AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS.AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
SUNSET LODGE N0, 1388 BY AMENDING THE ZONING MAP BY
CHANGING THE ZONING ON A 1.50 -ACRE TRACT OF LAND
OUT OF LOTS 31 AND 34, H, B. SHEPPARD FARM LOTS
LOCATED AT THE REAR OF 8314 LEOPARD STREET (HIGHWAY
#9), SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, FROM "R -1B "ONE- FAMILY DWELLING DIS-
TRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; KEEPING
IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDI-
NANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND DECLARING AN EMERGENCY.
WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY
COUNCIL ITS REPORTS AND RECOMM.EN OAT I ONS CONCERNING THE APPLICATION OF
SUNSET LODGE NO. 1388 FOR AMENDMENT
TO THE Z014ING MAP OF THE CITY OF CORPUS CHRISTI; A14D
k9iEREAS, PUBLIC HEARINGIWAS HELD AT WHICH HEARING ALL PERSONS .
W15NING TO APPEAR AND BE HEARD VERE HEARD, TO CONSIDER THE SAME BEFORE

THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER
NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON MARCH
1971 , AT SPECIAL COUNCIL MEETING OF THE CITY
COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS

WHEREAS, BY MOTION DULY'MADE, SECONDED AND CARRIED, IT WAS
DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH
AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND
THE GENERAL WELFARE OF' THE CITY OF CORPUS CHRISTI AND ITS CITIZENS:
NOW,.THEREFORE, BE IT ORDAINED BY THE CITY COU ?ICIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE ZONING ORDINANCE OF.THE CITY OF CORPUS
CHRISTI, TEXAS, PASSED ON THE 2771'4 DAY OF AUGUST, 1937, APPEARING OF
RECORD IN VOLUME 9, PAGES 565, ET�SEQ, OF THE ORDINANCE AND RESOLUTION
RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY
ORDINANCE ND. 61o6, AS AMENDED, DE AND THE SAME IS HEREBY AMENDED BY

SECTION 2. THAT THE ZONING OF THE FOLLOWING DESCRIBED PARCEL OF
LAND BE CHANGED FROM "R -18" ONE - FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL
OFFICE DISTRICT:
A PORTION OF LOTS THIRTY -ONE (31) AND THIRTY -FOUR (34) OF
THE H. B. SHEPPARD FARM LOTS THE MAP OR PLAT OF WHICH
APPEARS OF RECORD IN VOLUME A" PAGE 51, MAP RECORDS OF
NUECES COUNTY TEXAS TO WHICH REFERENCE IS HERE MADE IN
AID OF THIS DESCRIPTION; SAID TRACT BEING MORE PARTICULARLY
DESCRIBED BY METES AND BOUNDS AS FOLLOWS TO -WIT:
COMMENCING AT AN IRON PIPE SET AT THE POINT OF INTERSECTION
OF THE NORTHEAST BOUNDARY LINE OF THE RIGHT -OF -WAY OF STATE
HIGHWAY NO. 9 AND A LINE THAT IS PARALLEL TO AND 25 FEET
WEST OF THE CENTER LINE OF TULOSO ROAD;

THENCE SOUTH 00 DEGREES 02 MINUTES WEST ALONG THE WEST BOUND-

OF THAT CERTAIN TRACT OF LAND HERETOFORE CONVEYED TO THE

TEXAS, A DISTANCE OF 284.14 FEET TO AN IRON PIPE IN THE
NORTHEAST BOUNDARY LINE OF THE AFOREMENTIONED C. B. COLLINS
ET UX TRACT, THE SOUTHWEST CORNER OF SAID TULOSO- MIDWAY
INDEPENDENT SCHOOL DISTRICT TRACTS FOR THE SOUTHEAST CORNER
OF THIS TRACT;
THENCE NORTH 65 DEGREES 15 MINUTES WEST ALONG THE SAID NORTH-
EAST BOUNDARY LINE OF THE C. B. COLLINS ET UX TRACT A DISTANCE
OF 334.25 FEET TO THE PLACE OF BEGINNING; SAVE AND EXCEPT]
HOWEVER, ALL OF THE MINERALS IN SAID LAND AND ALL RIGHTS
APPURTENANT TO SUCH MINERALS IT BEING THE INTENTION OF GRANTOR
HEREIN TO HEREBY CONVEY ONLY THE SURFACE ESTATE OF SAID LAND.

SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS
CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED.
SECTION b. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF
CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS
AMENDED FROM T114E TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN
FULL FORCE AND EFFECT.
SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT HEREWITH ARE-HEREBY EXPRESSLY REPEALED.
SECTION 6. THAT THE NECESSfTY OF IMMEDIATELY MAKING AFORESAID
CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING
ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND
AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER
RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE
OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED
THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL
FORCE AND EFFECT FROM AND

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shali be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
