HomeMy WebLinkAbout10221 ORD - 03/31/1971VMP:3 /31/71 ..� A AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE DRUG ABUSE COUNCIL FOR THE PURPOSE OF COMBATING THE USE OF NARCOTICS AND DANGEROUS DRUGS IN THIS AREA AND FOR THE DEVELOPMENT, COORDINATION AND IMPLEMENTATION OF A COMPREHENSIVE COMMUNITY PROGRAM, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "o, AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. WHEREAS, THE CITY OF CORPUS CHRISTI HAS RECEIVED A DISCRETIONARY GRANT FROM THE LAW ENFORCEMENT ASSISTANCE ADMINISTRATION TO(SSIST ITJ N THE IMPLEMENTATION OF A PROGRAM DESIGNED TO CONTROL THE USE OF NARCOTICS I� AND DANGEROUS DRUGS (WITH FUNDS MADE AVAILABLE UNDER AUTHORITY OF SECTION 306 OF THE OMNIBUS CRIME CONTROL AND SAFE STREETS ACT OF 1968); AND WHEREAS, THE DRUG ABUSE COUNCIL DESIRES TO PARTICIPATE WITH THE CITY BY RENDERING SERVICES FOR THE PURPOSES OF COMBATING THE USE OF NAR- COTICS AND DANGEROUS DRUGS IN THIS AREA: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO ENTER INTO AN AGREEMENT WITH THE DRUG ABUSE COUNCIL FOR THE PURPOSE OF COMBATING THE USE OF NARCOTICS AND DANGEROUS DRUGS IN THE CORPUS CHRISTI AREA AND FOR THE DEVELOPMENT, COORDINATION AND IMPLEMENTATION OF A COMPREHENSIVE COM- MUNITY PROGRAM, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT AND MADE A PART HEREOF. SECTION 2. THE NECESSITY TO ENTER INTO THE AFORESAID AGREEMENT AT THE EARLIEST PRACTICABLE DATE IN ORDER THAT THE NARCOTICS AND DANGEROUS DRUG CONTROL PROGRAM MAY BE FURTHERED IN THE AREA CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPEN- SION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE 10221 DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER /pITS � PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF "`��`^`� , 1971. ATTEST: �— •���yyy ems CITY SEC TAj2J / R THE CITY OF CORPUS CHRISTI, TEXAS APPROVED: DAY OF , 1971: ": CIT ATTORNEY vmP:3 3171 AGREEMENT THE STATE OF TEXAS j COUNTY OF NUECES THIS AGREEMENT, ENTERED INTO AS OF THE 31sT DAY OF MARCH, 1971, BY AND BETWEEN THE CITY OF CORPUS CHRISTI, HEREAFTER REFERRED TO AS "CITY11, AND THE DRUG ABUSE COUNCIL, HEREINAFTER REFERRED TO AS "COUNCIL11, W I T N E S S E T H: WHEREAS, CITY HAS RECEIVED A DISCRETIONARY GRANT FROM THE LAW ENFORCEMENT ASSISTANCE ADMINISTRATION (HEREINAFTER REFERRED TO AS LEAP,) TO ASSIST IT IN THE IMPLEMENTATION OF A PROGRAM DESIGNED TO CONTROL THE USE OF NARCOTICS AND DANGEROUS DRUGS (WITH FUNDS MADE AVAILABLE UNDER AUTHORITY OF SECTION 306 OF THE OMNIBUS CRIME CONTROL AND SAFE STREETS ACT OF 1968), AND WHEREAS, THE COUNCIL DESIRES TO PARTICIPATE WITH THE CITY BY REN- DERING THE SERVICES HEREINAFTER DESCRIBED FOR THE PURPOSES OF COMBATING THE USE OF NARCOTICS AND DANGEROUS DRUGS IN THIS