FOR A TERM OF FIVE YEARS CONCERNING THE INSTALLATION AND MAINTENANCE OF A FOUR- SIDED, ILLUMINATED BASKETBALL SCOREBOARD IN MEMORIAL COLISEUM WITH WINCH MECHANISM FOR RAISING AND LOWERING SAID SCOREBOARD, AS SHOWN ON THE ATTACHED SKETCH, A COPY OF WHICH AGREEMENT MARKED EXHIBIT "A ", IS ATTACHED HERETO AND MADE A PART HEREOF. F BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to execute, for and on behalf of the City of Corpus Christi, a Contract with the American Bottling Co., Inc. for a term of five (5) years concerning the installation and maintenance of a four- sided, illuminated Basketball Scoreboard in Memorial Coliseum with winch mechanism for raising and lowering said scoreboard, as shown on the attached sketch, a copy of which agreement marked Exhibit "A ", is attached hereto and made a part hereof. I0191 3/15/71:mvl CONTRACT THE STATE OF TEXAS COUNTY OF NUECES This agreement made and entered into this day of 1971, by and between the City of Corpus Christi, a municipal corporation of the State of Texas, hereinafter called "CITY ", and the American Bottling Company, Inc., whose principal office or place of business is located at 717 Lester Street, Corpus Christi, Texas, here- inafter called "LICENSEE ". W I T N E S S E T H: For valuable consideration the parties hereto mutually agree to the installation of a four -sided illuminated Basketball scoreboard = with winch mechanism for raising and lowering in Memorial Coliseum for the term of five (5) years, said license beginning on the day of 1971, and ending five (5) years from that date, subject to the following conditions, to -wit: 1. The scoreboard to be installed and maintained by the American Bottling Company at their total expense for the entire five (5) year term in exchange for advertising message on said scoreboard. 2. The American Bottling Company will retain ownership of said scoreboard. 3. The American Bottling Company agrees to carry the City as an "Additional Insured" for said scoreboard. 4. This Contract contains all the provisions agreed upon by the parties hereto and displaces all previous verbal or oral agreements. Witnesseth the hands of the parties hereto this the day of. 1971.
