AN ORDINANCE
APPROPRIATING OUT OF NO. 250 SANITARY SEWER BOND FUND
$175 FOR ACQUISITION OF UTILITY EASEMENTS NEEDED IN
CONNECTION WITH ROLLING ACRES 1 AND 2 SEWER LATERALS,
PARCELS NO. 1 AND NO. 2, APPLICABLE TO PROJECT NO.

AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THERE IS HEREBY APPROPRIATED OUT OF NO. 250 SANITARY
SEWER BOND FUND $175 FOR ACQUISITION OF UTILITY EASEMENTS NEEDED IN CONNEC-
TION WITH ROLLING ACRES 1 AND 2 SEWER LATERALS, PARCELS N0. 1 AND NO. 2,
APPLICABLE TO PROJECT N0.250 -76-8 .2;SA1D PARCELS BEING MORE FULLY DESCRIBED
AS FOLLOWS:
PARCEL NO. 7
BEING THE NORTH 5.0 FEET OF LOT 16, BLOCK 5, ROLLING
ACRES SUBDIVISION NO. 2, AS SHOWN BY MAP OF RECORD IN
VOLUME 11, PAGE 47, NUECES COUNTY, TEXAS,
AND
ALSO THE RIGHT TO USE A 10 FOOT WIDE CONSTRUCTION
EASEMENT STRIP OF LAND OUT OF LOT 16, BLOCK 5, SOUTH
OF AND ADJACENT TO THE ABOVE DESCRIBED 5 FOOT PERMANENT
EASEMENT, MAKING A TOTAL OF 15 FOOT, DURING THE PERIOD
OF CONSTRUCTION, SAID CONSTRUCTION EASEMENT TO EXPIRE
ON COMPLETION OF THE CONSTRUCTION OF THE PROPOSED
SANITARY SEWER.

BEING THE SOUTH 5.0 FEET OF LOT 17, BLOCK 5, ROLLING
ACRES SUBDIVISION N0. 2, AS SHOWN BY MAP OF RECORD IN
VOLUME 11, PAGE 47, NUECES COUNTY, TEXAS MAP RECORDS.
SECTION 2. THAT THE CITY MANAGER BE, AND HE IS HEREBY AUTHORIZED
TO ACQUIRE THE AFORESAID PARCELS FROM THE OWNERS, LOUIS C. AND MARGARET
HAYNIE AND WILLIAM K. AND BEOLA G. HUBER, BY PROPER CONVEYANCE AND BY THE
EXECUTION OF SUCH OTHER INSTRUMENTS AS MAY BE NECESSARY.
SECTION 3. THE NECESSITY TO APPROPRIATE THE SUMS HEREINABOVE
DESCRIBED AND THE ACQUISITION OF THE UTILITY EASEMENT AFORESAID CREATES A
PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL
BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING

DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE
SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON
THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT
FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE /� i

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
.be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
- nance finally on the date it is introduced, or at the present meeting of the
City Council.
