HomeMy WebLinkAbout10122 ORD - 02/24/1971BJW:2/24/71 AN ORDINANCE ABANDONING THE 5 -FOOT UTILITY EASEMENT BETWEEN BLOCK A AND LOT 1, ALONG THE SIDE OF BLOCK A, AND ALONG THE REAR OF LOTS 1 THROUGH 5, BLOCK 2, SOUTH AIRES SUBDI- VISION NO. 1, UPON DEDICATION AND DELIVERY TO THE CITY OF A SUBSTITUTE 10 -FOOT EASEMENT PERPENDICULAR TO AYERS STREET ALONG THE SOUTH SIDE OF THE PROPOSED LOT 11, BLOCK 2, SOUTH AIRES SUBDIVISION NO. 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, A CERTAIN 5- FOOT UTILITY EASEMENT EXISTS BETWEEN BLOCK IAA, AND LOT 12 ALONG THE SIDE OF BLOCK "A', AND ALONG THE REAR OF LOTS T THROUGH 5, BLOCK 2, SOUTH AIRES SUBDIVISION N0. 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND WHEREAS, THE OWNER OF THE PROPERTY HEREINABOVE MENTIONED HAS EXPRESSED A WILLINGNESS TO GRANT A SUBSTITUTE EASEMENT, BEING 10 FEET IN WIDTH, BEING PERPENDICULAR TO AYERS STREET ALONG THE SOUTH SIDE OF THE PRO- POSED LOT 11, BLOCK 2, SOUTH AIRES SUBDIVISION NO. 1, IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, THE CITY OF CORPUS CHRISTI IS AGREEABLE TO THE RELOCA- TION OF THE HEREINABOVE DESCRIBED UTILITY EASEMENT: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT, UPON THE OBTAINING OF DELIVERY TO AND APPROVAL OF THE PLANNING COMMISSION OF THE PLAT AND RECORDING OF THE PLAT IN THE COUNTY CLERKS OFFICE, SHOWING THEREON THE DEDICATION OF A 10 -FOOT UTILITY EASEMENT TO THE CITY OF CORPUS CHRISTI, AND BEING DESCRIBED AS BEING THAT 10 -FOOT STRIP OF LAND PERPENDICULAR TO AYERS STREET, ALONG THE SOUTH SIDE OF THE PROPOSED LOT 11, BLOCK 2, SOUTH AIRES SUBDIVISION NO. 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, THERE IS HEREBY ABANDONED, RELEASED AND RELINQUISHED BY THE CITY OF CORPUS CHRISTI ITS EASEMENT UNTO THE PRESENT OWNERS IN THE HEREINAFTER DESCRIBED 51 STRIP OF LAND, AS OF THE DATE OF THE FILING OF SAID APPROVED PLAT PROVIDING FOR SAID 10 -FOOT UTILITY EASEMENT. THE EXISTING UTILITY EASEMENT IS DESCRIBED AS A FIVE - FOOT UTILITY EASEMENT EXISTING BETWEEN BLOCK "AP AND LOT 1, ALONG THE SIDE OF BLOCK °A °, AND ALONG THE REAR OF LOTS 1 THROUGH 5, BLOCK 2, SOUTH AIRES SUBDIVISILON N0. 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS. 10122 • r r SECTION Z. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE EASEMENT HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECES- SITY EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY ACCORDINGLY SO ORDAINED, THIS THEc*27` 6 DAY OF FEBRUARY, 1971- ATTEST: CITY SECRE AR�, /� i MA OR c'/ THE CITY OF CORPUS CHRISTI, TEXAS A ROVED: AP OF FEBRUARY, 971: 7-j CI ATTORNEY + 50, 50'50'x. /50.0, 50 e- T J I �' / Z• 3 Q S vi oaa 20 IiMI Xr. 6/ °.30'.30' S'41 Alo. a I& 16 7. ace Corpus Christi, Texas 'FYfilday of_t� <s cc.r/ /=-��/ , 19%% V TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
