HomeMy WebLinkAbout10130 ORD - 03/03/1971TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH HELDENFELS BROTHERS FOR THE CONSTRUCTION OF STREET IMPROVEMENTS FOR GOLLIHAR ROAD UNIT III, AYERS TO KOSTORYZ; APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND THE SUM OF $290,000, OF WHICH $274,840.445 IS FOR THE CONSTRUCTION CONTRACT AND $15,159.55 IS FOR ENGINEERING AND CONTINGENCIES, ALL APPLICABLE TO PROJECT NO. 22o- 67- 86;•AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY.OF CORPUS CHRISTI, A CONTRACT WITH HELDENFELS BROTHERS FOR THE CONSTRUCTION OF STREET IMPROVEMENTS FOR GOLLIHAR ROAD UNIT III, AYERS TO KOSTORYZ, APPLICABLE TO PROJECT NO. 220- 67 -86, ALL AS MORE FULLY DESCRIBED IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE•CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE AND ACCORDING TO THE BID OF HELDENFELS BROTHERS OPENED ON THE 6TH DAY OF JANUARY, 1971, THE SAID BID OF HELDENFELS I BROTHERS BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED.OUT OF NO. 220 STREET BOND FUND THE SUM OF $290,000, OF WHICH $2714,840.445 IS FOR THE CONSTRUCTION CONTRACT AND $15,159.55 IS FOR ENGINEERING AND CONTINGENCIES. SECTION 3. THE NECESSITY TO EXECUTE THE AFORESAID CONTRACT AND TO APPROPRIATE THE SUMS THEREOF CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE L�,�t GY DAY OF MARCH, 1971.
