AN ORDINANCE

AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH CORPUS CHRISTI SYMPHONY WHEREBY THE CORPUS CHRISTI
SYMPHONY WILL PROVIDE SYMPHONY MUSIC TO A BROADER
CROSS- SECTION OF THE CITIZENS OF CORPUS CHRISTI, ALL
AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF
WHICH IS ATTACHED HERETO MARKED EXHIBIT "A ", AND MADE
A PART HEREOF; APPROPRIATING AND REAPPROPRIATING OUT
OF CODE 362, GAS ADVERTISING BUDGET, THE SUM OF $6,000
FOR THE CITY'S PARTICIPATION IN THE PROGRAM PROVIDED
IN THE AFORESAID AGREEMENT; AND DECLARING AN EMERGENCY.
WHEREAS, THE CITY OF CORPUS CHRISTI IS INTERESTED IN BRINGING
SYMPHONY MUSIC TO A BROADER CROSS- SECTION OF THE CITIZENS OF* CORPUS CHRISTI;
AND
WHEREAS, THE CORPUS CHRISTI SYMPHONY HAS AGREED TO PROVIDE
THE AFORESAID SYMPHONY MUSIC:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
TO EXECUTE AN AGREEMENT WITH CORPUS CHRISTI SYMPHONY FOR THE PURPOSE OF
PROVIDING SYMPHONY I4USIC TO A BROADER CROSS-SECTION OF THE CITIZENS OF
CORPUS CHRISTI, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF
WHICH IS ATTACHED HERETO, MARKED EXHIBIT A', AND MADE A PART HEREOF.
SECTION 2. THERE IS HEREBY APPJRIATED AND REAPPROPRIATED OUT
OF CODE 362, GAS ADVERTISING BUDGET, THE SUM OF $6,000 AS THE CITY'S SHARE
FOR PARTICIPATION IN THE PROGRAM PROVIDED IN THE AFORESAID AGREEMENT.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE
AGREEMENT AFORESAID AND TO APPROPRIATE THE NECESSARY SUMS CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE
CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE
READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING
DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE
SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY

ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE

WHEREAS, THE CITY OF CORPUS CHRISTI IS INTERESTED IN BRINGING
SYMPHONY MUSIC TO A BROADER CROSS - SECTION OF THE CITIZENS OF CORPUS
CHRISTI; AND
WHEREAS, THE CORPUS CHRISTI SYMPHONY HAS AGREED TO PROVIDE THE
SAME, THE FOLLOWING CONTRACT AND AGREEMENT IS-ENTERED INTO BETWEEN THE
CITY OF CORPUS CHRISTI AND THE CORPUS CHRISTI SYMPHONY:
THE CORPUS CHRISTI SYMPHONY AGREES TO PROVIDE SYMPHONY MUSIC
AS FOLLOWS:
A. TO BRING MEMBERS OF THE ORCHESTRA TO VARIOUS COMMUNITY
.CENTERS THROUGHOUT THE CITY TO EXPLAIN THEIR MUSICAL
INSTRUMENTS AND'TO PERFORM IN SMALL GROUPS;
B. TO PROVIDE A FREE CHRISTMAS CONCERT OF HANDEL'S MESSIAH;
AND
C. TO PROVIDE A SPRING POPS CONCERT WITH A GUEST JAZZ
SOLOIST OR ROCK GROUP.
IN CONSIDERATION OF THE CORPUS CHRISTI SYMPHONY PROVIDING THE
ABOVE AND FOREGOING SYMPHONY MUSIC TO THE CITIZENS OF CORPUS CHRISTI, THE
CITY OF CORPUS CHRISTI AGREES TO PAY TO THE CORPUS CHRISTI SYMPHONY THE SUM
OF $6,000, WHICH SUM IS TO BE APPROXIMATELY ONE -HALF OF THE TOTAL COST OF
SUCH PROGRAM; PROVIDED, HOWEVER,-THAT THE CITY OF CORPUS CHRISTI'S APPLICA-
TION HEREIN IS CONDITIONAL AND CONTINGENT UPON THE CORPUS CHRISTI SYMPHONY'S
RECEIVING THE REMAINDER OF THE COST OF THE CONTRACT THROUGH THE PARTICIPATION
OF THE NATIONAL ENDOWMENT OF THE ARTS, AND THAT THE CITY SHALL HAVE NO
OBLIGATION UNDER THIS CONTRACT UNLESS AND UNTIL SUCH PARTICIPATION IS SECURED
BY THE CORPUS CHRISTI SYMPHONY.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
