HomeMy WebLinkAbout10196 ORD - 03/31/1971I JKH:3 -26 -71 I- it r AN ORDINANCE CLOSING A PORTION OF WATER STREET, FROM MESQUITE TO HIRSCH, AND THE PORTION OF DAN REID STREET LOCATED BETWEEN CHAPARRAL AND WEST SHORELINE, LOCATED IN THE BAYFRONT SCIENCE PARK; RESERVING THE NECESSARY EASE- MENTS FOR EXISTING UTILITIES; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CON- CERNING THE CLOSING OF A PORTION OF WATER STREET, FROM MESQUITE TO HIRSCH, AND THE PORTION OF DAN REID STREET, FROM CHAPARRAL TO WEST SHORELINE, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, MORE FULLY DESCRIBED HEREINAFTER, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID PORTIONS OF WATER AND DAN REID STREETS AND WITHIN 450 FEET OF THE AREA TO BE CLOSED AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR MEETING OF THE F. CITY'COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, MARCH 24, 1971, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCILrAFTER SUCH HEARING THAT IT WOULD BEST SERVE THE PUBLIC CONVENIENCE AND NECESSITY TO CLOSE THAT PORTION OF WATER STREET AND THAT PORTION OF DAN REID STREET, MORE FULLY DESCRIBED HEREINAFTER, FOR USE AS PUBLIC STREETS; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE HEREINAFTER DESCRIBED PORTIONS OF WATER AND DAN REID STREETS SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES; HOWEVER, THE CITY COUNCIL HAS DETERMINED IT IS NECESSARY TO RETAIN EASEMENTS FOR EXISTING UTILITIES: w NOW, THEREFORE, BE IT ORDAINED L„BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THAT PORTION OF WATER STREET, FROM MESQUITE TO HIRSCH, AND THAT PORTION OF DAN REID STREET, FROM CHAPARRAL TO WEST SHORELINE, LOCATED IN THE BAYFRONT SCIENCE PARK, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, BE AND THE SAME ARE HEREBY CLOSED FOR PUBLIC USE AS PUBLIC e STREETS AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY, SUBJECT TO RESERVATION OF THE HEREINAFTER DESCRIBED UTILITY EASEMENT, AND AS MORE FULLY ILLUSTRATED ON THE MAP ATTACHED HERETO, MARKED EXHIBIT "A ", AND q MADE A PART HEREOF: v i� 10136 y � 3J � ^fit Being an irregularly shaped tract of land out of a portion of Block 105, Beach Portion and out of those portions of Water Street and Dan Reid Street lying between Blocks 95 and 94 and Blocks 94 and 105 respectively, said Beach Portion, said tract being more particularly described by metes and bounds as follows: Beginning at the Southwest corner of said Block 94, said point being at the intersection of the North right of way line of Carroll Street and the Nast right -o£ -tray line of Water Street, for the beginning corner of the tract herein described; Thence in a westerly direction with the westerly extension of said North right of tray line of Carroll Street, across water Street a distance of 60.0 feet to the Southeast corner of said Block 95 for a corner of this tract; Thence in a northerly direction with the east boundary line of said Block 95, a distance of 263.0 feet to a point for a corner of this tract; Thence in a northeasterly direction a distance of '107.0 feet to a point in the Northerly extension of the east right of way line of Water Street for an interior corner of the tract herein described; Thence in a Northerly direction with the northerly extension of'the east right of way line of said Water Street, a distance of 15.0 feet to a point in the Southwest corner of said Block 105 for a corner of the tract herein described; Thence in a easterly direction, with the South boundary line of said Block 105, a distance of 48.5 feet to a point for a corner of the tract herein described; Thence in a northerly direction with a line that is 48.5 feet east of and parallel to the west boundary line of said Block 105, a distance of,80.0 feet to a point for an interior corner of the tract herein described; Thence in a Northwesterly direction, at 69.0 feet plus or minus pass the west "boundary line of said Block 105, in all a distance of 104.0 feet to a point for a corner of the tract herein described; Thence in a northerly direction with a line that is 5.0 feet east of and parallel to the centerline of Water Street, a distance of 170.0 feet to a point in the easterly extension of the north boundary line of said Block 104, for a corner of the tract herein described; Thence in an easterly direction with the easterly extension of the north boundary line of Block 104, said Beach Portion, a distance of 10.0 feet to a -point for a corner of the tract herein described; Thence in a southerly direction with a line that is 15.0 feet east of and parallel to the centerline of said Water Street, a distance of 165.0 feet to a point for an interior. corner of-this tract; Thence in a Southeasterly direction at 19.0 feet plus or minus pass the west boundary line of said Block 105, in all a distance of 104.0 feet to a point for a corner of the tract herein described; Thence in a Southerly direction, with a line that is 58.5 feet east of and parallel to the west boundary line of said Block 105, a distance of 84.0 feet to a point in the South boundary line of said Block 105 for a corner of the tract herein described; Thence iri an easterly direction with the South boundary-line of said Block 105, a distance of 241.5 feet to the Southeast corner of said Block 105, for a corner of the tract herein described; Thence in a Southerly direction with the west right of way line of West Shoreline Blvd., across Dan Reid Street, a distance of 63.6 feet to the Northeast corner of said Block 94, for a corner of the tract herein described; Thence in a Westerly direction with the north boundary line of said Block 94, a distance of 300.0 feet to the Northwest corner of said Block 94 for a corner of the tract herein•described; Thence in a Southerly direction with the west boundary line of said Black 94, a distance of 300.0 feet to the point of beginning. Containing 0.733 acre of land more or less -2- i IN THE EVENT ANY RESERVATION OF EASEMENT HEREIN MADE BY THIS CLOSING IS NULLIFIED, INVALIDATED OR REVOKED 8Y ANY LEGAL AUTHORITY OR BY FINAL JUDG- MENT OF A COURT OF COMPETENT JURISDICTION, THIS CLOSURE IS THEREBY VOIDED TO THE EXTENT OF SUCH REVOCATION OR INVALIDATION OF EASEMENT. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID PORTION OF SAID STREETS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLU- TION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE --?/&DAY OF MARCH, 1971• ATTEST: CITY 3ECRIETAr ` Y THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: h%c DAY OF RC , 1971: C Y ATTORNEY 3 Corpus Christi, /Texas day o f % ?, - 4 , 19 7 � TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
