HomeMy WebLinkAbout10141 ORD - 03/03/1971VMP:3/3/71 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH MCCORD AND LORENZ, ARCHITECTS AND ENGINEERS, FOR PROFESSIONAL SERVICES NEEDED IN CONNECTION WITH THE DESIGN OF CERTAIN IMPROVEMENTS TO THE CORPUS CHRISTI MARINA AND THE PREPARATION OF PLANS AND SPECIFICATIONS FOR SAID IMPROVEMENTS, A COPY OF SAID AGREEMENT BEING ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING OUT OF NO. 292 MARINA IMPROVEMENTS BOND FUND THE SUM OF $20,000, OF WHICH $19,6$5 IS FOR THE ARCHITECTURAL AND ENGINEERING FEE AND $315 IS,FOR INCIDENTAL EXPEN- SES, ALL APPLICABLE TO PROJECT NO. 292 -70 -1; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, AN AGREEMENT WITH MCCORD AND LORENZ, ARCHITECTS AND ENGINEERS, FOR PROFESSIONAL SERVICES NEEDED IN CONNECTION WITH THE DESIGN OF CERTAIN IMPROVEMENTS TO b. THE CORPUS CHRISTI MARINA AND THE PREPARATION OF PLANS AND SPECIFICATIONS FOR SAID IMPROVEMENTS, A COPY OF SAID AGREEMENT BEING ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES. SECTION 2. THAT THERE IS HEREBY APPROPRIATED FROM N0. 292 MARINA IMPROVEMENTS BOND FUND, PROJECT N0. 292 -70 -1, THE SUM OF $20,000, OF WHICH $19,685 IS FOR THE ARCHITECTURAL AND ENGINEERING FEE AND $315 IS FOR INCI- DENTAL EXPENSES. SECTION 3. THE NECESSITY TO EXECUTE THE AFOREMENTIONED AGREEMENT ND APPROPRIATE THE NECESSARY FUNDS FOR THE FEE AND CONTINGENCIES AT THE EARLIEST POSSIBLE DATE SO THAT WORK ON THIS PROJECT MAY PROCEED WITHOUT DELAY, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIR- ING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL AND THE MAYOR, HAVING DECLARED THAT SUCH PUBLIC EMERGENCY AND IM- PERATIVE PUBLIC NECESSITY EXIST, AND HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS l ®A ` l LM i INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE"&j DAY OF MARCH, 1971. Marvin Townsend, hereinafter called "City ", and McCord and Lorenz, Architects and Engineers, herein- after called "Architects and Engineers ": W I T N E S S E T H: Whereas the City contemplates the construction of several improvements to the Corpus Christi Marina and whereas such improvements are (A) Pier and Filing Replacements on the Lawrence and Peoples Street T -Heads (B) Restroom Facilities on the IrHead and two T -Heads (C) Marina Office/Restroom Building - Lawrence Street T -Head (D) Concession/Restroom Building - L-Head and Peoples Street T -Head (E) Installation of Safety Ladders around L-Head and T -Heads (F) Water Distribution lines on L-Head and T -Heads (G) Piers on Ir and T -Heads and whereas in connectionCwith the above listed improvements and related work the City employs the said Architects and Engineers and said City and Architects and Engineers agree as follows: Phase I (Preliminary Phase) - Engineering and Architectural Studies Architects and Engineers agree to do the following work related to the Marina improvements but not limited to items listed above: (A) Review the items listed above with the appropriate agency or agencies of the City. Include in review any other items related generally to the improvements listed above. (B) Counsel with the City agency or agencies about the general plan and design of the proposed improvements to suit the needs and the budget. (C) Prepare schematic design studies of the proposed improvements. e (D) Prepare preliminary cost estimates of all studies and construction phases. (E) For each phase C chitects and Engineers are to submit project designs, material outline, specifications outline, and cost estimates of structural, mechanical and electrical systems. (F) Prepare a comprehensive engineering report of the total project including all items listed above but not limited to these items, showing costs, sketches, designs, suggestions, recommendations, alternate designs and plans, scheduling of project phases, etc. Submit 10 copies of this preliminary report to City. Phase II - Detailed Plans and Specifications After the City has determined the scope of work to be performed and has approved all or portions of the work phases recommended in the preliminary work and subsequent to written authorization by the City, the Architects and Engineers shall do the following: (A) Make necessary field surveys requDred for drawing plans and specifica- tions. (B) Prepare detailed plans and specifications for the authorized work. (C) Prepare detailed estimate of construction cost for the authorized work. (D) Provide City with 5 „copies of approved plans and 25 copies of specifica- tions for each phase of construction. (E) Assist and advise City concerning award of contracts. (F) Review drawing and data submitted by contractor (shop drawing, etc.) for approval. (G) Make periodic visits to the site of work during construction and consult with City concerning,progress. (H) Review laboratory reports. (I) Prepare contractors monthly estimates and time statements. (J) Provide City with "As -Built Construction Drawing” upon completion of project and original drawings. Page 2 FEE The City agrees to pay the Engineers and Architects for work approved on the following basis: 1. Upon the delivery and acceptance of the 10 copies of the preliminary report to)the City the lump sum of six thousand dollars ($6,000.00,) as payment in full for the services rendered under Phase I of the contract. 2. The fee for Phase II of the project shall be based on 8.5% of the construction cost of work authorized less 30% credit for work done on preliminary phase and paid for by the City. Effective rate thus will be (8.5 %) (70 %) = 5.95% net. The fee under Phase II of the project shall be paid as follows: (a) 85% upon completion of detailed plans and specifications and approval of these plans by the City. (b) 15% of the effective fee to be paidE chitects and Engineers upon completion of Phase II of the project. In the event the plans and specifications are not approved by the City within 120 calendar days from the date of official submission by Architects and Engineers, then the Architects and Engineers will be paid 8.5% of construction F estimate less 30% for preliminary work previously paid. SCHEDULING OF WORK Architects and Engineers agree to complete work in accordance with the following time table: 1. Phase I (Preliminary Work): All preliminary work shall be completed and preliminary report submitted to the City within 90 days from the date of written authorization by the City. 2. Phase TI: All design and detailed specifications shall be completed within 90 days from the date of written authorization by the City. Page 3 TERMINATION OF CONTRACT The City shall have the option of terminating this contract at any time and the fees of Architects and Engineers shall be the fee due for such stage or stages as are completed; and in the event termination occurs after request of the City to proceed with the next stage but before such stage is completed, the payment due the Architects and Engineers shall be the payment herein provided for the stage completed and a percentage of the uncompleted stage commensurate with the percentage of completion of that s'�'tage. FIN 2 -55 Revised 7/31/69 y� � i w Corpus Christi, Texas �2 ci day of t_t c Lc 19%/ TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall bd passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
