HomeMy WebLinkAbout10186 ORD - 03/24/19713-24-71 :mv1 , AN ORDINANCE I AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED; UPON APPLICATION OF CAPITAL EQUITIES, LTD., BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PROPERTY OUT OF LOTS 7 AND 10, SECTION 5, RANGE V111 GUGENHEIM & COHN'S FARM LOTS, CONTAINING 16.419 ACRES, LOCATED ON THE NORTHEAST CORNER OF THE INTERSECTION OF SOUTH PADRE ISLAND DRIVE AND OLD BROWNSVILLE ROAD, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE- FAMILY ]XjELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND'DECIZARING AN- EMERGENCY 1MEREAS, THE PLANNING COMt4ISSION HAS' FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERIJING THE APPLICATION OF CAPITAL EQUITIES, LTD., FOR A14tNDMENT TO THE ZONING t.AP OF THE CITY OF CORPUS CHRISTI; AND 4MEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE TIIE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON MAr.CH 22, 1971 , AT SPECIAL COUNCIL'VIEETING OF THE CITY COUNCIL IN THE COUNCIL CHA14BER AT CITY HALL IN THE CITY'OF CORPUS CHRISTI ;, AND t- AIEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH \ AMENDIIENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE,CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAIPIED BY THE CITY COUNCIL OF THE CITY'OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF i RECORD IN VOLUME 9, PAGES SUS, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TII.IE, AND IN PARTICULAR AS AMENDED BY- ORDINANCE 1-10. 0106, AS AMENDED, HE AND THE SAME 15 HEREBY AMENDED BY MAKING TIIE CHANGE I1ERI :INAf TF.R SET OUT. That the zoning on property out of Lots 7 and 10, Section 5, Range V111 Gugenheim & Cohn's Farm Lots containing 16.419 acres located on the northeast corner of the intersection of South Padre Island Drive and Old Brownsville Road, situated in the City of Corpus Christi, Nueces County, Texas, as more fully described hereinafter, be, and the same is hereby, changed from "R -1B" One- Family Dwelling District to "B -4" General Business District: Beginning at a point in the northeast right- of-way line of South Padre Island Drive for the most westerly corner and point of beginning of this tract whence the northwest corner of Lot 3, Gugenheim & Cohn's Farm Lots bears with said right- of-way line N 410 12' W 2,628.30 feet; N 350 46' W 260.36 feet to the south right -of -way line of Kosar Road and along said right- of-way line N 890 18' E 150.70 feet and N 000 42' W 30 feet to the centerline of Kosar Road; Thence with said right -of -way line of South Padre Island Drive S 410 12' E,329 feet; S 450 32' E 420.80 feet; S 830 43' E 101.15 feet to the northwest right -of -way line of Old Robstown Road for the most southerly corner of this tract; Thence with said right -of -way line N 530 47' E 378 feet to the east boundary line of said Lot 7 for the south- east corner of this tract; Thence with said boundary line N 000 24' W 1,156.79 feet to the northeast corner of this tract; Thence S 470 53' 04" W 1,232.75 feet to the point of beginning. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas; be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That the necessity of, immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist; and having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the -14 day of ' o / -c,lc� _ 1971.
