FOR SANITARY SEWER EXTENSIONS FOR THE MUNICIPAL SERVICE CENTER ANDAYERS STREET EXTENSION, PROJECT No. 250- 70 -88, SAID AMOUNT TO BE PAID TO THE CITY OF CORPUS CHRISTI PUBLIC UTILITIES DEPARTMENT TO APPLY AGAINST EXTENSION AND TAP CHARGES FOR THE SAME PROPERTY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION I. THAT THERE IS HEREBY APPROPRIATED OUT OF N0. 250 SAN I TAR Y_SEWER­BOND 'FUND ­THE `SUM'OF`070 FOR'ACQU PS I TPON'OF A UTILITY EASEMENT FROM C. GANAHL WALKER, JR. FOR SANITARY SEWER EXTENSIONS FOR THEEp tUNICIPAL SERVICE CENTER AND AYERS STREET EXTENSION, PROJECT NO. 250- 70 -88, SAID EASEMENT BEING DESCRIBED AS FOLLOWS: 10 -FOOT UTILITY EASEMENT OUT OF TRACT NO. -1 BEING A 10 -FOOT WIDE BY 882.0 -FOOT LONG STRIP OF LAND SOUTHWEST OF AND ADJACENT TO THE NORTHEAST BOUNDARY LINE OF TRACT NO. 1 AS DESCRIBED BY DEED DATED JULY 22, 1969 AND RECORDED IN VOLUME 1340, PAGE 306 DEED RECORDS, NUECES COUNTY, TEXAS, AND CONTAINING (820.0 SQUARE FEET OF LAND, MORE OR LESS, AND IN ADDITION, A 15 -FOOT WIDE BY 882.0 -FOOT LONG TEMPORARY CONSTRUCTION EASEMENT SOUTHWEST OF AND ADJACENT TO SAID 10 -FOOT WIDE UTILITY EASEMENT, SAID CONSTRUCTION EASEMENT TO EXPIRE ON COMPLETION OF THE INSTALLATION OF PROPOSED SANITARY SEWER LINE. UPON THE COMPLETION OF THE INSTALLATION OF THE SAID SANITARY SEWER LINE, THE GRANTEE SHALL RESTORE THE PREMISES SUBSTAN- TIALLY TO THE CONDITION SAID PREMISES ARE OR WERE IN, PRIOR TO THE USE OF SAME BY GRANTEE. 10 -FOOT UTILITY EASEMENT OUT OF TRACT NO. 2 BEING A 10 -FOOT WIDE BY 168 -FOOT LONG STRIP OF LAND SOUTH- WEST OF AND ADJACENT TO THE NORTHEAST BOUNDARY LINE OF TRACT NO. 2 AS DESCRIBED BY DEED DATED JULY 22, 1969 AND RECORDED IN VOLUME 134o, PAGE 306, DEED RECORES, NUECES COUNTY, TEXAS, AND CONTAINING 1680 SQUARE FEET OF LAND, MORE OR LESS, AND IN ADDITION, A 15-FOOT WIDE BY 168-FOOT LONG TEMPORARY CONSTRUCTION EASEMENT SOUTHWEST OF AND ADJACENT TO SAID 10 -FOOT WIDE UTILITY EASEMENT. SAID CONSTRUCTION EASEMENT TO EXPIRE ON COMPLETION OF THE INSTALLA- TION OF PROPOSED SANITARY SEWER LINE. THE NECESSITY TO IMMEDIATELY APPROPRIATE THE SUMS HEREINABOVE DESCRIBED AND TO ACQUIRE THE UTILITY EASEMENT FOR SANITARY SEWER EXTENSIONS FOR THE MUNICIPAL SERVICE CENTER AND AYERS STREET EXTENSION CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE D ) DAY OF MARCH, 1971.
