police Depart: -

and adjustments at least twice a year.
(10) Within ten days after the effective date of this ordinance,
Operator shall provide the CiLy with a•complcte schedule of
rates charged for ambulance service and first aid in connection
with said service. if, during the term of this contract,
Operator amends his schedule of rates, said Operator shall pro-
vide the City with a written copy of such amendment within five
days after said amendment is put into effect. This contract
may be canceled if the Cily Council determines that any charge
for service is unreasonable in the light of- prevailing local
circumstances.
(11) The payment referred to in this contract shall not apply to a
request from the Police Dispatcher to an Operator for the pur-
pose of removing a dead body. When it becomes necessary
to remove a body and no member of the immediate family is
available or indicates what disposition should be made of
the body, the Dispatcher shall call the Operator "on call"
who has mortuary facilities.
(12) If the Operator does business under this contract with an ambu-
lance more than five years old, as determined by the-model year,
he shall be required to take said ambulance to the Corpus
Christi Police Station at least once every 60 days for an
inspection to insure that said ambulance is in proper condition
and meets all requirements of the State of Texas and the City of
Corpus Christi relating to ambulance equipment.
This contract shall become effective at midnight- June 30 , 71 , and
shall continue until terminaEed•by either party without cause giving the other
party notice in writing at least 60 days prior to the date of said cancellation.
Continuation of the contract beyond July 31st of each year shall also be subject
to the appropriation of sufficient money in the budget of the ensuing year to
meet- the potential obligations of this contract.
(13) It is expressly understood and agreed that Operator shall maintain
at all times public liability insurance as required by the City
ordinances and shall, in all events, save and hold harmless the
City from any.aid all liability, obligation, debt, charge or judg-
ment for injuries or property d;mtage caused by Operator on dispatches
madt: hereunder.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
