HomeMy WebLinkAbout10217 ORD - 03/31/1971JKH:3 -31 -71 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH BRASELTON CONSTRUCTION COMPANY FOR THE CONSTRUC- TIQN OF THE MUNICIPAL SERVICE CENTER; APPROPRIATING OUT OF NO. 207 PUBLIC BUILDING BOND FUND $1,040,000, OF WHICH $1,013,790.53 15 FOR THE CONSTRUCTION CONTRACT AND $26,209.47 IS FOR CONTINGENCIES, INCLUDING ENGINEER- ING AND INCIDENTAL EXPENSES,,ALL APPLICABLE TO PROJECT NO. 207- 70 -10; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE A CONTRACT WITH BRASELTON CONSTRUCTION COMPANY FOR THE CONSTRUC- TION OF THE MUNICIPAL SERVICE CENTER, APPLICABLE TO PROJECT N0. 207- 70 -10, ALL AS MORE FULLY DESCRIBED IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE AND ACCORDING TO THE BID OF BRASELTON CONSTRUCTION COMPANY, OPENED ON THE * DAY OF MARCH, 1971, THE SAID BID OF BRASELTON CONSTRUCTION COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF N0. 207 PUBLIC BUILDING BOND FUND THE SUM OF $1,040,000, OF WHICH $1,013,790.53 IS FOR THE CONSTRUCTION-CONTRACT AND $26,209.47 IS FOR CONTINGENCIES, INCLUDING ENGINEERING AND INCIDENTAL EXPENSES. SECTION 3. THE NECCSSITY TO EXECUTE THE AFORESAID CONTRACT AND TO APPROPRIATE THE SUMS THEREFOR CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDI- NANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF'THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT,SUCH EMERGENCY AND NECESSITY EXIST, AND HAVIIIG REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, 10217 IT IS ACCORDINGLY SO ORDAINED, THIS THE d /.?C- DAY OF MARCH, 1971- ATTEST: CITY SECRETAR Ys OR THE CITY OF CORPUS CHRISTI,,TEXAS APPROVED: DAY "OF RC 1971: r CI Y ATTORNEY, i CITY OF CORPUS CHRISTI, TEXAS CERTIFICATION OF FUNDS (City Charter Article IV Section 21) March 29, 1971 I certify to the City Council that $ 1,040,000.00 , the amount required for the contract, agreement, obligation or expenditures contemplated in the above and foregoing ordinance is in the Treasury of the City of Corpus Christi to the credit of: Fund No. and Name 207 Public Building Bond Fund Project No. 207 -70 -10 Project Name Municipal Service Center - Buildings and Improvements from which it is proposed to be drawn, and such money is not appropriated for any other purpose. '5 3 a , �9Z Director of nance FIN 2 -55 Revised 7/31/69 Corpus Christi, Texas -1dt day of tJ , 19;%l TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
