HomeMy WebLinkAbout10155 RES - 03/10/1971A RESOLUTION INDEMNIFYING AND HOLDING HARMLESS THE GOVERNMENT OF THE UNITED STATES OF AMERICA FROM CLAIMS AND DAMAGES RESULTING FROM THE CITY'S DISPOSAL AND BURIAL OF HURRICANE CELIA DEBRIS AT NALFS CABANISS AND WALDRON; AND DECLARING AN EMERGENCY. WHEREAS, ON THE 4TH DAY OF AUGUST., 1970, THE PRESIDENT DECLARED A "MAJOR DISASTER" IN THE STATE OF TEXAS UNDER THE PROVISIONS OF PUBLIC LAW 875, 81ST CONGRESS, AS AMENDED, AND PUBLIC LAW 79, 91sT CONGRESS; AND WHEREAS, THE CITY OF CORPUS CHRISTI IS A PUBLIC ENTITY WITHIN SAID STATE AND WITHIN SAID DISASTER AREA: - NOW, THEREFORE, BE IT. RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY OF CORPUS CHRISTI AGREES TO INDEMNIFY AND HOLD HARMLESS THE UNITED STATES OF AMERICA FROM AND AGAINST ANY CLAIMS, DEMANDS, OR ACTIONS RESULTING FROM, OR ARISING IN CONNECTION WITH, THE THE DISPOSAL AND BURIAL OF DEBRIS AT NALFS CABANISS AND WALDRON. SECTION 2. THE NECESSITY TO IMMEDIATELY REDUCE TO WRITING THE CITY'S WILLINGNESS TO INDEMNIFY AND HOLD HARMLESS THE UNITED STATES OF AMERICA FROM ANY CLAIMS WHATSOEVER ARISING AS A RESULT OF THE CITY'S DISPOSAL AND BURIAL OF DEBRIS AT NALFs CABANISS AND WALDRON CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS RESOLUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO RESOLVED, THIS THE ID M DAY OF MARCH, 1971- ATTEST: � / r �J�dKdddil�E CITY EC ET Y �MA'YOR r/ 4e-�\l(( THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: AY OF M 7",/ 9 71: CI ATTORNEY 1 ®155. W Corpus Christi, Texas /0V day of , 197/ TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall bd passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
