AN ORDINANCE

VACATING THE 5 —FOOT POWER AND TELEPHONE EASEMENT ALONG
THE WEST SIDE OF MT. VERNON SHOPPING CENTER, BLOCK K,
BETWEEN SOUTH STAPLES STREET AND MCARDLE ROAD;, CONDI-
TIONED UPON-.T-HE PAYMENT BY THE OWNER OF ABUTTING
PROPERTY OF THE COST OF RELOCATION OF ANY EXISTING
UTILITY LINES;•AND DECLARING AR' EMERGENCY. '
WHEREAS, A CERTAIN 5 —FOOT POWER AND TELEPHONE EASEMENT EXISTS
ALONG'THE WEST SIDE OF MT. VERNON SHOPPING CENTER, BLOCK K, BETWEEN SOUTH
STAPLES STREET AND MCARDLE ROAD, AS SHOWN BY MAP OR PLAT OF RECORD IN THE
MAP RECORDS OF NUECES COUNTY, TEXAS; AND ,

WHEREAS, THE OWNER OF THE ABUTTING PROPERTY HAS *REQUESTED ABANDON-
MENT OF THE AFORESAID EASEMENT, WHICH EASEMENT IS NOT NOW NEEDED AND WILL
NOT. IN THE FORESEEABLE FUTURE BE NEEDED BY THE CITY, AND THE CITY A S AGREE-
ABLE TO THE ABANDONMENT OF THE AFORESAID 5 —FOOT POWER AND TELEPHONE EASE-
MENT:
` NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THAT ALL OF THAT CERTAIN 5 —FOOT POWER AND TELEPHONE
EASEMENT PRESENTLY EXISTING ALONG THE WEST SIDE OF MT. VERNON SHOPPING s.
CENTER, BLOCK K, BETWEEN SOUTH STAPLES STREET AND MCARDLE ROAD, IN THE CITY
OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY MAP OR PLAT OF RECORD
IN THE MAP RECORDS OF NUECES COUNTY, TEXAS, BE, AND THE SAME IS HEREBY,
DECLARED ABANDONED AND RELEASED AND RELINQUISHED BY THE CITY OF CORPUS
- CHRISTI UNTO THE PRESENT OWNERS, SUBJECT, HOWEVER, TO,PAYMENT BY THE SAID
OWNER OF COST OF RELOCATION OF ANY EXISTING UTILITY LINES.
SECTION 'L. THE NECESSITY FOR RECOGNIZING THE ABANDONMENT OF THE ,
EASEMENT HEREINABOVE DESCRIBED CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE
PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI-
NANCE OR RESOLUTION SHALL BEyPA$SED FINALLY ON THE DATE OF ITS INTRODUCTION
AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEET-
INGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY
AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