AREA; AND WHEREAS, MEMORIAL HOSPITAL DESIRES TO PROVIDE $31,1+6 IN IN -KIND CONTRIBUTIONS IN THE NATURE OF HOSPITAL FACILITIES FOR DRUG ADDICTS; NOW, THEREFORE, THE COUNCIL AGREES AS FOLLOWS: 1. TO COORDINATE, DEVELOP AND IMPLEMENT A COMPREHENSIVE COMMUNITY PROGRAM TO ADDRESS DRUG ABUSE FROM SEVERAL APPROACHES. THE PROGRAM WILL CONSIST OF: A. CONTACTING YOUTH DRUG ABUSERS AND PROVIDING THEM WITH ACTIVITIES, COUNSELING AND THERAPY DESIGNED TO SUPPORT AND ENCOURAGE THE FUNCTIONING OF THE INDIVIDUAL IN SOCIETY WITHOUT THE USE OF DRUGS. B. TO ESTABLISH AN ADDICT TREATMENT CENTER REVOLVING AROUND THE EXPERIMENTAL METHADONE TREATMENT. C. ESTABLISHMENT OF AN ADOLESCENT PSYCHIATRIC CENTER USING LOCAL PSYCHIATRISTS AND CLINICAL PSYCHOLOGISTS. D. PROVIDE A PROGRAM OF PUBLIC INFORMATION THROUGH A SPEAKERS BUREAU AND SEMINARS. r x 11 1 13 1 7- l,-X-" 2. TO SPEND NO MORE THAN $92,506 UNDER THE TERMS.SET FORTH IN THE BUDGET AND TO ADHERE TO THE REQUIREMENTS CONTAINED IN THE APPLICATION PROJECT. BUDGET AND APPLICATION PROJECT ARE ATTACHED HERETO AS EXHIBIT "A". '3. TO ABIDE BY THE PROCEDURES FOR FINANCIAL ADMINISTRATION OF THE GRANT AS SET FORTH IN EXHIBIT "B". 4. THE PERSONNEL DESCRIBED IN THE BUDGET SHALL BE UNDER THE SUPERVISION OF A PERSON DESIGNATED AS THE DIRECTOR OF THE DRUG ABUSE COUNCIL AND SAID PERSON SHALL BE DESIGNATED TO SIGN ALL FINANCIAL DOCUMENTS AS REQUIRED BY THE CITY. j. TO ABIDE BY ALL SPECIAL CONDITIONS AS ESTABLISHED BY THE CRIMINAL JUSTICE COUNCIL AND AS INCLUDED AS EXHIBIT "C ". 6. TO RENDER A WRITTEN REPORT BY THE 20TH OF EACH MONTH FOR THE PRECEDING MONTHS ACTIVITIES TO THE CITY COUNCIL AND CITY MANAGER OF THE EXPENDITURCS 14ADE BY THE COUNCIL, IN CONNECTION WITH GRANT AND A DESCRIP- TION OF THE PREVIOUS MONTHS ACTIVITIES. COPIES OF THE QUARTERLY REPORT AND EVALUATION REQUIRED BY THE GRANT WILL BE'FORWARDED,TO THE CITY COUNCIL AND CITY MANAGER. NOW, THEREFORE, THE CITY AGREES AS FOLLOWS: 1. TO ACT AS CONTROL DIRECTOR OF SAID PROJECT AND FISCAL AGENT TO RECEIVE, HOLD, AND DISBURSE THE FUNDS AS ESTABLISHED IN THE BUDGET EXHIBIT flAll� • • 2. TO REIMBURSE THE COUNCIL FOR ALL EXPENDITURES INCURRED TO THE DATE OF THIS CONTRACT AS OF MARCH 1, 1971, THE DATE FOR THE BEGINNING OF SAID GRANT. NOW, THEREFORE, CITY AND COUNCIL DO MUTUALLY AGREE: 1. THIS CONTRACT SHALL REMAIN IN FORCE UNTIL FEBRUARY 27, 1972• HOWEVER, EACH PARTY RESERVES THE RIGHT TO TERMINATE THE CONTRACT AT ANY TIME IN CASE OF VIOLATION BY 30 -DAY NOTICE IN WRITING OF ANY OF THE TERMS CONTAINED HEREIN BY THE OTHER PARTY. -2- WITNESS OUR HANDS IN DUPLICATE THIS THE 31ST DAY OF MARCH, 1971, CITY OF CORPUS CHRISTI ATTEST: BY R. ECRETARY Corpus Christi, Tex�s od1A t' day of , 19 -71 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
