AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
A REAL ESTATE SALES CONTRACT ON BEHALF OF THE CITY OF
CORPUS CHRISTI FOR THE ACQUISITION OF LAND AND IMPROVE-
MENTS DESCRIBED HEREIN BELOW, OWNED BY BURLEY F. FELLOWS
AND BARBARA FELLOWS; APPROPRIATING OUT OF NO. 202 WATER
SYSTEM BOND FUND THE SUM OF $4,387, OF WHICH $4,237 IS
FOR ACQUISITION AND $150 IS FOR INCIDENTAL EXPENSES
RELATED TO CLOSING COST APPLICABLE TO PROJECT NO.
202 -68 -29.1 GREENWAY 48" TRANSMISSION WATER MAIN LINE
FROM CALALLEN RIGHT -OF -WAY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
TO EXECUTE A REAL ESTATE SALES CONTRACT WITH THE OWNERS,BURLEY F. FELLOWS AND
BARBARA FELLOWS;z OF THE LAND AND IMPROVEMENTS DESCRIBED HEREINBELOW, APPLICABLE
TO PROJECT NO. 202 -68 -29.1 GREENWAY 48" TRANSMISSION WATER MAIN LINE FROM
CALALLEN RIGHT -OF -WAY, SAID LAND AND IMPROVEMENTS BEING DESCRIBED AS FOLLOWS:
BEING A 2.27 ACRE TRACT OF LAND OUT OF THAT CERTAIN 28.75
ACRE TRACT OF LAND CONVEYED TO BURLEY FELLOWS AND WIFE
BARBARA FELLOWS MARCH A, 1961 BY HENRY P. KNOLLE AND FILED
IN THE OFFICE OF THE COUNTY CLERK, NUECES COUNTY, TEXAS, IN
FILE No. 572161E sn"✓ 2.27 ACRE TRACT OF LAND BEING MORE PARTICU-
LARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
BEGINNING AT THE MOST NORTHERLY CORNER OF SAID 28.75 ACRE TRACT
OF LAND FOR THE MOST NORTHERLY AND BEGINNING CORNER OF THE
TRACT HEREIN DESCRIBED;
THENCE S. 54° 47' E., WITH THE NORTHEAST BOUNDARY OF SAID
28.75 ACRE TRACT, A DISTANCE OF 427.0 FEET TO A POINT IN THE
WEST RIGHT OF WAY LINE OF THE ST. LOUIS, BROWNSVILLE, AND
MEXICO RAILROAD COMPANY FOR THE MOST EASTERLY CORNER OF THE
TRACT HEREIN DESCRIBED;
THENCE IN A SOUTHERLY DIRECTION, WITH THE WEST RIGHT -OF -WAY
LINE OF SAID RAILROAD, AND WITH THE ARC OF A CURVE TO THE
RIGHT WHOSE CENTRAL ANGLE IS 4° 51' 08" AND WHOSE RADIUS IS
2814.93 FEET, A DISTANCE OF 238.39 FEET TO A POINT FOR THE
MOST SOUTHERLY CORNER OF THIS TRACT;
THENCE N. 54° 47' W., A DISTANCE OF 554.30 FEET TO A POINT
IN THE NORTHWEST BOUNDARY LINE OF SAID 35.0 ACRE TRACT, FOR
THE MOST WESTERLY CORNER OF THE TRACT HEREIN DESCRIBED;
THENCE N. 34° 33' E., WITH THE NORTHWEST BOUNDARY LINE OF SAID
2$.75 ACRE TRACT, A DISTANCE OF 200.0 FEET TO THE POINT OF
BEGINNING.

SECTION 2. THERE I1S1 HEREBY APPROPRIATED OUT OF NO. 202 WATER
SYSTEM BOND FUND THE SUM OF $4,387, OF WHICH $4,237 IS FOR ACQUISITION AND
$150 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING COST APPLICABLE TO PROJECT
N0. 202 -68 -29.1 GREENWAY 48" TRANSMISSION WATER MAIN LINE FROM CALALLEN RIGHT-
OF-WAY.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE NECES-
SARY DOCUMENTS AND TO AUTHORIZE THE PAYMENT OF FUNDS FOR THE ACQUISITION OF
THE AFORESAID PARCEL OF LAND IN ORDER TO PROCEED WITH THE WATER LINE PROJECT
CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER AND
THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND
THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING
REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY.SO
ORDAINED, THIS THE DAY OF FEBRUARY, 1971.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I. therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
