HomeMy WebLinkAbout10166 ORD - 03/17/19713- 17- 71:mvl AN ORDINANCE AUTHORIZING THE CITY MANAGER TO CONVEY TO THE PARKWAY CHURCH OF CHRIST THAT PROPERTY DESCRIBED AS A 0.591 -ACRE TRACT OF LAND, FRONTING ON DAKIN PLACE, SIDING ON BRAWNER PARKWAY, AND BEING THAT TRACT KNOWN AS SARAH GOCHER ANNEX FILED IN VOLUME 24, PAGE 81, MAP RECORDS OF NUECES COUNTY, TEXAS, UPON THE PAYMENT OF THE CASH CONSIDERATION OF $9,000; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, WILUKIa6� SECTION 1. That the City Manager be, and he is hereby authorized, for and on behalf of the City of Corpus Christi, to execute a deed conveying to the Parkway Church of Christ that property described as a 0.591 -acre tract of land, fronting approximately 185 feet on Dakin Place, having a depth of 265 feet, siding approximately 290 feet on Brawner Parkway, and being that tract known as Sarah Gocher Annex, filed in Volume 24, Page 81, Map Records of Nueces County, Texas, upon the payment of the cash consideration of $9000, a copy of which deed, marked Exhibit "A ", is attached hereto and made a part hereof, r SECTION 2. The necessity to immediately authorize the execution of a deed in order to facilitate the sale of the above described parcel or tract of land creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 1)V4 day of ��/1l?/2C�tJ 1971. ATTEST,, City Secie ,Vry MAYOR THE CITY OF CO CHRISTI, TEXAS APPROVED: /7� DAY OF 1,14A, 1971: Cit Attorney 10166 3- 17- 71:mvl - SPECIAL WARRANTY DEED THE STATE OF TEXAS X a COUNTY OF NUECES That the City of Corpus Christi, hereinafter called Grantor, for and in consideration of the sum of Nine Thousand Dollars ($9,000) to Grantor in hand paid by the Parkway Church of Christ, the receipt of which is hereby acknowledged, and for which no lien is retained, either expressed or implied, has this day sold, and by these presents does GRANT, BARGIAN, SELL and CONVEY unto the Parkway Church of,,Christ, all that certain tract or parcel of land lying and being situated in the County of Nueces, State of Texas, more particularly described as follows, to -wit: Being a 0.591-acre tract of land, fronting approximately 185 feet on Dakin Place, having a depth of 265 feet, siding approximately 290 feet on Brawner Parkway, and being that tract known as Sarah Gocher Annex, filed in Volume 24, page 81, Map Records of Nueces County, Texas. There is reserved, however, a utility easement 10 feet wide by-.1ength of existing sewer line. It is understood that purchaser will pay all closing costs in connection with this transaction. TO HAVE AND TO HOLD the above described premises herein conveyed, together with all and singular the rights and appurtenances thereto in any- wise belonging, to the Parkway Church of Christ, its successors, adminis- trators and assigns, forever, and Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend all and singular the said premises herein conveyed 'against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through or under Grantor.
